Regulations on Labor Protection in Workplaces Where Toxic Substances Are Used
第一章 總則
Chapter I General Provisions
第一條
為了保證作業(yè)場(chǎng)所安全使用有毒物品，預(yù)防、控制和消除職業(yè)中毒危害，保護(hù)勞動(dòng)者的生命安全、身體健康及其相關(guān)權(quán)益，根據(jù)職業(yè)病防治法和其他有關(guān)法律、行政法規(guī)的規(guī)定，制定本條例。
Article 1 These Regulations are formulated in accordance with the provisions
of the Law on the Prevention and Control of Occupational Diseases and other
relevant laws and administrative regulations for the purposes of ensuring the
safe use of toxic substances in workplaces, preventing against, controlling, and
eliminating occupational poisoning hazards, and protecting workers' life safety,
body health and their relevant rights and interests.
第二條 作業(yè)場(chǎng)所使用有毒物品可能產(chǎn)生職業(yè)中毒危害的勞動(dòng)保護(hù)，適用本條例。
Article 2 These Regulations shall be applicable to labor protection against
possible occupational poisoning hazards due to the use of toxic substances in
workplaces.
第三條 按照有毒物品產(chǎn)生的職業(yè)中毒危害程度，有毒物品分為一般有毒物品和高毒物品。
Article 3 Toxic substances are classified into general toxic substances and
high toxic substances in light of the extent of occupational poisoning hazards
caused by toxic substances.
國(guó)家對(duì)作業(yè)場(chǎng)所使用高毒物品實(shí)行特殊管理。
The State exercises special control over the use of high toxic substances in
workplaces.
一般有毒物品目錄、高毒物品目錄由國(guó)務(wù)院衛(wèi)生行政部門(mén)會(huì)同有關(guān)部門(mén)依據(jù)國(guó)家標(biāo)準(zhǔn)制定、調(diào)整并公布。
The catalogues of general toxic substances and high toxic substances shall, on
the basis of the national standards, be formulated, adjusted and published by
the administrative department for public health under the State Council jointly
with the departments concerned.
第四條
從事使用有毒物品作業(yè)的用人單位（以下簡(jiǎn)稱(chēng)用人單位）應(yīng)當(dāng)使用符合國(guó)家標(biāo)準(zhǔn)的有毒物品，不得在作業(yè)場(chǎng)所使用國(guó)家明令禁止使用的有毒物品或者使用不符合國(guó)家標(biāo)準(zhǔn)的有毒物品。
Article 4 An employing unit that engages in the operations in which toxic
substances are used (hereinafter referred to as the employing unit) shall use
toxic substances that meet the national standards, and shall not use in
workplaces the toxic substances that are explicitly prohibited by the State, or
that fail to meet the national standards.
用人單位應(yīng)當(dāng)盡可能使用無(wú)毒物品；需要使用有毒物品的，應(yīng)當(dāng)優(yōu)先選擇使用低毒物品。
An employing unit shall, as possible as it can, use nontoxic substances; where
it is required to use toxic substances, low toxic substances shall be selected
for use with priority.
第五條 用人單位應(yīng)當(dāng)依照本條例和其他有關(guān)法律、行政法規(guī)的規(guī)定，采取有效的防護(hù)措施，預(yù)防職業(yè)中毒事故的發(fā)生，依法參加工傷保險(xiǎn)，保障勞動(dòng)者的生命安全和身體健康。
Article 5 An employing unit shall, in accordance with the provisions of these
Regulations and other relevant laws and administrative regulations, take
effective protective measures to prevent the occurrence of occupational
poisoning accidents, and buy work injury insurance according to law so as to
safeguard workers' life safety and body health.
第六條
國(guó)家鼓勵(lì)研制、開(kāi)發(fā)、推廣、應(yīng)用有利于預(yù)防、控制、消除職業(yè)中毒危害和保護(hù)勞動(dòng)者健康的新技術(shù)、新工藝、新材料；限制使用或者淘汰有關(guān)職業(yè)中毒危害嚴(yán)重的技術(shù)、工藝、材料；加強(qiáng)對(duì)有關(guān)職業(yè)病的機(jī)理和發(fā)生規(guī)律的基礎(chǔ)研究，提高有關(guān)職業(yè)病防治科學(xué)技術(shù)水平。
Article 6 The State encourages the research, development, popularization and
application of the new technologies, new techniques and new materials that are
beneficial to the prevention, control and elimination of occupational poisoning
hazards and to the protection of workers' health, restricts the use of, or
obsoletes, the technologies, techniques and materials that may cause serious
occupational poisoning hazards, and strengthens the basic research on the
mechanism and regular rules for occupational diseases so as to improve the level
of science and technology in the prevention and control of occupational
diseases.
第七條 禁止使用童工。
Article 7 Child laborers shall be prohibited from being employed.
用人單位不得安排未成年人和孕期、哺乳期的女職工從事使用有毒物品的作業(yè)。
An employing unit shall not assign minors and female employees in pregnancy or
lactation to engage in the operations in which toxic substances are used.
第八條
工會(huì)組織應(yīng)當(dāng)督促并協(xié)助用人單位開(kāi)展職業(yè)衛(wèi)生宣傳教育和培訓(xùn)，對(duì)用人單位的職業(yè)衛(wèi)生工作提出意見(jiàn)和建議，與用人單位就勞動(dòng)者反映的職業(yè)病防治問(wèn)題進(jìn)行協(xié)調(diào)并督促解決。
Article 8 Trade unions shall urge and assist employing units in the publicity,
education and training of occupational health, make proposals and suggestions
concerning employing units' occupational health work, and coordinate with and
urge the employing units to solve the problems in relation to the prevention and
control of occupational diseases that are reported by workers.
工會(huì)組織對(duì)用人單位違反法律、法規(guī)，侵犯勞動(dòng)者合法權(quán)益的行為，有權(quán)要求糾正；產(chǎn)生嚴(yán)重職業(yè)中毒危害時(shí)，有權(quán)要求用人單位采取防護(hù)措施，或者向政府有關(guān)部門(mén)建議采取強(qiáng)制性措施；
Trade unions shall have the right to demand corrections by employing units
committing acts of infringing upon workers' legal rights and interests in
violation of laws and regulations; in cases of serious occupational poisoning
hazards, they shall have the right to require the employing units to take
protective measures or suggest that the relevant departments of the people's
governments take compulsory measures;
發(fā)生職業(yè)中毒事故時(shí)，有權(quán)參與事故調(diào)查處理；發(fā)現(xiàn)危及勞動(dòng)者生命、健康的情形時(shí)，有權(quán)建議用人單位組織勞動(dòng)者撤離危險(xiǎn)現(xiàn)場(chǎng)，用人單位應(yīng)當(dāng)立即作出處理。
in case of occupational poisoning accidents, they shall have the right to
participate in the investigation and handling of the accidents; under
circumstances in which workers' lives and health are jeopardized, they shall
have the right to suggest that the employing units should organize the
evacuation of the workers from the premises in danger, and the employing units
shall immediately take such measures.
第九條
縣級(jí)以上人民政府衛(wèi)生行政部門(mén)及其他有關(guān)行政部門(mén)應(yīng)當(dāng)依據(jù)各自的職責(zé)，監(jiān)督用人單位嚴(yán)格遵守本條例和其他有關(guān)法律、法規(guī)的規(guī)定，加強(qiáng)作業(yè)場(chǎng)所使用有毒物品的勞動(dòng)保護(hù)，防止職業(yè)中毒事故發(fā)生，確保勞動(dòng)者依法享有的權(quán)利。
Article 9 The administrative departments for public health and other relevant
departments of the people's governments at or above the county level shall, in
light of their respective functions and responsibilities, supervise employing
units’ strict compliance of the provisions of these Regulations and other
relevant laws and regulations, strengthen the labor protection against the use
of toxic substances in workplaces, prevent the occurrence of occupational
poisoning accidents, and ensure the rights enjoyed by the workers according to
law.
第十條
各級(jí)人民政府應(yīng)當(dāng)加強(qiáng)對(duì)使用有毒物品作業(yè)場(chǎng)所職業(yè)衛(wèi)生安全及相關(guān)勞動(dòng)保護(hù)工作的領(lǐng)導(dǎo)，督促、支持衛(wèi)生行政部門(mén)及其他有關(guān)行政部門(mén)依法履行監(jiān)督檢查職責(zé)，及時(shí)協(xié)調(diào)、解決有關(guān)重大問(wèn)題；
Article 10 The people's governments at all levels shall strengthen the
leadership over the occupational health and safety as well as the relevant labor
protection in the workplaces where toxic substances are used, urge and support
the administrative departments for public health and other relevant
administrative departments to fulfill their functions and responsibilities of
supervision and inspection according to law, and coordinate the work of solving
relevant major problems in time;
在發(fā)生職業(yè)中毒事故時(shí)，應(yīng)當(dāng)采取有效措施，控制事故危害的蔓延并消除事故危害，并妥善處理有關(guān)善后工作。
in case of occupational poisoning accidents, they shall take effective
measures to control the spreading of the accidental hazards and eliminate the
accidental hazards, and deal with problems arising from the accidents.
第二章 作業(yè)場(chǎng)所的預(yù)防措施
Chapter II Preventive Measures in Workplaces
第十一條 用人單位的設(shè)立，應(yīng)當(dāng)符合有關(guān)法律、行政法規(guī)規(guī)定的設(shè)立條件，并依法辦理有關(guān)手續(xù)，取得營(yíng)業(yè)執(zhí)照。
Article 11 The establishment of an employing unit shall meet the conditions
provided for in the relevant laws and administrative regulations, the relevant
formalities shall be gone through according to law, and the business license
shall be obtained.
用人單位的使用有毒物品作業(yè)場(chǎng)所，除應(yīng)當(dāng)符合職業(yè)病防治法規(guī)定的職業(yè)衛(wèi)生要求外，還必須符合下列要求：
The employing unit's workplaces where toxic substances are used shall, in
addition to the occupational health requirements provided for in the Law on the
Prevention and Control of Occupational Diseases, also meet the following
conditions:
?。ㄒ唬┳鳂I(yè)場(chǎng)所與生活場(chǎng)所分開(kāi)，作業(yè)場(chǎng)所不得住人；
(1) the workplaces must be separated from the living areas, and no person
shall reside in the workplaces;
?。ǘ┯泻ψ鳂I(yè)與無(wú)害作業(yè)分開(kāi)，高毒作業(yè)場(chǎng)所與其他作業(yè)場(chǎng)所隔離；
(2) the harmful operations must be separated from the harmless operations, and
the workplaces where high toxic substances are used shall be isolated from other
workplaces;
?。ㄈ┰O(shè)置有效的通風(fēng)裝置；可能突然泄漏大量有毒物品或者易造成急性中毒的作業(yè)場(chǎng)所，設(shè)置自動(dòng)報(bào)警裝置和事故通風(fēng)設(shè)施；
(3) effective ventilation facilities shall be installed, and automatic alarm
facilities and ventilation facilities for accidents shall be installed in the
workplaces in case a large quantity of toxic substances may suddenly leak out or
acute poisoning may be easily caused; and
?。ㄋ模└叨咀鳂I(yè)場(chǎng)所設(shè)置應(yīng)急撤離通道和必要的泄險(xiǎn)區(qū)。
(4) emergency exits for evacuation and necessary hazard-eliminating areas
shall be set up in the workplaces where high toxic substances are used.
