(根據(jù)《中華人民共和國(guó)核兩用品及相關(guān)技術(shù)出口管制條例》、《中華人民共和國(guó)導(dǎo)彈及相關(guān)物項(xiàng)和技術(shù)出口管制條例》、《中華人民共和國(guó)生物兩用品及相關(guān)設(shè)備和技術(shù)出口管制條例》和《有關(guān)化學(xué)品及相關(guān)設(shè)備和技術(shù)出口管制辦法》,制定《中華人民共和國(guó)敏感物項(xiàng)和技術(shù)出口經(jīng)營(yíng)登記管理辦法》,經(jīng)第11次部務(wù)會(huì)議審議通過,二○○二年十一月十二日發(fā)布,自2002年11月12日起施行)
第一條 為規(guī)范敏感物項(xiàng)和技術(shù)出口經(jīng)營(yíng)秩序,加強(qiáng)對(duì)敏感物項(xiàng)和技術(shù)出口經(jīng)營(yíng)的管理,根據(jù)《中華人民共和國(guó)核兩用品及相關(guān)技術(shù)出口管制條例》、《中華人民共和國(guó)導(dǎo)彈及相關(guān)物項(xiàng)和技術(shù)出口管制條例》、《中華人民共和國(guó)生物兩用品及相關(guān)設(shè)備和技術(shù)出口管制條例》和《有關(guān)化學(xué)品及相關(guān)設(shè)備和技術(shù)出口管制辦法》,制定本辦法。
第二條 本辦法所稱敏感物項(xiàng)和技術(shù)是指《中華人民共和國(guó)核兩用品及相關(guān)技術(shù)出口管制條例》、《中華人民共和國(guó)導(dǎo)彈及相關(guān)物項(xiàng)和技術(shù)出口管制條例》、《中華人民共和國(guó)生物兩用品及相關(guān)設(shè)備和技術(shù)出口管制條例》和《有關(guān)化學(xué)品及相關(guān)設(shè)備和技術(shù)出口管制辦法》所附清單中的物項(xiàng)和技術(shù)。
第三條 凡從事敏感物項(xiàng)和技術(shù)出口的經(jīng)營(yíng)者(以下簡(jiǎn)稱經(jīng)營(yíng)者),必須按照本辦法規(guī)定,向?qū)ν赓Q(mào)易經(jīng)濟(jì)合作部(以下簡(jiǎn)稱外經(jīng)貿(mào)部)申請(qǐng)登記。未經(jīng)登記,任何單位或者個(gè)人不得經(jīng)營(yíng)敏感物項(xiàng)和技術(shù)的出口。
第四條 滿足下列條件的經(jīng)營(yíng)者,可向外經(jīng)貿(mào)部科技發(fā)展和技術(shù)進(jìn)出口司(以下簡(jiǎn)稱科技司)提出登記申請(qǐng)。
(一)經(jīng)外經(jīng)貿(mào)部批準(zhǔn),獲得進(jìn)出口企業(yè)資格證書或外商投資企業(yè)批準(zhǔn)證書,并已由工商行政管理部門核發(fā)營(yíng)業(yè)執(zhí)照;
?。ǘ┙?jīng)工商行政管理部門和外經(jīng)貿(mào)主管部門年審合格;
?。ㄈ┰谧罱陜?nèi)未受過國(guó)家刑事處罰或因進(jìn)行非法經(jīng)營(yíng)活動(dòng)受過有關(guān)部門行政處罰;
(四)了解所申請(qǐng)經(jīng)營(yíng)物項(xiàng)和技術(shù)的性能、指標(biāo)和主要用途;
(五)有負(fù)責(zé)出口和售后跟蹤服務(wù)事務(wù)的部門或機(jī)構(gòu)。
第五條 經(jīng)營(yíng)者申請(qǐng)登記時(shí),應(yīng)當(dāng)如實(shí)填寫并提交以下材料:
?。ㄒ唬┲腥A人民共和國(guó)敏感物項(xiàng)和技術(shù)出口經(jīng)營(yíng)登記申請(qǐng)表(見附件一);
?。ǘ┢髽I(yè)法人營(yíng)業(yè)執(zhí)照(復(fù)印件);
(三)進(jìn)出口企業(yè)資格證書(復(fù)印件)或外商投資企業(yè)批準(zhǔn)證書(復(fù)印件)。
第六條 外經(jīng)貿(mào)部科技司在收到登記申請(qǐng)后10個(gè)工作日內(nèi)決定是否予以登記。對(duì)予以登記的頒發(fā)《中華人民共和國(guó)敏感物項(xiàng)和技術(shù)出口經(jīng)營(yíng)登記證書》(以下簡(jiǎn)稱登記證書,見附件二),并加蓋"中華人民共和國(guó)出口管制專用章".