用人單位及其作業(yè)場(chǎng)所符合前兩款規(guī)定的，由衛(wèi)生行政部門(mén)發(fā)給職業(yè)衛(wèi)生安全許可證，方可從事使用有毒物品的作業(yè)。
The employing unit and its workplaces that meet the conditions provided for in
the preceding two paragraphs shall not engage in the operations in which toxic
substances are used unless the administrative department for public health has
issued the occupational health and safety license to it.
第十二條 使用有毒物品作業(yè)場(chǎng)所應(yīng)當(dāng)設(shè)置黃色區(qū)域警示線(xiàn)、警示標(biāo)識(shí)和中文警示說(shuō)明。
Article 12 The yellow area-warning lines, warning marks, and warning
specifications in Chinese shall be displayed in the workplaces where toxic
substances are used.
警示說(shuō)明應(yīng)當(dāng)載明產(chǎn)生職業(yè)中毒危害的種類(lèi)、后果、預(yù)防以及應(yīng)急救治措施等內(nèi)容。
Warning specifications shall indicate varieties and consequences of
occupational poisoning hazards and the corresponding preventive measures and
emergency measures.
高毒作業(yè)場(chǎng)所應(yīng)當(dāng)設(shè)置紅色區(qū)域警示線(xiàn)、警示標(biāo)識(shí)和中文警示說(shuō)明，并設(shè)置通訊報(bào)警設(shè)備。
The red area-warning lines, warning marks, and warning specifications in
Chinese shall be displayed, and communication and alarm equipment shall be
installed in the workplaces where high toxic substances are used.
第十三條
新建、擴(kuò)建、改建的建設(shè)項(xiàng)目和技術(shù)改造、技術(shù)引進(jìn)項(xiàng)目（以下統(tǒng)稱(chēng)建設(shè)項(xiàng)目），可能產(chǎn)生職業(yè)中毒危害的，應(yīng)當(dāng)依照職業(yè)病防治法的規(guī)定進(jìn)行職業(yè)中毒危害預(yù)評(píng)價(jià)，并經(jīng)衛(wèi)生行政部門(mén)審核同意；
Article 13 Building projects, rebuilding projects, extension projects,
technological transformation projects, and technology-introduction projects
(hereinafter collectively referred to as the construction projects) likely to
cause occupational poisoning hazards shall be subject to a pre-evaluation of the
occupational poisoning hazards in accordance with the provisions of the Law on
the Prevention and Control of Occupational Diseases, and shall pass the
examination and obtain the approval of the administrative departments for public
health.
可能產(chǎn)生職業(yè)中毒危害的建設(shè)項(xiàng)目的職業(yè)中毒危害防護(hù)設(shè)施應(yīng)當(dāng)與主體工程同時(shí)設(shè)計(jì)，同時(shí)施工，同時(shí)投入生產(chǎn)和使用；
The safeguards against occupational poisoning hazards for a construction
project that is likely to cause occupational poisoning hazards shall be
designed, constructed and put into production and utilization simultaneously
with the project's principal part.
建設(shè)項(xiàng)目竣工，應(yīng)當(dāng)進(jìn)行職業(yè)中毒危害控制效果評(píng)價(jià)，并經(jīng)衛(wèi)生行政部門(mén)驗(yàn)收合格。
After a construction project is completed, the effect of control over
occupational poisoning hazards shall be evaluated, and the project shall be
subject to the inspection for acceptance by the administrative department for
public health.
存在高毒作業(yè)的建設(shè)項(xiàng)目的職業(yè)中毒危害防護(hù)設(shè)施設(shè)計(jì)，應(yīng)當(dāng)經(jīng)衛(wèi)生行政部門(mén)進(jìn)行衛(wèi)生審查；經(jīng)審查，符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)和衛(wèi)生要求的，方可施工。
The design of safeguards against occupational poisoning hazards for a
construction project involving the operations with high toxic substances shall
be subject to the hygienic examination by the administrative department for
public health. The design shall not be put into construction unless it has met
the national occupational health standards and hygienic requirements upon
examination.
第十四條 用人單位應(yīng)當(dāng)按照國(guó)務(wù)院衛(wèi)生行政部門(mén)的規(guī)定，向衛(wèi)生行政部門(mén)及時(shí)、如實(shí)申報(bào)存在職業(yè)中毒危害項(xiàng)目。
Article 14 The employing units shall, in accordance with the provisions of the
administrative department for public health under the State Council, promptly
and truthfully declare the operation items which involve the occupational
poisoning hazards to the administrative departments for public health.
從事使用高毒物品作業(yè)的用人單位，在申報(bào)使用高毒物品作業(yè)項(xiàng)目時(shí)，應(yīng)當(dāng)向衛(wèi)生行政部門(mén)提交下列有關(guān)資料：
An employing unit that engages in the operations in which high toxic
substances are used shall, when declaring operation items with the use of high
toxic substances, submit the following materials to the administrative
department for public health:
?。ㄒ唬┞殬I(yè)中毒危害控制效果評(píng)價(jià)報(bào)告；
(1) the evaluation report on the effect of control over occupational poisoning
hazards;
?。ǘ┞殬I(yè)衛(wèi)生管理制度和操作規(guī)程等材料；
(2) materials of the occupational health administrative system and operating
rules; and
?。ㄈ┞殬I(yè)中毒事故應(yīng)急救援預(yù)案。
(3) emergency and first-aid pre-scheme against occupational poisoning
accidents.
從事使用高毒物品作業(yè)的用人單位變更所使用的高毒物品品種的，應(yīng)當(dāng)依照前款規(guī)定向原受理申報(bào)的衛(wèi)生行政部門(mén)重新申報(bào)。
An employing unit that engages in the operations in which high toxic
substances are used shall, when it changes varieties of the high toxic
substances used, make anew declarations to the administrative department for
public health that originally accepted its declarations in accordance with the
provisions of the preceding paragraph.
第十五條 用人單位變更名稱(chēng)、法定代表人或者負(fù)責(zé)人的，應(yīng)當(dāng)向原受理申報(bào)的衛(wèi)生行政部門(mén)備案。
Article15 An employing unit which changes its name, legal representative, or
person in charge shall make a report thereon for the record to the
administrative department for public health that originally accepted its
declarations.
第十六條
從事使用高毒物品作業(yè)的用人單位，應(yīng)當(dāng)配備應(yīng)急救援人員和必要的應(yīng)急救援器材、設(shè)備，制定事故應(yīng)急救援預(yù)案，并根據(jù)實(shí)際情況變化對(duì)應(yīng)急救援預(yù)案適時(shí)進(jìn)行修訂，定期組織演練。
Article 16 An employing unit that engages in the operations in which high
toxic substances are used shall assign emergency and first-aid personnel and
equip itself with necessary emergency and first-aid devices and equipment,
formulate emergency and first-aid pre-schemes, revise such pre-schemes in good
time according to the practical situations, and organize rehearsals at regular
intervals.
事故應(yīng)急救援預(yù)案和演練記錄應(yīng)當(dāng)報(bào)當(dāng)?shù)匦l(wèi)生行政部門(mén)、安全生產(chǎn)監(jiān)督管理部門(mén)和公安部門(mén)備案。
The emergency and first-aid pre-schemes and rehearsal records shall be
reported for the record to the local administrative department for public
health, the department in charge of supervision on production safety, and the
department of public security.
第三章 勞動(dòng)過(guò)程的防護(hù)
Chapter III Protection in Working Process
第十七條 用人單位應(yīng)當(dāng)依照職業(yè)病防治法的有關(guān)規(guī)定，采取有效的職業(yè)衛(wèi)生防護(hù)管理措施，加強(qiáng)勞動(dòng)過(guò)程中的防護(hù)與管理。
Article 17 An employing unit shall, in accordance with the relevant provisions
of the Law on the Prevention and Control of Occupational Diseases, take
effective occupational health protection and management measures to strengthen
the protection and management for working process.
從事使用高毒物品作業(yè)的用人單位，應(yīng)當(dāng)配備專(zhuān)職的或者兼職的職業(yè)衛(wèi)生醫(yī)師和護(hù)士；
The employing units that engage in the operations in which high toxic
substances are used shall assign the full-time or part-time occupational health
doctors and nurses.
不具備配備專(zhuān)職的或者兼職的職業(yè)衛(wèi)生醫(yī)師和護(hù)士條件的，應(yīng)當(dāng)與依法取得資質(zhì)認(rèn)證的職業(yè)衛(wèi)生技術(shù)服務(wù)機(jī)構(gòu)簽訂合同，由其提供職業(yè)衛(wèi)生服務(wù)。
Where they have no conditions to assign such doctors and nurses, they shall
sign contracts with the occupational health and technical service agencies that
have obtained qualification certification according to law for the provision of
occupational health services.
第十八條
用人單位應(yīng)當(dāng)與勞動(dòng)者訂立勞動(dòng)合同，將工作過(guò)程中可能產(chǎn)生的職業(yè)中毒危害及其后果、職業(yè)中毒危害防護(hù)措施和待遇等如實(shí)告知?jiǎng)趧?dòng)者，并在勞動(dòng)合同中寫(xiě)明，不得隱瞞或者欺騙。
Article 18 The employing units shall sign labor contracts with their workers,
truthfully inform the workers of the possible occupational poisoning hazards in
the working process and the corresponding consequences, the safeguards against
occupational poisoning hazards and the welfares, and clearly state such
information in the labor contracts without any concealment or cheating.
勞動(dòng)者在已訂立勞動(dòng)合同期間因工作崗位或者工作內(nèi)容變更，從事勞動(dòng)合同中未告知的存在職業(yè)中毒危害的作業(yè)時(shí)，用人單位應(yīng)當(dāng)依照前款規(guī)定，如實(shí)告知?jiǎng)趧?dòng)者，并協(xié)商變更原勞動(dòng)合同有關(guān)條款。
Where the workers change their operating posts or work contents during the
term of the labor contracts concluded and engage in the operations involving
occupational poisoning hazards that are not specified in the labor contracts,
the employing units shall, in accordance with the provisions of the preceding
paragraph, truthfully inform the workers, and modify the relevant terms and
conditions in the original labor contracts through consultation.
用人單位違反前兩款規(guī)定的，勞動(dòng)者有權(quán)拒絕從事存在職業(yè)中毒危害的作業(yè)，用人單位不得因此單方面解除或者終止與勞動(dòng)者所訂立的勞動(dòng)合同。
Where the employing units violate the provisions of the preceding two
paragraphs, their workers shall have the right to refuse to engage in the
operations involving occupational poisoning hazards, and consequently the
employing units shall not unilaterally dissolve or terminate the labor contracts
concluded with the workers.
第十九條 用人單位有關(guān)管理人員應(yīng)當(dāng)熟悉有關(guān)職業(yè)病防治的法律、法規(guī)以及確保勞動(dòng)者安全使用有毒物品作業(yè)的知識(shí)。
Article 19 The relevant managing personnel of the employing units shall be
familiar with the relevant laws and regulations on prevention and control of
occupational diseases, and with the knowledge of ensuring the safe use of toxic
substances by the workers in their operations.
用人單位應(yīng)當(dāng)對(duì)勞動(dòng)者進(jìn)行上崗前的職業(yè)衛(wèi)生培訓(xùn)和在崗期間的定期職業(yè)衛(wèi)生培訓(xùn)，普及有關(guān)職業(yè)衛(wèi)生知識(shí)，督促勞動(dòng)者遵守有關(guān)法律、法規(guī)和操作規(guī)程，指導(dǎo)勞動(dòng)者正確使用職業(yè)中毒危害防護(hù)設(shè)備和個(gè)人使用的職業(yè)中毒危害防護(hù)用品。
The employing units shall provide occupational health training before the
workers take up their jobs, and conduct regular occupational health training
when the workers are at posts, popularize the relevant occupational health
knowledge, supervise and urge the workers to abide by the relevant laws,
regulations and operating rules, and guide the workers to correctly use
safeguards against occupational health hazards and individual protective
appliances against occupational health hazards.
勞動(dòng)者經(jīng)培訓(xùn)考核合格，方可上崗作業(yè)。
The workers shall not take up their jobs unless they have received the
training and passed the examination.
第二十條 用人單位應(yīng)當(dāng)確保職業(yè)中毒危害防護(hù)設(shè)備、應(yīng)急救援設(shè)施、通訊報(bào)警裝置處于正常適用狀態(tài)，不得擅自拆除或者停止運(yùn)行。
Article 20 The employing units shall guarantee the normal service conditions
of the safeguards against occupational health hazards, emergency and first-aid
facilities, and communication and alarm facilities, and shall not dismantle them
or stop the use of them without authorization.
用人單位應(yīng)當(dāng)對(duì)前款所列設(shè)施進(jìn)行經(jīng)常性的維護(hù)、檢修，定期檢測(cè)其性能和效果，確保其處于良好運(yùn)行狀態(tài)。
The employing units shall frequently maintain and overhaul safeguards and
facilities as specified in the preceding paragraph, test their performances and
effects at regular intervals, and ensure they are in good conditions.
職業(yè)中毒危害防護(hù)設(shè)備、應(yīng)急救援設(shè)施和通訊報(bào)警裝置處于不正常狀態(tài)時(shí)，用人單位應(yīng)當(dāng)立即停止使用有毒物品作業(yè)；恢復(fù)正常狀態(tài)后，方可重新作業(yè)。
In case that safeguards against occupational health hazards, emergency and
first-aid facilities, and communication and alarm facilities are in abnormal
conditions, the employing units shall immediately stop the operations in which
toxic substances are used. The operations shall not restart unless all the
aforesaid equipment and facilities are recovered to work normally.
第二十一條 用人單位應(yīng)當(dāng)為從事使用有毒物品作業(yè)的勞動(dòng)者提供符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)的防護(hù)用品，并確保勞動(dòng)者正確使用。
Article 21 The employing units shall provide protective appliances that meet
the national occupational health standards to their workers engaging in the
operations in which toxic substances are used, and ensure their workers’ correct
use of such appliances.
第二十二條
有毒物品必須附具說(shuō)明書(shū)，如實(shí)載明產(chǎn)品特性、主要成分、存在的職業(yè)中毒危害因素、可能產(chǎn)生的危害后果、安全使用注意事項(xiàng)、職業(yè)中毒危害防護(hù)以及應(yīng)急救治措施等內(nèi)容；
Article 22 Toxic substances shall be attached with the specifications to
indicate the true information such as product property, essential ingredients,
existing factors of occupational poisoning hazards, possible dangerous
consequences, precaution items for safe use, measures to prevent occupational
poisoning hazards and the corresponding emergency and first-aid measures.
沒(méi)有說(shuō)明書(shū)或者說(shuō)明書(shū)不符合要求的，不得向用人單位銷(xiāo)售。
Toxic substances without the specifications or with unqualified specifications
shall not be sold to the employing units.
用人單位有權(quán)向生產(chǎn)、經(jīng)營(yíng)有毒物品的單位索取說(shuō)明書(shū)。
The employing units shall have the right to demand the specifications from
units that manufacture or trade in toxic substances.
第二十三條 有毒物品的包裝應(yīng)當(dāng)符合國(guó)家標(biāo)準(zhǔn)，并以易于勞動(dòng)者理解的方式加貼或者拴掛有毒物品安全標(biāo)簽。有毒物品的包裝必須有醒目的警示標(biāo)識(shí)和中文警示說(shuō)明。
Article 23 Packages for toxic substances shall meet the national standards,
and the safety labels for poisoning articles shall be stuck or fastened thereto
in a way easily comprehensible to the workers. Packages for toxic substances
shall have conspicuous warning marks and warning specifications in Chinese.
經(jīng)營(yíng)、使用有毒物品的單位，不得經(jīng)營(yíng)、使用沒(méi)有安全標(biāo)簽、警示標(biāo)識(shí)和中文警示說(shuō)明的有毒物品。
Units that trade in or use toxic substances shall not trade in nor use toxic
substances without safety labels, warning marks and warning specifications in
Chinese.
第二十四條 用人單位維護(hù)、檢修存在高毒物品的生產(chǎn)裝置，必須事先制訂維護(hù)、檢修方案，明確職業(yè)中毒危害防護(hù)措施，確保維護(hù)、檢修人員的生命安全和身體健康。
Article 24 The employing units shall, when maintaining or overhauling
production installations involving the use of high toxic substances, work out
maintenance or overhaul scheme in advance to specify protective measures against
occupational poisoning hazards, so as to safeguard the maintenance or overhaul
staff's life safety and body health.
維護(hù)、檢修存在高毒物品的生產(chǎn)裝置，必須嚴(yán)格按照維護(hù)、檢修方案和操作規(guī)程進(jìn)行。維護(hù)、檢修現(xiàn)場(chǎng)應(yīng)當(dāng)有專(zhuān)人監(jiān)護(hù)，并設(shè)置警示標(biāo)志。
Maintenance or overhaul of production installations involving the use of high
toxic substances shall be in strict accordance with the maintenance or overhaul
scheme and the operating rules. There shall be the specialized personnel to
supervise the maintenance or overhaul sites, and the corresponding warning marks
shall be displayed.
第二十五條 需要進(jìn)入存在高毒物品的設(shè)備、容器或者狹窄封閉場(chǎng)所作業(yè)時(shí)，用人單位應(yīng)當(dāng)事先采取下列措施：
Article 25 Where it is required to enter and conduct operations in equipment,
containers, or narrow or closed workplaces with high toxic substances, the
employing units shall take the following measures in advance:
?。ㄒ唬┍３肿鳂I(yè)場(chǎng)所良好的通風(fēng)狀態(tài)，確保作業(yè)場(chǎng)所職業(yè)中毒危害因素濃度符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)；
(1) to keep the workplaces in good ventilation conditions, and ensure that the
concentration of factors of occupational poisoning hazards in the workplaces
meet the national occupational health standards;
（二）為勞動(dòng)者配備符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)的防護(hù)用品；
(2) to provide their workers with protective appliances that meet the national
occupational health standards; and
?。ㄈ┰O(shè)置現(xiàn)場(chǎng)監(jiān)護(hù)人員和現(xiàn)場(chǎng)救援設(shè)備。
(3) to assign the supervisory personnel and install the first-aid equipment on
the spot.
未采取前款規(guī)定措施或者采取的措施不符合要求的，用人單位不得安排勞動(dòng)者進(jìn)入存在高毒物品的設(shè)備、容器或者狹窄封閉場(chǎng)所作業(yè)。
In case that the measures specified in the preceding paragraph are not taken
or the measures taken fail to satisfy the requirements, the employing units
shall not assign their workers to enter and conduct operations in equipment,
containers, or narrow or closed workplaces with high toxic substances.
第二十六條 用人單位應(yīng)當(dāng)按照國(guó)務(wù)院衛(wèi)生行政部門(mén)的規(guī)定，定期對(duì)使用有毒物品作業(yè)場(chǎng)所職業(yè)中毒危害因素進(jìn)行檢測(cè)、評(píng)價(jià)。
Article 26 The employing units shall, in accordance with the provisions of the
administrative department for public health under the State Council, regularly
test and evaluate the factors of occupational poising hazards in the workplaces
where toxic substances are used.
檢測(cè)、評(píng)價(jià)結(jié)果存入用人單位職業(yè)衛(wèi)生檔案，定期向所在地衛(wèi)生行政部門(mén)報(bào)告并向勞動(dòng)者公布。
The test and evaluation results shall be kept in the employing units'
occupational health archives, and shall be reported at regular intervals to the
local administrative departments for public health and announced to the workers.
從事使用高毒物品作業(yè)的用人單位應(yīng)當(dāng)至少每一個(gè)月對(duì)高毒作業(yè)場(chǎng)所進(jìn)行一次職業(yè)中毒危害因素檢測(cè)；至少每半年進(jìn)行一次職業(yè)中毒危害控制效果評(píng)價(jià)。
The employing units that engage in the operations in which high toxic
substances are used shall, at least once a month, detect factors of occupational
poisoning hazards in the workplaces where high toxic substances are used, and
shall evaluate the effect of control over occupational poisoning hazards at
least once every six months.
高毒作業(yè)場(chǎng)所職業(yè)中毒危害因素不符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)和衛(wèi)生要求時(shí)，用人單位必須立即停止高毒作業(yè)，并采取相應(yīng)的治理措施；
When factors of occupational poisoning hazards in the workplaces where high
toxic substances are used fail to meet the national occupational health
standards and hygienic requirements, the employing units shall immediately stop
operations involving high toxic substances, and take the corresponding control
measures.
經(jīng)治理，職業(yè)中毒危害因素符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)和衛(wèi)生要求的，方可重新作業(yè)。
The operations shall not restart unless the aforesaid factors have met the
national occupational health standards and hygienic requirements after control
measures are taken.
第二十七條 從事使用高毒物品作業(yè)的用人單位應(yīng)當(dāng)設(shè)置淋浴間和更衣室，并設(shè)置清洗、存放或者處理從事使用高毒物品作業(yè)勞動(dòng)者的工作服、工作鞋帽等物品的專(zhuān)用間。
Article 27 The employing units that engage in the operations in which high
toxic substances are used shall set up shower compartments and changing cabins
as well as specialized compartments to wash, store, or dispose of working
clothes, shoes, caps, etc. of the workers engaging in the operations in which
high toxic substances are used.
勞動(dòng)者結(jié)束作業(yè)時(shí)，其使用的工作服、工作鞋帽等物品必須存放在高毒作業(yè)區(qū)域內(nèi)，不得穿戴到非高毒作業(yè)區(qū)域。
After the workers complete their operations, working clothes, shoes, caps,
etc. used by them shall be stored in the workplaces where high toxic substances
are used, and shall not be worn in the workplaces where high toxic substances
are not used.
第二十八條 用人單位應(yīng)當(dāng)按照規(guī)定對(duì)從事使用高毒物品作業(yè)的勞動(dòng)者進(jìn)行崗位輪換。
Article 28 The employing units shall, according to the provisions, shift posts
for the workers engaging in the operations in which high toxic substances are
used.
用人單位應(yīng)當(dāng)為從事使用高毒物品作業(yè)的勞動(dòng)者提供崗位津貼。
The employing units shall provide allowances to the workers engaging in the
operations in which high toxic substances are used.
第二十九條 用人單位轉(zhuǎn)產(chǎn)、停產(chǎn)、停業(yè)或者解散、破產(chǎn)的，應(yīng)當(dāng)采取有效措施，妥善處理留存或者殘留有毒物品的設(shè)備、包裝物和容器。
Article 29 Where the employing units halt production, change the line of
production, or are shut down or dissolved, or go into bankruptcy, they shall
take effective measures to dispose of equipment, packages, and containers with
the residues of toxic substances.
第三十條 用人單位應(yīng)當(dāng)對(duì)本單位執(zhí)行本條例規(guī)定的情況進(jìn)行經(jīng)常性的監(jiān)督檢查；發(fā)現(xiàn)問(wèn)題，應(yīng)當(dāng)及時(shí)依照本條例規(guī)定的要求進(jìn)行處理。
Article 30 The employing units shall frequently supervise and inspect their
implementation of the provisions of these Regulations, and shall promptly solve
the discovered problems in accordance with the requirements as provided for in
these Regulations.