經(jīng)營(yíng)者提交材料不完整,需要經(jīng)營(yíng)者補(bǔ)報(bào)的,登記工作日自收到完整材料時(shí)起計(jì)算。
第七條 經(jīng)營(yíng)者在申請(qǐng)登記過程中不得故意隱瞞實(shí)情、提供虛假信息或以其他不正當(dāng)手段騙取登記證書。
第八條 登記證書僅對(duì)被登記的經(jīng)營(yíng)者有效,不得偽造、涂改、轉(zhuǎn)借、出租或轉(zhuǎn)讓。
第九條 企業(yè)名稱變更、合并、分立或撤銷的,經(jīng)營(yíng)者須及時(shí)通知外經(jīng)貿(mào)部科技司并交回原登記證書。需繼續(xù)從事敏感物項(xiàng)和技術(shù)出口的,應(yīng)重新履行登記手續(xù),領(lǐng)取新的登記證書。
第十條 登記證書有效期為三年。需繼續(xù)從事敏感物項(xiàng)和技術(shù)出口的,經(jīng)營(yíng)者應(yīng)在有效期滿一個(gè)月之前完成換領(lǐng)登記證書事宜。
第十一條 登記證書毀壞、遺失的,經(jīng)營(yíng)者應(yīng)及時(shí)通知外經(jīng)貿(mào)部科技司,并書面說明情況。需繼續(xù)從事敏感物項(xiàng)和技術(shù)出口的,應(yīng)重新履行登記手續(xù),領(lǐng)取新的登記證書。
第十二條 經(jīng)營(yíng)者在申請(qǐng)敏感物項(xiàng)和技術(shù)出口許可證件時(shí),須出示登記證書。
第十三條 經(jīng)登記的經(jīng)營(yíng)者在經(jīng)營(yíng)敏感物項(xiàng)和技術(shù)出口時(shí),必須嚴(yán)格遵守國(guó)家有關(guān)出口管制法律、法規(guī)和規(guī)章,并自覺接受外經(jīng)貿(mào)部的管理。
第十四條 經(jīng)營(yíng)者未經(jīng)登記,擅自經(jīng)營(yíng)敏感物項(xiàng)和技術(shù)出口的,依照《中華人民共和國(guó)核兩用品及相關(guān)技術(shù)出口管制條例》、《中華人民共和國(guó)導(dǎo)彈及相關(guān)物項(xiàng)和技術(shù)出口管制條例》、《中華人民共和國(guó)生物兩用品及相關(guān)設(shè)備和技術(shù)出口管制條例》、《有關(guān)化學(xué)品及相關(guān)設(shè)備和技術(shù)出口管制辦法》和其他有關(guān)法律法規(guī)的規(guī)定處理。
第十五條 經(jīng)營(yíng)者違反本辦法第七條、第八條、第九條的規(guī)定,外經(jīng)貿(mào)部除可處以警告處罰外,并可依照有關(guān)規(guī)定注銷其登記證書。
第十六條 經(jīng)登記的經(jīng)營(yíng)者在經(jīng)營(yíng)敏感物項(xiàng)和技術(shù)出口過程中有違反國(guó)家出口管制法律、法規(guī)和規(guī)章行為的,除根據(jù)有關(guān)法律法規(guī)給予處罰外,外經(jīng)貿(mào)部并可依照有關(guān)規(guī)定注銷其登記證書。被注銷登記證書后,經(jīng)營(yíng)者需重新履行登記手續(xù)后方可從事敏感物項(xiàng)和技術(shù)的出口。
第十七條 本辦法中的復(fù)印件均指加蓋有關(guān)發(fā)證機(jī)關(guān)印章的復(fù)印件。
第十八條 本辦法由外經(jīng)貿(mào)部負(fù)責(zé)解釋。
第十九條 本辦法自2002年11月12日起生效?!吨腥A人民共和國(guó)導(dǎo)彈及相關(guān)物項(xiàng)和技術(shù)出口經(jīng)營(yíng)登記(暫行)管理辦法》同時(shí)廢止。

Measures of The People's Republic of China for The Administration of The Export
Registration of Sensitive Items And Technologies
(Order No.35 in 2002 of the MOFTEC of China)
The Measures of the People''s Republic of China for the Administration of the
Export Registration of Sensitive Items and Technologies have been formulated on
the basis of the Regulation of the People''s Republic of China on Controlling
the Export of Dual-purpose Nuclear Products and Affiliated Technologies, the
Regulation of the People''s Republic of China on Controlling the Export of
Guided Missiles and Affiliated Items and Technologies, the Regulation of the
People''s Republic of China on Controlling the Export of Dual-purpose Biological
Products and Affiliated Equipments and Technologies, and the Measures for
Controlling the Export of Relevant Chemical Products and Affiliated
Technologies, and have been adopted at the 11th executive meeting of the MOFTEC.
They are hereby promulgated for effect as of November 12, 2002. Shi Guangsheng,

Measures of the People''s Republic of China for the Administration of the
Export Registration of Sensitive Items and Technologies
Article 1 With a view to regulating the management order of the export of