第四章 職業(yè)健康監(jiān)護(hù)
Chapter IV Occupational Health Surveillance
第三十一條 用人單位應(yīng)當(dāng)組織從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行上崗前職業(yè)健康檢查。
Article 31 The employing units shall organize their workers engaging in the
operations in which toxic substances are used to receive occupational health
examinations before taking up their jobs.
用人單位不得安排未經(jīng)上崗前職業(yè)健康檢查的勞動(dòng)者從事使用有毒物品的作業(yè)，不得安排有職業(yè)禁忌的勞動(dòng)者從事其所禁忌的作業(yè)。
The employing units shall neither assign the workers who have not received
occupational health examinations before taking up their jobs to engage in the
operations in which toxic substances are used, nor assign taboo-bound workers to
engage in taboo operations.
第三十二條 用人單位應(yīng)當(dāng)對(duì)從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行定期職業(yè)健康檢查。
Article 32 The employing units shall organize their workers engaging in the
operations in which toxic substances are used to receive occupational health
examinations at regular intervals.
用人單位發(fā)現(xiàn)有職業(yè)禁忌或者有與所從事職業(yè)相關(guān)的健康損害的勞動(dòng)者，應(yīng)當(dāng)將其及時(shí)調(diào)離原工作崗位，并妥善安置。
When finding that the workers with occupational taboos or health injuries
relating to their jobs, the employing units shall remove them from their
original posts in time, and make appropriate arrangements for them.
用人單位對(duì)需要復(fù)查和醫(yī)學(xué)觀察的勞動(dòng)者，應(yīng)當(dāng)按照體檢機(jī)構(gòu)的要求安排其復(fù)查和醫(yī)學(xué)觀察。
With respect to the workers for whom the reexaminations and medical
observations are required, the employing units shall arrange reexaminations and
medical observations for them in accordance with the requirements of the
physical examination institutions.
第三十三條 用人單位應(yīng)當(dāng)對(duì)從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行離崗時(shí)的職業(yè)健康檢查；對(duì)離崗時(shí)未進(jìn)行職業(yè)健康檢查的勞動(dòng)者，不得解除或者終止與其訂立的勞動(dòng)合同。
Article 33 The employing units shall organize their workers engaging in the
operations in which toxic substances are used to receive post-leaving
occupational health examinations, and shall not rescind or terminate the labor
contracts concluded with the workers who have not received the post-leaving
occupational health examinations.
用人單位發(fā)生分立、合并、解散、破產(chǎn)等情形的，應(yīng)當(dāng)對(duì)從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行健康檢查，并按照國(guó)家有關(guān)規(guī)定妥善安置職業(yè)病病人。
In case that the employing units are divided, merged, dissolved, or go into
bankruptcy, they shall arrange health examinations for the workers engaging in
the operations in which toxic substances are used and make appropriate
arrangements for the patients suffering from occupational diseases in accordance
with the relevant provisions of the State.
第三十四條 用人單位對(duì)受到或者可能受到急性職業(yè)中毒危害的勞動(dòng)者，應(yīng)當(dāng)及時(shí)組織進(jìn)行健康檢查和醫(yī)學(xué)觀察。
Article 34 The employing units shall duly arrange health examinations and
medical observations for their workers who have suffered or are likely to suffer
acute occupational poisoning hazards.
第三十五條 勞動(dòng)者職業(yè)健康檢查和醫(yī)學(xué)觀察的費(fèi)用，由用人單位承擔(dān)。
Article 35 The employing units shall bear expenses for the occupational health
examinations and medical observations for their workers.
第三十六條 用人單位應(yīng)當(dāng)建立職業(yè)健康監(jiān)護(hù)檔案。
Article 36 The employing units shall establish occupational health
surveillance archives.
職業(yè)健康監(jiān)護(hù)檔案應(yīng)當(dāng)包括下列內(nèi)容：
The occupational health surveillance archives shall cover the following items:
?。ㄒ唬﹦趧?dòng)者的職業(yè)史和職業(yè)中毒危害接觸史；
(1) workers' occupational history, and the history of exposure to occupational
poisoning hazards;
（二）相應(yīng)作業(yè)場(chǎng)所職業(yè)中毒危害因素監(jiān)測(cè)結(jié)果；
(2) monitoring results of factors of occupational poisoning hazards in
corresponding workplaces;
?。ㄈ┞殬I(yè)健康檢查結(jié)果及處理情況；
(3) occupational health examination results and the disposition; and
（四）職業(yè)病診療等勞動(dòng)者健康資料。
(4) materials relating to workers' health, including diagnosis and treatment
of occupational diseases.
第五章 勞動(dòng)者的權(quán)利與義務(wù)
Chapter V Workers' Rights and Obligations
第三十七條 從事使用有毒物品作業(yè)的勞動(dòng)者在存在威脅生命安全或者身體健康危險(xiǎn)的情況下，有權(quán)通知用人單位并從使用有毒物品造成的危險(xiǎn)現(xiàn)場(chǎng)撤離。
Article 37 In case of threat to life safety or hazard to physical health of
the workers engaging in the operations in which toxic substances are used, the
workers shall have the right to notify the employing units and to evacuate from
the premises in danger caused by using toxic substances.
用人單位不得因勞動(dòng)者依據(jù)前款規(guī)定行使權(quán)利，而取消或者減少勞動(dòng)者在正常工作時(shí)享有的工資、福利待遇。
The employing units shall not cancel or reduce wages and benefits enjoyed by
the workers in normal working hours if the workers exercise the rights specified
in the preceding paragraph.
第三十八條 勞動(dòng)者享有下列職業(yè)衛(wèi)生保護(hù)權(quán)利：
Article 38 The workers shall enjoy the following occupational health
protection rights:
?。ㄒ唬┇@得職業(yè)衛(wèi)生教育、培訓(xùn)；
(1) to receive occupational health education and training;
?。ǘ┇@得職業(yè)健康檢查、職業(yè)病診療、康復(fù)等職業(yè)病防治服務(wù)；
(2) to receive occupational diseases prevention and control services,
including occupational health examination, diagnosis, treatment and
rehabilitation of occupational diseases;
（三）了解工作場(chǎng)所產(chǎn)生或者可能產(chǎn)生的職業(yè)中毒危害因素、危害后果和應(yīng)當(dāng)采取的職業(yè)中毒危害防護(hù)措施；
(3) to learn factors of occupational poisoning hazards that have been caused
or are likely to be caused in workplaces, the consequences, and preventive
measures against such hazards to be taken;
?。ㄋ模┮笥萌藛挝惶峁┓戏乐温殬I(yè)病要求的職業(yè)中毒危害防護(hù)設(shè)施和個(gè)人使用的職業(yè)中毒危害防護(hù)用品，改善工作條件；
(4) to require the employing units to provide safeguards against occupational
poisoning hazards that satisfy the requirements for the prevention and control
of occupational diseases and individual preventive appliances against
occupational poisoning hazards, and to improve the working conditions;
?。ㄎ澹?duì)違反職業(yè)病防治法律、法規(guī)，危及生命、健康的行為提出批評(píng)、檢舉和控告；
(5) to criticize, make exposures of or charges against any act of jeopardizing
the life and health in violation of laws and regulations on the prevention and
control of occupational diseases;
?。┚芙^違章指揮和強(qiáng)令進(jìn)行沒(méi)有職業(yè)中毒危害防護(hù)措施的作業(yè)；
(6) to refuse any command in violation of regulations or any order to conduct
operations without safeguards against occupational poisoning hazards; and
?。ㄆ撸﹨⑴c用人單位職業(yè)衛(wèi)生工作的民主管理，對(duì)職業(yè)病防治工作提出意見(jiàn)和建議。
(7) to participate in the employing units' democratic management in the work
involving occupational health, and make comments and suggestions for the
prevention and control of occupational diseases.
用人單位應(yīng)當(dāng)保障勞動(dòng)者行使前款所列權(quán)利。禁止因勞動(dòng)者依法行使正當(dāng)權(quán)利而降低其工資、福利等待遇或者解除、終止與其訂立的勞動(dòng)合同。
The employing units shall guarantee the exercise of the rights by the workers
as specified in the preceding paragraph. It shall be prohibited from reducing
workers' wages, welfares or other benefits, or rescinding or terminating the
labor contracts concluded with the workers because the workers exercise their
legitimate rights according to law.
第三十九條 勞動(dòng)者有權(quán)在正式上崗前從用人單位獲得下列資料：
Article 39 The workers shall have the right to obtain the following materials
from the employing units before they take up their jobs:
?。ㄒ唬┳鳂I(yè)場(chǎng)所使用的有毒物品的特性、有害成分、預(yù)防措施、教育和培訓(xùn)資料；
(1) properties and harmful ingredients of toxic substances used in workplaces,
preventive measures, education and training materials;
?。ǘ┯卸疚锲返臉?biāo)簽、標(biāo)識(shí)及有關(guān)資料；
(2) labels, marks, and the relevant materials of toxic substances;
?。ㄈ┯卸疚锲钒踩褂谜f(shuō)明書(shū)；
(3) the specifications for the safe use of toxic substances; and
?。ㄋ模┛赡苡绊懓踩褂糜卸疚锲返钠渌嘘P(guān)資料。
(4) other relevant materials which are likely to affect the safe use of toxic
substances.
第四十條 勞動(dòng)者有權(quán)查閱、復(fù)印其本人職業(yè)健康監(jiān)護(hù)檔案。
Article 40 The workers shall have the right to consult or copy their own
archives of occupational health surveillance.
勞動(dòng)者離開(kāi)用人單位時(shí)，有權(quán)索取本人健康監(jiān)護(hù)檔案復(fù)印件；用人單位應(yīng)當(dāng)如實(shí)、無(wú)償提供，并在所提供的復(fù)印件上簽章。
The workers shall have the right to demand duplicate copies of their health
surveillance archives when leaving the employing units, and the employing units
shall truthfully provide such duplicate copies at no charge and affix their
seals on the duplicate copies they provide.
第四十一條 用人單位按照國(guó)家規(guī)定參加工傷保險(xiǎn)的，患職業(yè)病的勞動(dòng)者有權(quán)按照國(guó)家有關(guān)工傷保險(xiǎn)的規(guī)定，享受下列工傷保險(xiǎn)待遇：
Article 41 Where an employing unit has bought work injury insurance for its
workers in accordance with the provisions of the State, the workers who suffer
from occupational diseases shall have the right to enjoy the following benefits
of the work injury insurance in accordance with the provisions of the State on
work injury insurance:
（一）醫(yī)療費(fèi)：因患職業(yè)病進(jìn)行診療所需費(fèi)用，由工傷保險(xiǎn)基金按照規(guī)定標(biāo)準(zhǔn)支付；
(1) medical expenses: expenses required for diagnosis and treatment of
occupational diseases shall be paid from the work injury insurance fund
according to the prescribed standards;
?。ǘ┳≡夯锸逞a(bǔ)助費(fèi)：由用人單位按照當(dāng)?shù)匾蚬霾罨锸硺?biāo)準(zhǔn)的一定比例支付；
(2) in-hospital food allowances: these shall be paid by the employing unit in
certain proportion of the local standards of food allowances for business trips;
?。ㄈ┛祻?fù)費(fèi)：由工傷保險(xiǎn)基金按照規(guī)定標(biāo)準(zhǔn)支付；
(3) rehabilitation expenses: these expenses shall be paid from the work injury
insurance fund according to the prescribed standards;
?。ㄋ模埣灿镁哔M(fèi)：因殘疾需要配置輔助器具的，所需費(fèi)用由工傷保險(xiǎn)基金按照普及型輔助器具標(biāo)準(zhǔn)支付；
(4) expenses of appliances for the disabled: the expenses for supporting
appliances out of the need of the disabled conditions shall be paid from the
work injury insurance fund according to the standards for the popular-type
appliances;
（五）停工留薪期待遇：原工資、福利待遇不變，由用人單位支付；
(5) benefits enjoyed during the period of stopping of work but remaining on
the payroll: their original wages and welfare benefits shall not be changed, and
shall be paid by the employing unit;
?。┥钭o(hù)理補(bǔ)助費(fèi)：經(jīng)評(píng)殘并確認(rèn)需要生活護(hù)理的，生活護(hù)理補(bǔ)助費(fèi)由工傷保險(xiǎn)基金按照規(guī)定標(biāo)準(zhǔn)支付；
(6) nursing allowances: these allowances for the confirmed disability and
necessary nursing services shall be paid from the work injury insurance fund
according to the prescribed standards;
（七）一次性傷殘補(bǔ)助金：經(jīng)鑒定為十級(jí)至一級(jí)傷殘的，按照傷殘等級(jí)享受相當(dāng)于６個(gè)月至２４個(gè)月的本人工資的一次性傷殘補(bǔ)助金，由工傷保險(xiǎn)基金支付；
(7) lump-sum disability subsidies: where the workers are determined as Grade
10 to Grade 1 disability through assessment, they shall enjoy such subsidies
equivalent to their six-month to 24-month wages based on the degree of
disability, and such allowances shall be paid from the work injury insurance
fund;
?。ò耍﹤麣埥蛸N：經(jīng)鑒定為四級(jí)至一級(jí)傷殘的，按照規(guī)定享受相當(dāng)于本人工資７５％至９０％的傷殘津貼，由工傷保險(xiǎn)基金支付；
(8) disability allowances: where the workers are determined as Grade 4 to
Grade 1 disability through assessment, they shall enjoy such allowances
equivalent to 75% to 90% of their wages according to the provisions, and such
allowances shall be paid from the work injury insurance fund;
（九）死亡補(bǔ)助金：因職業(yè)中毒死亡的，由工傷保險(xiǎn)基金按照不低于４８?jìng)€(gè)月的統(tǒng)籌地區(qū)上年度職工月平均工資的標(biāo)準(zhǔn)一次支付；
(9) death subsidies: where the workers are deceased due to occupational
poisoning, such subsidies shall be paid in one lump sum from the work injury
insurance fund according to the standard of not less than 48-month wages based
on the workers’ average monthly wages in the previous year of the same overall
planning areas;
（十）喪葬補(bǔ)助金：因職業(yè)中毒死亡的，由工傷保險(xiǎn)基金按照６個(gè)月的統(tǒng)籌地區(qū)上年度職工月平均工資的標(biāo)準(zhǔn)一次支付；
(10) funeral subsidies: where the workers are deceased due to occupational
poisoning, such subsidies shall be paid in one lump sum from the work injury
insurance fund according to the standard of 6-month wages based on the workers’
average monthly wages in the previous year of the same overall planning areas;
（十一）供養(yǎng)親屬撫恤金：因職業(yè)中毒死亡的，對(duì)由死者生前提供主要生活來(lái)源的親屬由工傷保險(xiǎn)基金支付撫恤金：
(11) pensions for supporting the family members: where the workers are
deceased due to occupational poisoning, pensions shall be paid from the work
injury insurance fund for the family members of the deceased for whom the
deceased before their death provided main sources of livelihood.
對(duì)其配偶每月按照統(tǒng)籌地區(qū)上年度職工月平均工資的４０％發(fā)給，對(duì)其生前供養(yǎng)的直系親屬每人每月按照統(tǒng)籌地區(qū)上年度職工月平均工資的３０％發(fā)給；
The spouses of the deceased shall enjoy a monthly pension equivalent to 40% of
the workers’ average monthly wages in the previous year of the same overall
planning area. The lineal relatives supported by the deceased before their death
shall enjoy per capita a monthly pension equivalent to 30% of the workers’
average monthly wages in the previous year of the same overall planning area;
?。ㄊ﹪?guó)家規(guī)定的其他工傷保險(xiǎn)待遇。
(12) other welfare benefits of the work injury insurance provided by the
State.
本條例施行后，國(guó)家對(duì)工傷保險(xiǎn)待遇的項(xiàng)目和標(biāo)準(zhǔn)作出調(diào)整時(shí)，從其規(guī)定。
Where the State adjusts the items and standards of the welfare benefits of the
work injury insurance after the implementation of these Regulations, the
adjusted provisions of the State shall prevail.
第四十二條 用人單位未參加工傷保險(xiǎn)的，其勞動(dòng)者從事有毒物品作業(yè)患職業(yè)病的，用人單位應(yīng)當(dāng)按照國(guó)家有關(guān)工傷保險(xiǎn)規(guī)定的項(xiàng)目和標(biāo)準(zhǔn)，保證勞動(dòng)者享受工傷待遇。
Article 42 Where an employing unit has not bought work injury insurance, it
shall, when its workers engaging in the operations in which toxic substances are
used suffer from occupational diseases, guarantee that such workers enjoy the
welfare benefits for work injury in accordance with the items and standards of
the work injury insurance prescribed by the State.
第四十三條
用人單位無(wú)營(yíng)業(yè)執(zhí)照以及被依法吊銷(xiāo)營(yíng)業(yè)執(zhí)照，其勞動(dòng)者從事使用有毒物品作業(yè)患職業(yè)病的，應(yīng)當(dāng)按照國(guó)家有關(guān)工傷保險(xiǎn)規(guī)定的項(xiàng)目和標(biāo)準(zhǔn)，給予勞動(dòng)者一次性賠償。
Article 43 Where an employing unit has no business license or its business
license has been revoked according to law, it shall, when its workers engaging
in the operations in which toxic substances are used suffer from occupational
diseases, make compensation in one lump sum for these workers in accordance with
the items and standards of the work injury insurance prescribed by the State.
第四十四條 用人單位分立、合并的，承繼單位應(yīng)當(dāng)承擔(dān)由原用人單位對(duì)患職業(yè)病的勞動(dòng)者承擔(dān)的補(bǔ)償責(zé)任。
Article 44 Where an employing unit is divided or merged, the successors shall
bear the former employing unit’s liabilities of compensation for the workers who
suffer from occupational diseases.
用人單位解散、破產(chǎn)的，應(yīng)當(dāng)依法從其清算財(cái)產(chǎn)中優(yōu)先支付患職業(yè)病的勞動(dòng)者的補(bǔ)償費(fèi)用。
Where an employing unit is dissolved or goes into bankruptcy, it shall make
compensation for the workers who suffer from occupational diseases with priority
from assets in liquidation according to law.
第四十五條 勞動(dòng)者除依法享有工傷保險(xiǎn)外，依照有關(guān)民事法律的規(guī)定，尚有獲得賠償?shù)臋?quán)利的，有權(quán)向用人單位提出賠償要求。
Article 45 In addition to the work injury insurance, the workers shall also
have the right to claim for compensation from the employing unit if they are
entitled to obtain compensation in accordance with the provisions of relevant
civil laws.
第四十六條
勞動(dòng)者應(yīng)當(dāng)學(xué)習(xí)和掌握相關(guān)職業(yè)衛(wèi)生知識(shí)，遵守有關(guān)勞動(dòng)保護(hù)的法律、法規(guī)和操作規(guī)程，正確使用和維護(hù)職業(yè)中毒危害防護(hù)設(shè)施及其用品；發(fā)現(xiàn)職業(yè)中毒事故隱患時(shí)，應(yīng)當(dāng)及時(shí)報(bào)告。
Article 46 The workers shall learn and master the knowledge of occupational
health, abide by the relevant laws and regulations on labor protection as well
as the operating rules, and correctly use and maintain safeguards and protective
appliances against occupational poisoning hazards. When finding potential
occupational poisoning accidents, they shall make reports in time.
作業(yè)場(chǎng)所出現(xiàn)使用有毒物品產(chǎn)生的危險(xiǎn)時(shí)，勞動(dòng)者應(yīng)當(dāng)采取必要措施，按照規(guī)定正確使用防護(hù)設(shè)施，將危險(xiǎn)加以消除或者減少到最低限度。
In case of hazards in workplaces due to the use of toxic substances, the
workers shall take necessary measures, correctly use the safeguards in
accordance with the provisions, and eliminate such hazards or reduce them to the
minimum.
第六章 監(jiān)督管理
Chapter VI Supervision and Administration
第四十七條
縣級(jí)以上人民政府衛(wèi)生行政部門(mén)應(yīng)當(dāng)依照本條例的規(guī)定和國(guó)家有關(guān)職業(yè)衛(wèi)生要求，依據(jù)職責(zé)劃分，對(duì)作業(yè)場(chǎng)所使用有毒物品作業(yè)及職業(yè)中毒危害檢測(cè)、評(píng)價(jià)活動(dòng)進(jìn)行監(jiān)督檢查。
Article 47 The administrative departments for public health of the people's
governments at or above the county level shall, in accordance with the
provisions of these Regulations and the relevant requirements of the State for
occupational health, supervise and inspect ex officio the use of toxic
substances in workplaces and the test and evaluation of occupational poisoning
hazards.
衛(wèi)生行政部門(mén)實(shí)施監(jiān)督檢查，不得收取費(fèi)用，不得接受用人單位的財(cái)物或者其他利益。
The administrative departments for public health shall conduct the supervision
and inspection at no charge, and shall not accept property or other benefits
from the employing units.
第四十八條 衛(wèi)生行政部門(mén)應(yīng)當(dāng)建立、健全監(jiān)督制度，核查反映用人單位有關(guān)勞動(dòng)保護(hù)的材料，履行監(jiān)督責(zé)任。
Article 48 The administrative departments for public health shall establish
and improve the supervisory system, checked the materials relating to the
employing units' labor protection, and fulfill the supervisory responsibilities.
用人單位應(yīng)當(dāng)向衛(wèi)生行政部門(mén)如實(shí)、具體提供反映有關(guān)勞動(dòng)保護(hù)的材料；必要時(shí)，衛(wèi)生行政部門(mén)可以查閱或者要求用人單位報(bào)送有關(guān)材料。
The employing units shall provide truthful and specific materials relating to
labor protection to the administrative departments for public health. When
necessary, the administrative departments for public health may consult, or
require the employing units to submit, the relevant materials.
第四十九條 衛(wèi)生行政部門(mén)應(yīng)當(dāng)監(jiān)督用人單位嚴(yán)格執(zhí)行有關(guān)職業(yè)衛(wèi)生規(guī)范。
Article 49 The administrative departments for public health shall supervise
employing units’ strict implementation of the relevant occupational health
standards.
衛(wèi)生行政部門(mén)應(yīng)當(dāng)依照本條例的規(guī)定對(duì)使用有毒物品作業(yè)場(chǎng)所的職業(yè)衛(wèi)生防護(hù)設(shè)備、設(shè)施的防護(hù)性能進(jìn)行定期檢驗(yàn)和不定期的抽查；
The administrative departments for public health shall, in accordance with the
provisions of these Regulations, periodically inspect and selectively check at
irregular intervals the performances of safeguards for the occupational health
in the workplaces where toxic substances are used.
發(fā)現(xiàn)職業(yè)衛(wèi)生防護(hù)設(shè)備、設(shè)施存在隱患時(shí)，應(yīng)當(dāng)責(zé)令用人單位立即消除隱患；消除隱患期間，應(yīng)當(dāng)責(zé)令其停止作業(yè)。
When finding any potential accident involved in such safeguards, they shall
order the employing units to eliminate such potential accident forthwith, and
shall order them to stop such operation during the period of eliminating the
potential accident.