sensitive items and technologies, and enhancing the administration of the export
management of sensitive items and technologies, the present Measures have been
formulated on the basis of the Regulation of the People''s Republic of China on
Controlling the Export of Dual-purpose Nuclear Products and Affiliated
Technologies, the Regulation of the People''s Republic of China on Controlling
the Export of Guided Missiles and Affiliated Items and Technologies, the
Regulation of the People''s Republic of China on Controlling the Export of
Dual-purpose Biological Products and Affiliated Equipments and Technologies, and
the Measures for Controlling the Export of Relevant Chemical Products and
Affiliated Technologies.
Article 2 The term "sensitive items and technologies" as mentioned in the
present Measures shall refer to any of the items and technologies as described
in the name lists attached to the Regulation of the People''s Republic of China
on Controlling the Export of Dual-purpose Nuclear Products and Affiliated
Technologies, the Regulation of the People''s Republic of China on Controlling
the Export of Guided Missiles and Affiliated Items and Technologies, the
Regulation of the People''s Republic of China on Controlling the Export of
Dual-purpose Biological Products and Affiliated Equipments and Technologies, and
the Measures for Controlling the Export of Relevant Chemical Products and
Affiliated Technologies.
Article 3 Any business operator that engages in the export of sensitive items
and technologies (hereafter "business operator") shall apply for registration
with the Ministry of Foreign Trade and Economic Cooperation (hereafter "MOFTEC")
according to the provisions of the present Measures. No entity or individual
may, without being registered, engage in the export of any sensitive item or
technology.
Article 4 Any business operator that meet the following conditions may apply
to the Department of Scientific and Technologic Development and the Import and
Export of Technologies under the MOFTEC (hereafter "the Technology Department")
for registration.
?。?) Having obtained a certificate of enterprise qualification for import and
export or an approval certificate of foreign-funded enterprise upon the approval
of the MOFTEC, and having obtained a business license issued by the
administrative department of industry and commerce;
(2) Having passed the annual inspections of the administrative department of
industry and commerce and the administrative department of foreign trade and
economic cooperation;
?。?) Having no record of criminal sanctions imposed by the state or
administrative punishment imposed by relevant departments for engagement in
illegal business operations within the recent three years;
?。?) Having knowledge of the performance, indices and major uses of the items
and technologies that it applies for management;
?。?) Having a department or institution that takes charge of the export and
after-sales follow-up services.