第五十條 衛(wèi)生行政部門(mén)應(yīng)當(dāng)采取措施，鼓勵(lì)對(duì)用人單位的違法行為進(jìn)行舉報(bào)、投訴、檢舉和控告。
Article 50 The administrative departments for public health shall take
measures to encourage the reports, complaints, exposures or charges against any
law-breaking act of employing units.
衛(wèi)生行政部門(mén)對(duì)舉報(bào)、投訴、檢舉和控告應(yīng)當(dāng)及時(shí)核實(shí)，依法作出處理，并將處理結(jié)果予以公布。
The administrative departments for public health shall promptly verify the
reports, complaints, exposures or charges, handle them according to law and
publish the results.
衛(wèi)生行政部門(mén)對(duì)舉報(bào)人、投訴人、檢舉人和控告人負(fù)有保密的義務(wù)。
The administrative departments for public health shall be obliged to keep
confidentiality for the reporters, complainants, informants and chargers.
第五十一條 衛(wèi)生行政部門(mén)執(zhí)法人員依法執(zhí)行職務(wù)時(shí)，應(yīng)當(dāng)出示執(zhí)法證件。
Article 51 The law enforcement officials of the administrative departments for
public health shall show their certificates for law enforcement when fulfilling
their duties according to law.
衛(wèi)生行政部門(mén)執(zhí)法人員應(yīng)當(dāng)忠于職守，秉公執(zhí)法；涉及用人單位秘密的，應(yīng)當(dāng)為其保密。
The law enforcement officials of the administrative departments for public
health shall be devoted to their duties, enforce the law impartially, and shall
keep confidentiality for the employing units in case that their secrets are
involved.
第五十二條 衛(wèi)生行政部門(mén)依法實(shí)施罰款的行政處罰，應(yīng)當(dāng)依照有關(guān)法律、行政法規(guī)的規(guī)定，實(shí)施罰款決定與罰款收繳分離；
Article 52 With regard to the administrative penalty of fine imposed by the
administrative departments for public health according to law, the organ that
makes the decision on the fine shall, in accordance with the provisions of
relevant laws and administrative regulations, be separated from the organ that
collects the fine.
收繳的罰款以及依法沒(méi)收的經(jīng)營(yíng)所得，必須全部上繳國(guó)庫(kù)。
The fine collected and illegal gains confiscated according to law must be
turned over to the State Treasury in full.
第五十三條 衛(wèi)生行政部門(mén)履行監(jiān)督檢查職責(zé)時(shí)，有權(quán)采取下列措施：
Article 53 The administrative departments for public health shall, when
fulfilling their duties of supervision and inspection, have the rights to take
the following measures:
?。ㄒ唬┻M(jìn)入用人單位和使用有毒物品作業(yè)場(chǎng)所現(xiàn)場(chǎng)，了解情況，調(diào)查取證，進(jìn)行抽樣檢查、檢測(cè)、檢驗(yàn)，進(jìn)行實(shí)地檢查；
(1) to enter the employing units and their workplaces where toxic substances
are used to collect relevant information, make investigations and collect
evidence, carry out sampling inspection, test, and check, and make spot
investigations;
?。ǘ┎殚喕蛘邚?fù)制與違反本條例行為有關(guān)的資料，采集樣品；
(2) to consult or reproduce materials related to the acts in violation of
these Regulations, and collect samples; and
?。ㄈ┴?zé)令違反本條例規(guī)定的單位和個(gè)人停止違法行為。
(3) to order the units and individuals in violation of these Regulations to
stop their unlawful acts.
第五十四條 發(fā)生職業(yè)中毒事故或者有證據(jù)證明職業(yè)中毒危害狀態(tài)可能導(dǎo)致事故發(fā)生時(shí)，衛(wèi)生行政部門(mén)有權(quán)采取下列臨時(shí)控制措施：
Article 54 In case an occupational poisoning accident occurs, or the evidence
proves that the situation of occupational poisoning hazards is likely to cause
an accident, the administrative departments for public health shall have the
rights to take the following provisional controlling measures:
?。ㄒ唬┴?zé)令暫停導(dǎo)致職業(yè)中毒事故的作業(yè)；
(1) to order suspension of operations causing occupational poisoning
accidents;
?。ǘ┓獯嬖斐陕殬I(yè)中毒事故或者可能導(dǎo)致事故發(fā)生的物品；
(2) to seal up and keep substances that have caused or are likely to cause
occupational poisoning accidents; and
?。ㄈ┙M織控制職業(yè)中毒事故現(xiàn)場(chǎng)。
(3) to organize the control over the occupational poisoning accident sites.
在職業(yè)中毒事故或者危害狀態(tài)得到有效控制后，衛(wèi)生行政部門(mén)應(yīng)當(dāng)及時(shí)解除控制措施。
Upon the effective control over occupational poisoning accidents or hazards,
the administrative departments for public health shall remove such measures in
time.
第五十五條 衛(wèi)生行政部門(mén)執(zhí)法人員依法執(zhí)行職務(wù)時(shí)，被檢查單位應(yīng)當(dāng)接受檢查并予以支持、配合，不得拒絕和阻礙。
Article 55 When the law enforcement officials of the administrative
departments for public health fulfill their duties according to law, the
inspected units shall be subject to the inspection, give necessary support and
cooperation, and shall not refuse or hinder the inspection.
第五十六條
衛(wèi)生行政部門(mén)應(yīng)當(dāng)加強(qiáng)隊(duì)伍建設(shè)，提高執(zhí)法人員的政治、業(yè)務(wù)素質(zhì)，依照本條例的規(guī)定，建立、健全內(nèi)部監(jiān)督制度，對(duì)執(zhí)法人員執(zhí)行法律、法規(guī)和遵守紀(jì)律的情況進(jìn)行監(jiān)督檢查。
Article 56 The administrative departments for public health shall strengthen
the team building, improve the law enforcement officials’ political and
professional qualifications, establish and improve the internal supervisory
system in accordance with the provisions of these Regulations, and supervise and
inspect the execution of laws and regulations by law enforcement officials as
well as their observation of disciplines.
第七章 罰則
Chapter VII Penalty Provisions
第五十七條 衛(wèi)生行政部門(mén)的工作人員有下列行為之一，導(dǎo)致職業(yè)中毒事故發(fā)生的，依照刑法關(guān)于濫用職權(quán)罪、玩忽職守罪或者其他罪的規(guī)定，依法追究刑事責(zé)任；
Article 57 The functionaries of the administrative departments for public
health who commit any of the following acts, thus causing any occupational
poisoning accident, shall be investigated for criminal liability according to
the provisions of the criminal law on the crime of abuse of power, the crime of
neglect of duty or other crimes;
造成職業(yè)中毒危害但尚未導(dǎo)致職業(yè)中毒事故發(fā)生，不夠刑事處罰的，根據(jù)不同情節(jié)，依法給予降級(jí)、撤職或者開(kāi)除的行政處分：
where they cause occupational poisoning hazards but do not cause any
occupational poisoning accident, and criminal punishments are too severe to
apply to them, they shall be imposed such administrative sanctions as degrading,
dismissal from their posts, or discharge from public employment in light of
different circumstances:
?。ㄒ唬?duì)不符合本條例規(guī)定條件的涉及使用有毒物品作業(yè)事項(xiàng)，予以批準(zhǔn)的；
(1) approving operations involving the use of toxic substances that fail to
meet the conditions specified in these Regulations;
（二）發(fā)現(xiàn)用人單位擅自從事使用有毒物品作業(yè)，不予取締的；
(2) failing to lay a ban on the employing units' operations in which toxic
substances are used without authorization upon discovery thereof;
?。ㄈ?duì)依法取得批準(zhǔn)的用人單位不履行監(jiān)督檢查職責(zé)，發(fā)現(xiàn)其不再具備本條例規(guī)定的條件而不撤銷(xiāo)原批準(zhǔn)或者發(fā)現(xiàn)違反本條例的其他行為不予查處的；
(3) failing to fulfill the duties of supervision and inspection over the
employing units that are approved according to law, or failing to withdraw the
original approval granted to the employing units that no longer satisfy the
conditions specified in these Regulations or failing to investigate into and
handle other acts in violation of these Regulations upon discovery of such
non-satisfaction or violation; or
（四）發(fā)現(xiàn)用人單位存在職業(yè)中毒危害，可能造成職業(yè)中毒事故，不及時(shí)依法采取控制措施的。
(4) failing to take prompt controlling measures according to law against
occupational poisoning hazards existing in the employing units which are likely
to cause occupational poisoning accidents upon discovery of such hazards.
第五十八條 用人單位違反本條例的規(guī)定，有下列情形之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處１０萬(wàn)元以上５０萬(wàn)元以下的罰款；
Article 58 An employing unit that, in violation of the provisions of these
Regulations, comes under one of the following circumstances shall be given a
warning and ordered to make corrections within a specified time limit, and shall
be imposed a fine of not less than 100,000 yuan but not more than 500,000 yuan
by the administrative department for public health;
逾期不改正的，提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限責(zé)令停建、予以關(guān)閉；
if it fails to make corrections within the specified time limit, a request
shall be made to the relevant people's government to order it to stop the
construction or shut it down within the limits of authority vested by the State
Council;
造成嚴(yán)重職業(yè)中毒危害或者導(dǎo)致職業(yè)中毒事故發(fā)生的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大勞動(dòng)安全事故罪或者其他罪的規(guī)定，依法追究刑事責(zé)任：
where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of causing a serious labor security accident or other crimes:
?。ㄒ唬┛赡墚a(chǎn)生職業(yè)中毒危害的建設(shè)項(xiàng)目，未依照職業(yè)病防治法的規(guī)定進(jìn)行職業(yè)中毒危害預(yù)評(píng)價(jià)，或者預(yù)評(píng)價(jià)未經(jīng)衛(wèi)生行政部門(mén)審核同意，擅自開(kāi)工的；
(1) without authorization, starting the operation of a construction project
that is likely to cause any occupational poisoning hazard in case that no
pre-assessment of occupational poisoning hazards has been carried out in
accordance with the provisions of the Law on the Prevention and Control of
Occupational Diseases, or such pre-assessment fails to pass the examination and
obtain approval of the administrative department for public health;
?。ǘ┞殬I(yè)衛(wèi)生防護(hù)設(shè)施未與主體工程同時(shí)設(shè)計(jì)，同時(shí)施工，同時(shí)投入生產(chǎn)和使用的；
(2) failing to design, construct, and put into production and utilization the
safeguards for the occupational health simultaneously with the principal part of
the project;
?。ㄈ┙ㄔO(shè)項(xiàng)目竣工，未進(jìn)行職業(yè)中毒危害控制效果評(píng)價(jià)，或者未經(jīng)衛(wèi)生行政部門(mén)驗(yàn)收或者驗(yàn)收不合格，擅自投入使用的；
(3) without authorization, putting into use a completed construction project
in case that no assessment of effect in the control over occupational poisoning
hazards has been carried out, or the project fails to participate in or pass the
inspection for acceptance by the administrative department for public health; or
?。ㄋ模┐嬖诟叨咀鳂I(yè)的建設(shè)項(xiàng)目的防護(hù)設(shè)施設(shè)計(jì)未經(jīng)衛(wèi)生行政部門(mén)審查同意，擅自施工的。
(4) commencing construction without authorization before the design of
safeguards for a construction project involving the operations in which high
toxic substances are used is examined and approved by the administrative
department for public health.
第五十九條 用人單位違反本條例的規(guī)定，有下列情形之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處５萬(wàn)元以上２０萬(wàn)元以下的罰款；
Article 59 An employing unit that, in violation of the provisions of these
Regulations, comes under one of the following circumstances shall be given a
warning and ordered to make corrections within a specified time limit, and shall
be imposed a fine of not less than 50,000 yuan but not more than 200,000 yuan by
the administrative department for public health;
逾期不改正的，提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉；
if it fails to make corrections within the specified time limit, a request
shall be made to the relevant people's government to shut it down within the
limits of authority vested by the State Council;
造成嚴(yán)重職業(yè)中毒危害或者導(dǎo)致職業(yè)中毒事故發(fā)生的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大勞動(dòng)安全事故罪或者其他罪的規(guī)定，依法追究刑事責(zé)任：
where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of causing a serious labor security accident or other crimes:
?。ㄒ唬┦褂糜卸疚锲纷鳂I(yè)場(chǎng)所未按照規(guī)定設(shè)置警示標(biāo)識(shí)和中文警示說(shuō)明的；
(1) failing to display warning marks or warning specifications in Chinese in
the workplaces where toxic substances are used;
?。ǘ┪磳?duì)職業(yè)衛(wèi)生防護(hù)設(shè)備、應(yīng)急救援設(shè)施、通訊報(bào)警裝置進(jìn)行維護(hù)、檢修和定期檢測(cè)，導(dǎo)致上述設(shè)施處于不正常狀態(tài)的；
(2) failing to maintain, overhaul, or periodically detect safeguards for
occupational health, emergency and first-aid facilities, and communication and
alarm facilities, thus causing the aforesaid facilities to be in abnormal
conditions;
?。ㄈ┪匆勒毡緱l例的規(guī)定進(jìn)行職業(yè)中毒危害因素檢測(cè)和職業(yè)中毒危害控制效果評(píng)價(jià)的；
(3) failing to detect factors of occupational poisoning hazards and assess
effect of the control over occupational poisoning hazards in accordance with the
provisions of these Regulations;
?。ㄋ模└叨咀鳂I(yè)場(chǎng)所未按照規(guī)定設(shè)置撤離通道和泄險(xiǎn)區(qū)的；
(4) failing to set up emergency passes for evacuation and necessary
hazard-eliminating areas according to law in the workplaces where high toxic
substances are used;
?。ㄎ澹└叨咀鳂I(yè)場(chǎng)所未按照規(guī)定設(shè)置警示線(xiàn)的；
(5) failing to display warning lines according to the provisions in the
workplaces where high toxic substances are used; or
?。┪聪驈氖率褂糜卸疚锲纷鳂I(yè)的勞動(dòng)者提供符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)的防護(hù)用品，或者未保證勞動(dòng)者正確使用的。
(6) failing to provide protective appliances that meet the national
occupational health standards to the workers engaging in the operations in which
toxic substances are used, or failing to ensure its workers to use them
correctly.
第六十條
用人單位違反本條例的規(guī)定，有下列情形之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處５萬(wàn)元以上３０萬(wàn)元以下的罰款；逾期不改正的，提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉；
Article 60 An employing unit that, in violation of the provisions of these
Regulations, comes under any of the following circumstances shall be given a
warming and ordered to make corrections within a specified time limit, and shall
be imposed a fine of not less than 50,000 yuan but not more than 300,000 yuan by
the administrative department for public health; if it fails to make corrections
within the specified time limit, a request shall be made to the relevant
people's government to shut it down within the limits of authority vested by the
State Council;
造成嚴(yán)重職業(yè)中毒危害或者導(dǎo)致職業(yè)中毒事故發(fā)生的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大責(zé)任事故罪、重大勞動(dòng)安全事故罪或者其他罪的規(guī)定，依法追究刑事責(zé)任：
where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of negligently causing a serious accident, the crime of causing a serious labor
safety accident or other crimes:
?。ㄒ唬┦褂糜卸疚锲纷鳂I(yè)場(chǎng)所未設(shè)置有效通風(fēng)裝置的，或者可能突然泄漏大量有毒物品或者易造成急性中毒的作業(yè)場(chǎng)所未設(shè)置自動(dòng)報(bào)警裝置或者事故通風(fēng)設(shè)施的；
(1) failing to install effective ventilation installations in the workplaces
where toxic substances are used, or failing to install automatic alarm
facilities or ventilation facilities for accidents in the workplaces where a
large quantity of toxic substances are likely to leak out suddenly or acute
poisoning may be caused easily; or
（二）職業(yè)衛(wèi)生防護(hù)設(shè)備、應(yīng)急救援設(shè)施、通訊報(bào)警裝置處于不正常狀態(tài)而不停止作業(yè)，或者擅自拆除或者停止運(yùn)行職業(yè)衛(wèi)生防護(hù)設(shè)備、應(yīng)急救援設(shè)施、通訊報(bào)警裝置的。
(2) failing to stop the operations in case the safeguards against occupational
health hazards, emergency and first-aid facilities, and communication and alarm
facilities are in abnormal conditions, or dismantling or stopping the operation
of such facilities without authorization.
第六十一條
從事使用高毒物品作業(yè)的用人單位違反本條例的規(guī)定，有下列行為之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處５萬(wàn)元以上２０萬(wàn)元以下的罰款；逾期不改正的，提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉；
Article 61 An employing unit engaging in the operations in which high toxic
substances are used that, in violation of the provisions of these Regulations,
comes under one of the following circumstances shall be given a warning and
ordered to make corrections within a specified time limit, and shall be imposed
a fine of not less 50,000 yuan but not more than 200,000 yuan by the
administrative department for public health; if it fails to make corrections
within the specified time limit, a request shall be made to the relevant
people's government to shut it down within the limits of authority vested by the
State Council;
造成嚴(yán)重職業(yè)中毒危害或者導(dǎo)致職業(yè)中毒事故發(fā)生的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大責(zé)任事故罪或者其他罪的規(guī)定，依法追究刑事責(zé)任：
where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of negligently causing a serious accident or other crimes:
?。ㄒ唬┳鳂I(yè)場(chǎng)所職業(yè)中毒危害因素不符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)和衛(wèi)生要求而不立即停止高毒作業(yè)并采取相應(yīng)的治理措施的，或者職業(yè)中毒危害因素治理不符合國(guó)家職業(yè)衛(wèi)生標(biāo)準(zhǔn)和衛(wèi)生要求重新作業(yè)的；
(1) failing to stop the operations in which high toxic substances are used and
take appropriate controlling measures forthwith in case factors of occupational
poisoning hazards in workplaces fail to meet the national occupational health
standards and hygienic requirements, or restarting the operations in case the
aforesaid factors have not met the national occupational health standards and
hygienic requirements in spite of the controlling measures taken;
（二）未依照本條例的規(guī)定維護(hù)、檢修存在高毒物品的生產(chǎn)裝置的；
(2) failing to maintain or overhaul production installations involving the use
of high toxic substances according to the provisions of these Regulations; or
?。ㄈ┪床扇”緱l例規(guī)定的措施，安排勞動(dòng)者進(jìn)入存在高毒物品的設(shè)備、容器或者狹窄封閉場(chǎng)所作業(yè)的。
(3) without taking the measures specified in these Regulations, assigning its
workers to enter and conduct operations in equipment, containers, or narrow
closed workplaces with high toxic substances.
第六十二條 在作業(yè)場(chǎng)所使用國(guó)家明令禁止使用的有毒物品或者使用不符合國(guó)家標(biāo)準(zhǔn)的有毒物品的，由衛(wèi)生行政部門(mén)責(zé)令立即停止使用，處５萬(wàn)元以上３０萬(wàn)元以下的罰款；
Article 62 Whoever uses in any workplaces toxic substances that are explicitly
prohibited by the State or that fail to meet the national standards shall be
ordered to stop the use of such substances forthwith, and shall be imposed a
fine of not less than 50,000 yuan but not more than 300,000 yuan by the
administrative department for public health;
情節(jié)嚴(yán)重的，責(zé)令停止使用有毒物品作業(yè)，或者提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉；
if the circumstances are serious, the offender shall be ordered to stop the
operations in which toxic substances are used, or a request shall be made to the
relevant people's government to shut it down within the limits of authority
vested by the State Council;

where the offender causes any serious occupational poisoning hazard or causes
any occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of causing an accident in the control over dangerous articles, the crime of
negligently causing serious accidents or other crimes.
第六十三條 用人單位違反本條例的規(guī)定，有下列行為之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正；逾期不改正的，處５萬(wàn)元以上３０萬(wàn)元以下的罰款；
Article 63 An employing unit that, in violation of the provisions of these
Regulations, commits any of the following acts shall be given a warning and
ordered to make corrections within a specified time limit by the administrative
department for public health; if it fails to make corrections within the

where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of negligently causing a serious accident or other crimes:
?。ㄒ唬┦褂梦唇?jīng)培訓(xùn)考核合格的勞動(dòng)者從事高毒作業(yè)的；
(1) employing the workers who have not received the training and passed the
examination to engage in the operations in which high toxic substances are used;
?。ǘ┌才庞新殬I(yè)禁忌的勞動(dòng)者從事所禁忌的作業(yè)的；
(2) assigning taboo-bound workers to engage in taboo operations;
?。ㄈ┌l(fā)現(xiàn)有職業(yè)禁忌或者有與所從事職業(yè)相關(guān)的健康損害的勞動(dòng)者，未及時(shí)調(diào)離原工作崗位，并妥善安置的；
(3) failing to transfer in time the workers with occupational taboo or health
injuries related to their jobs from their original posts and make appropriate
arrangement for them;
（四）安排未成年人或者孕期、哺乳期的女職工從事使用有毒物品作業(yè)的；
(4) assigning minors or women employees in pregnancy or lactation to engage in
the operations in which toxic substances are used; or
（五）使用童工的。
(5) employing child laborers.
第六十四條 違反本條例的規(guī)定，未經(jīng)許可，擅自從事使用有毒物品作業(yè)的，由工商行政管理部門(mén)、衛(wèi)生行政部門(mén)依據(jù)各自職權(quán)予以取締；
Article 64 Whoever, in violation of the provisions of these Regulations,
engages in the operations in which toxic substances are used without
authorization shall be banned by the administrative department for industry and
commerce and the administrative department for public health ex officio;
造成職業(yè)中毒事故的，依照刑法關(guān)于危險(xiǎn)物品肇事罪或者其他罪的規(guī)定，依法追究刑事責(zé)任；尚不夠刑事處罰的，由衛(wèi)生行政部門(mén)沒(méi)收經(jīng)營(yíng)所得，并處經(jīng)營(yíng)所得３倍以上５倍以下的罰款；
if any occupational poisoning accident has been caused, the offender shall be
investigated for criminal liability according to the provisions of the criminal
law on the crime of causing an accident in the control over dangerous articles
or other crimes; if the case is not severe enough for criminal punishment, the
administrative department for public health shall confiscate the income derived
from business operations, and impose a fine of not less than three times but not
more than five times the amount of such income;
對(duì)勞動(dòng)者造成人身傷害的，依法承擔(dān)賠償責(zé)任。
if causing any personal injury to any worker, the offender shall bear the
liability for compensation according to law.