Article 5 To apply for registration, a business operator shall truthfully fill
in and submit the following materials:
?。?) Application Form of the People''s Republic of China for the Export
Registration of Sensitive Items and Technologies (see Attachment I);
?。?) Business License of Legal Person Enterprise (in photocopy);
?。?) Qualifications Certificate of an Import & Export Enterprise (in photocopy)
or Approval Certificate of a Foreign-funded Enterprise (in photocopy).d.
Article 6 The Technology Department under the MOFTEC shall, within 10 workdays
after receiving the application for registration, decide whether registration is
to be granted. Where registration is to be granted, a Registration Certificate
of the People''s Republic of China for the Export of Sensitive Items and
Technologies (hereafter "Registration Certificate", see Attachment II) shall be
issued, and to which the Special Seal of the People''s Republic of China for
Export Control" shall be affixed. In case the materials submitted by the
business operator is incomplete and need to be supplemented, the time limit for
registration shall be counted as of the day when complete materials are
received.
Article 7 No business operator may, in the process of applying for
registration, deliberately conceal any true facts, provide any false information
or obtain a Registration Certificate by any unlawful means.
Article 8 The Registration Certificate shall be valid to the registered
business operator only, and may not be forged, altered, lent, leased or
transferred.
Article 9 In case the name of the enterprise is changed or the enterprise is
merged, split or rescinded, the business operator shall inform the Department of
Technology under the MOFTEC and return the original Registration Certificate in
good time. In case it need to continue engaging in the export of sensitive items
and technologies, it shall go through registration procedures anew and obtain a
new Registration Certificate.
Article 10 A Registration Certificate shall be valid for a term of three
years. In case the business operator concerned needs to continue engaging in the
export of sensitive items and technologies, it shall accomplish the change of
Registration Certificates one month prior to the expiration of the valid term.
Article 11 In case any Registration Certificate is damaged or missing, the
business operator concerned shall inform the Department of Technology under the
MOFTEC and submit a written explanation in good time. If it needs to continue
engaging in the export of sensitive items and technologies, it shall go through
the procedures of registration anew, and obtain a new Registration Certificate.
Article 12 A business operator shall, when applying for approval certificates
for the export of sensitive items and technologies, show its Registration
Certificate.
Article 13 All registered business operators shall, when engaging in the
export of sensitive items and technologies, rigidly comply to the laws,
regulations and ministerial rules of the state concerning export control, and
shall voluntarily accept the administration of the MOFTEC.
Article 14 Any business operator who unlawfully engages in the export of any
sensitive item or technology without being registered shall be dealt with
according to relevant statutory provisions including the Regulation of the
People''s Republic of China on Controlling the Export of Dual-purpose Nuclear
Products and Affiliated Technologies, the Regulation of the People''s Republic
of China on Controlling the Export of Guided Missiles and Affiliated Items and
Technologies, the Regulation of the People''s Republic of China on Controlling
the Export of Dual-purpose Biological Products and Affiliated Equipments and
Technologies, and the Measures for Controlling the Export of Relevant Chemical
Products and Affiliated Technologies, etc.
Article 15 Any business operator that violates the provisions of eitherArticle
7 or 8 or 9 of the present Measures may, apart from being given a warning by the
MOFTEC, be punished by having its Registration Certificate canceled according to
relevant provisions.
Article 16 In case any registered business operator commits any act of
violating any of the laws, regulations or ministerial rules of the state
concerning export control in the process of managing the export of sensitive
items or technologies, the MOFTEC may, apart from meting out punishments thereto
according to relevant statutory provisions, cancel the Registration Certificate
thereof according to relevant provisions. The business operator shall, after the
Registration Certificate thereof being canceled, go through registration
procedures anew before engaging in the export of sensitive items and
technologies.
Article 17 The term "photocopy" as mentioned in the present Measures shall
refer to one that bears the seal of the certificate issuing organ.
Article 18 The power to interpret the present Measures shall remain with the
MOFTEC.
Article 19 The present Measures shall enter into force as of November 12,
2002. The Measures of the People''s Republic of China for the (Interim)
Administration of the Export Registration of Guided Missiles and Affiliated
Items and Technologies shall be repealed concurrently.