第六十五條
從事使用有毒物品作業(yè)的用人單位違反本條例的規(guī)定，在轉(zhuǎn)產(chǎn)、停產(chǎn)、停業(yè)或者解散、破產(chǎn)時(shí)未采取有效措施，妥善處理留存或者殘留高毒物品的設(shè)備、包裝物和容器的，由衛(wèi)生行政部門(mén)責(zé)令改正，處２萬(wàn)元以上１０萬(wàn)元以下的罰款；
Article 65 An employing unit engaging in the operations in which toxic
substances are used that, in violation of the provisions of these Regulations,
fails to take effective measures to dispose of equipment, packages, and
containers with residue of high toxic substances in case of changing the line of
production, stopping business, or dissolution or bankruptcy shall be ordered to
make corrections, and shall be imposed a fine of not less than 20,000 yuan but
not more than 100,000 yuan by the administrative department for public health;
觸犯刑律的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大環(huán)境污染事故罪、危險(xiǎn)物品肇事罪或者其他罪的規(guī)定，依法追究刑事責(zé)任。
where it violates the criminal provisions, the person in charge who is
responsible therefor and other directly responsible persons shall be
investigated for criminal liability according to the provisions of the criminal
law on the crime of major environmental pollution accident, the crime of causing
an accident in the control over dangerous articles, or other crimes.
第六十六條
用人單位違反本條例的規(guī)定，有下列情形之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處５０００元以上２萬(wàn)元以下的罰款；逾期不改正的，責(zé)令停止使用有毒物品作業(yè)，或者提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉；
Article 66 An employing unit that, in violation of the provisions of these
Regulations, comes under one of the following circumstances shall be given a
warning and ordered to make corrections within a specified time limit, and shall
be imposed a fine of not less than 5,000 yuan but not more than 20,000 yuan by
the administrative department for public health; if it fails to make corrections
within the specified time limit, it shall be ordered to stop the operations in
which toxic substances are used, or a request shall be made to the relevant
people's government to shut it down within the limits of authority vested by the
State Council;
造成嚴(yán)重職業(yè)中毒危害或者導(dǎo)致職業(yè)中毒事故發(fā)生的，對(duì)負(fù)有責(zé)任的主管人員和其他直接責(zé)任人員依照刑法關(guān)于重大勞動(dòng)安全事故罪、危險(xiǎn)物品肇事罪或者其他罪的規(guī)定，依法追究刑事責(zé)任：
where it causes any serious occupational poisoning hazard or causes any
occupational poisoning accident, the person in charge who is responsible
therefor and other directly responsible persons shall be investigated for
criminal liability according to the provisions of the criminal law on the crime
of causing a serious labor security accident, the crime of causing an accident
in the control over dangerous articles, or other crimes:
?。ㄒ唬┦褂糜卸疚锲纷鳂I(yè)場(chǎng)所未與生活場(chǎng)所分開(kāi)或者在作業(yè)場(chǎng)所住人的；
(1) failing to separate the workplaces where toxic substances are used from
the living areas, or allowing persons to reside in the workplaces;
?。ǘ┪磳⒂泻ψ鳂I(yè)與無(wú)害作業(yè)分開(kāi)的；
(2) failing to separate harmful operations from harmless operations;
（三）高毒作業(yè)場(chǎng)所未與其他作業(yè)場(chǎng)所有效隔離的；
(3) failing to effectively isolate the workplaces where high toxic substances
are used from other workplaces; or
（四）從事高毒作業(yè)未按照規(guī)定配備應(yīng)急救援設(shè)施或者制定事故應(yīng)急救援預(yù)案的。
(4) failing to equip with emergency and first-aid facilities or formulate
emergency and first-aid pre-schemes for the operations in which high toxic
substances are used according to the provisions.
第六十七條
用人單位違反本條例的規(guī)定，有下列情形之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處２萬(wàn)元以上５萬(wàn)元以下的罰款；逾期不改正的，提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉：
Article 67 An employing unit that, in violation of the provisions of these
Regulations, comes under one of the following circumstances shall be given a
warning and ordered to make corrections within a specified time limit, and shall
be imposed a fine of not less than 20,000 yuan but not more than 50,000 yuan by
the administrative department for public health; if it fails to make corrections
within the specified time limit, a request shall be made to the relevant
people's government to shut it down within the limits of authority vested by the
State Council:
?。ㄒ唬┪窗凑找?guī)定向衛(wèi)生行政部門(mén)申報(bào)高毒作業(yè)項(xiàng)目的；
(1) failing to declare the operations in which high toxic substances are used
to the administrative department for public health according to the provisions;
or
?。ǘ┳兏褂酶叨疚锲菲贩N，未按照規(guī)定向原受理申報(bào)的衛(wèi)生行政部門(mén)重新申報(bào)，或者申報(bào)不及時(shí)、有虛假的。
(2) failing to make a new declaration, or failing to make a declaration in
time, or making false declaration to the administrative department for public
health that originally dealt with declarations in case of change of varieties of
toxic substances.
第六十八條 用人單位違反本條例的規(guī)定，有下列行為之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處２萬(wàn)元以上５萬(wàn)元以下的罰款；
Article 68 An employing unit that, in violation of the provisions of these
Regulations, commits any of the following acts shall be given a warning and
ordered to make corrections within a specified time limit, and shall be imposed
a fine of not less than 20,000 yuan but not more than 50,000 yuan by the
administrative department for public health;
逾期不改正的，責(zé)令停止使用有毒物品作業(yè)，或者提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉：
if it fails to make corrections within the specified time limit, it shall be
ordered to stop the operations in which toxic substances are used, or a request
shall be made to the relevant people's government to shut it down within the
limits of authority vested by the State Council:
?。ㄒ唬┪唇M織從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行上崗前職業(yè)健康檢查，安排未經(jīng)上崗前職業(yè)健康檢查的勞動(dòng)者從事使用有毒物品作業(yè)的；
(1) failing to organize the workers engaging in the operations in which toxic
substances are used to receive occupational health examination before taking up
their jobs, or assigning the workers who have not received occupational health
examination before taking their jobs to engage in the operations in which toxic
substances are used;
?。ǘ┪唇M織從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行定期職業(yè)健康檢查的；
(2) failing to organize the workers engaging in the operations in which toxic
substances are used to receive occupational health examination at regular
intervals;
?。ㄈ┪唇M織從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行離崗職業(yè)健康檢查的；
(3) failing to organize the workers engaging in the operations in which toxic
substances are used to receive post-leaving occupational health examination;
?。ㄋ模?duì)未進(jìn)行離崗職業(yè)健康檢查的勞動(dòng)者，解除或者終止與其訂立的勞動(dòng)合同的；
(4) rescinding or terminating labor contracts with the workers who did not
receive post-leaving occupational health examination;
?。ㄎ澹┌l(fā)生分立、合并、解散、破產(chǎn)情形，未對(duì)從事使用有毒物品作業(yè)的勞動(dòng)者進(jìn)行健康檢查，并按照國(guó)家有關(guān)規(guī)定妥善安置職業(yè)病病人的；
(5) failing to conduct health examination for the workers engaging in the
operations in which toxic substances are used and to make appropriate
arrangements for occupational disease sufferers in accordance with the relevant
provisions of the State in case of division, merger, dissolution, or bankruptcy;
（六）對(duì)受到或者可能受到急性職業(yè)中毒危害的勞動(dòng)者，未及時(shí)組織進(jìn)行健康檢查和醫(yī)學(xué)觀察的；
(6) failing to arrange duly health examination and medical observation for the
workers who have suffered or are likely to suffer acute occupational poisoning
hazards;
?。ㄆ撸┪唇⒙殬I(yè)健康監(jiān)護(hù)檔案的；
(7) failing to establish occupational health supervision records;
?。ò耍﹦趧?dòng)者離開(kāi)用人單位時(shí)，用人單位未如實(shí)、無(wú)償提供職業(yè)健康監(jiān)護(hù)檔案的；
(8) failing to provide true occupational health surveillance archives at no
charge when the workers leave the employing unit;
?。ň牛┪匆勒章殬I(yè)病防治法和本條例的規(guī)定將工作過(guò)程中可能產(chǎn)生的職業(yè)中毒危害及其后果、有關(guān)職業(yè)衛(wèi)生防護(hù)措施和待遇等如實(shí)告知?jiǎng)趧?dòng)者并在勞動(dòng)合同中寫(xiě)明的；
(9) failing to truly inform the workers of possible occupational poisoning
hazards and the consequences therefrom, safeguards against occupational
poisoning hazards and the welfares, and failing to state these items clearly in
the labor contracts according to the provisions of the Law on the Prevention and
Control of Diseases and these Regulations; or
?。ㄊ﹦趧?dòng)者在存在威脅生命、健康危險(xiǎn)的情況下，從危險(xiǎn)現(xiàn)場(chǎng)中撤離，而被取消或者減少應(yīng)當(dāng)享有的待遇的。
(10) canceling or reducing benefits that should be enjoyed by the workers who
evacuated from the sites of hazards in the circumstance under which there exists
the danger threatening their life safety or body health.
第六十九條 用人單位違反本條例的規(guī)定，有下列行為之一的，由衛(wèi)生行政部門(mén)給予警告，責(zé)令限期改正，處５０００元以上２萬(wàn)元以下的罰款；
Article 69 An employing unit that, in violation of the provisions of these
Regulations, commits any of the following acts shall be given a warning and
ordered to make corrections within a specified time limit, and shall be imposed
a fine of not less than 5,000 yuan but not more than 20,000 yuan by the
administrative department for public health;
逾期不改正的，責(zé)令停止使用有毒物品作業(yè)，或者提請(qǐng)有關(guān)人民政府按照國(guó)務(wù)院規(guī)定的權(quán)限予以關(guān)閉：
if it fails to make corrections within the specified time limit, it shall be
ordered to stop the operations in which toxic substances are used, or a request
shall be made to the relevant people's government to shut it down within the
limits of authority vested by the State Council:
?。ㄒ唬┪窗凑找?guī)定配備或者聘請(qǐng)職業(yè)衛(wèi)生醫(yī)師和護(hù)士的；
(1) failing to assign or engage occupational health doctors and nurses in
accordance with the provisions;
?。ǘ┪礊閺氖率褂酶叨疚锲纷鳂I(yè)的勞動(dòng)者設(shè)置淋浴間、更衣室或者未設(shè)置清洗、存放和處理工作服、工作鞋帽等物品的專(zhuān)用間，或者不能正常使用的；
(2) failing to set up shower compartments and changing cabins, or specialized
compartments to wash, store or dispose of such articles as working clothes,
shoes and caps for the workers engaging in the operations in which high toxic
substances are used, or providing such facilities in abnormal conditions; or
（三）未安排從事使用高毒物品作業(yè)一定年限的勞動(dòng)者進(jìn)行崗位輪換的。
(3) failing to arrange post-shift for the workers who have engaged in the
operations in which high toxic substances are used for certain years.
第八章 附則
Chapter VIII Supplementary Provisions
第七十條 涉及作業(yè)場(chǎng)所使用有毒物品可能產(chǎn)生職業(yè)中毒危害的勞動(dòng)保護(hù)的有關(guān)事項(xiàng)，本條例未作規(guī)定的，依照職業(yè)病防治法和其他有關(guān)法律、行政法規(guī)的規(guī)定執(zhí)行。
Article70 Where these Regulations contain no provisions on relevant issues
concerning labor protection against possible occupational poisoning hazards due
to the use of toxic substances in workplaces, the relevant provisions of the Law
on the Prevention and Control of Occupational Diseases, other relevant laws and
administrative regulations shall be applicable.
有毒物品的生產(chǎn)、經(jīng)營(yíng)、儲(chǔ)存、運(yùn)輸、使用和廢棄處置的安全管理，依照危險(xiǎn)化學(xué)品安全管理?xiàng)l例執(zhí)行。
The safety management in the manufacture, marketing, storage, transportation
and use of toxic substances, and in the disposal of wasted toxic substances as
well, shall be subject to the Regulations on Safety Administration of Hazardous
Chemicals.
第七十一條 本條例自公布之日起施行。
Article 71 These Regulations shall become effective as of the date of
promulgation.
