Law of the People's Republic of China on Prevention and Control of Pollution
From Environmental Noise
第一條 為防治環(huán)境噪聲污染，保護(hù)和改善生活環(huán)境，保障人體健康，促進(jìn)經(jīng)濟(jì)和社會發(fā)展，制定本法。
Article 1 This Law is enacted for the purpose of preventing and controlling
environmental noise pollution, protecting and improving the living environment,
ensuring human health and promoting economic and social development.
第二條 本法所稱環(huán)境噪聲，是指在工業(yè)生產(chǎn)、建筑施工、交通運輸和社會生活中所產(chǎn)生的干擾周圍生活環(huán)境的聲音。
Article 2 For purposes of this Law, "environmental noise" means the sound that
is emitted in the course of industrial production, construction, transportation
and social activities and that impairs the living environment of the
neighbourhood.
本法所稱環(huán)境噪聲污染，是指所產(chǎn)生的環(huán)境噪聲超過國家規(guī)定的環(huán)境噪聲排放標(biāo)準(zhǔn)，并干擾他人正常生活、工作和學(xué)習(xí)的現(xiàn)象。
"environmental noise pollution", as used in this Law, means that the
environmental noise emitted exceeds the environmental noise emitted limits set
by the State on the environmental noise emitted and impairs people's daily life,
work and study.
第三條 本法適用于中華人民共和國領(lǐng)域內(nèi)環(huán)境噪聲污染的防治。
Article 3 This Law shall apply to prevention and control of environmental
noise pollution in the territory of the People's Republic of China.
因從事本職生產(chǎn)、經(jīng)營工作受到噪聲危害的防治，不適用本法。
This Law shall not apply to prevention and control of noise hazards incurred
in the course of production or business operation one is engaged in.
第四條 國務(wù)院和地方各級人民政府應(yīng)當(dāng)將環(huán)境噪聲污染防治工作納入環(huán)境保護(hù)規(guī)劃，并采取有利于聲環(huán)境保護(hù)的經(jīng)濟(jì)、技術(shù)政策和措施。
Article 4 The State Council and local people's governments at various levels
shall incorporate prevention and control of environmental noise pollution into
their environmental protection plans and adopt economic and technological
policies and measures to protect the acoustic environment.
第五條
地方各級人民政府在制定城鄉(xiāng)建設(shè)規(guī)劃時，應(yīng)當(dāng)充分考慮建設(shè)項目和區(qū)域開發(fā)、改造所產(chǎn)生的噪聲對周圍生活環(huán)境的影響，統(tǒng)籌規(guī)劃，合理安排功能區(qū)和建設(shè)布局，防止或者減輕環(huán)境噪聲污染。
Article 5 Local people's governments at various levels shall, when drawing up
urban and rural development plans, give full consideration to the impact of
noise emitted by construction projects and regional development and renovation
projects on the living environment of the neighbourhood, make unified plans and
rationally arrange the layout of the function areas and the buildings, in order
to prevent or minimize environmental noise pollution.
第六條 國務(wù)院環(huán)境保護(hù)行政主管部門對全國環(huán)境噪聲污染防治實施統(tǒng)一監(jiān)督管理。
Article 6 The competent administrative department for environmental protection
under the State Council shall exercise unified supervision and administration of
the prevention and control of environmental noise pollution throughout the
country.
縣級以上地方人民政府環(huán)境保護(hù)行政主管部門對本行政區(qū)域內(nèi)的環(huán)境噪聲污染防治實施統(tǒng)一監(jiān)督管理。
The competent administrative departments for environmental protection of the
local people's governments at or above the county level shall exercise unified
supervision and administration of the prevention and control of environmental
noise pollution within their respective administrative regions.
各級公安、交通、鐵路、民航等主管部門和港務(wù)監(jiān)督機(jī)構(gòu)，根據(jù)各自的職責(zé)，對交通運輸和社會生活噪聲污染防治實施監(jiān)督管理。
The competent administrative departments for public security, communications,
railways and civil aviation as well as harbour superintendency administration at
various levels shall, within their respective functions and duties, exercise
supervision and administration of the prevention and control of noise pollution
by traffic and social activities.
第七條 任何單位和個人都有保護(hù)聲環(huán)境的義務(wù)，并有權(quán)對造成環(huán)境噪聲污染的單位和個人進(jìn)行檢舉和控告。
Article 7 All units and individuals shall have the obligation to protect the
acoustic environment and shall have the right to inform against and accuse any
unit or individual that pollutes the environment with noise.
第八條 國家鼓勵、支持環(huán)境噪聲污染防治的科學(xué)研究、技術(shù)開發(fā)，推廣先進(jìn)的防治技術(shù)和普及防治環(huán)境噪聲污染的科學(xué)知識。
Article 8 The State encourages and supports scientific research and
technological development relating to the prevention and control of
environmental noise pollution, promotes wide adoption of advanced technologies
in this area and disseminates scientific knowledge about prevention and control
of such pollution.
第九條 對在環(huán)境噪聲污染防治方面成績顯著的單位和個人，由人民政府給予獎勵。
Article 9 The people's governments shall give awards to units and individuals
that have achieved outstanding successes in preventing and controlling
environmental noise pollution.
第二章 環(huán)境噪聲污染防治的監(jiān)督管理
CHAPTER II SUPERVISION AND ADMINISTRATION OF THE PREVENTION AND CONTROL OF
ENVIRONMENTAL NOISE POLLUTION
第十條 國務(wù)院環(huán)境保護(hù)行政主管部門分別不同的功能區(qū)制定國家聲環(huán)境質(zhì)量標(biāo)準(zhǔn)。
Article 10 The competent administrative department for environmental
protection under the State Council shall establish national standards for
acoustic environmental quality for different function areas.
縣級以上地方人民政府根據(jù)國家聲環(huán)境質(zhì)量標(biāo)準(zhǔn)，劃定本行政區(qū)域內(nèi)各類聲環(huán)境質(zhì)量標(biāo)準(zhǔn)的適用區(qū)域，并進(jìn)行管理。
Local people's governments at or above the county level shall, in accordance
with the national standards for acoustic environmental quality, divide their
respective administrative regions into different zones for application of
different standards for acoustic environmental quality and exercise control
accordingly.
第十一條 國務(wù)院環(huán)境保護(hù)行政主管部門根據(jù)國家聲環(huán)境質(zhì)量標(biāo)準(zhǔn)和國家經(jīng)濟(jì)、技術(shù)條件，制定國家環(huán)境噪聲排放標(biāo)準(zhǔn)。
Article 11 The competent administrative department for environmental
protection under the State Council shall, in accordance with the national
standards for acoustic environmental quality and the State's economic and
technological conditions, fix national limits for environmental noise emission.
第十二條 城市規(guī)劃部門在確定建設(shè)布局時，應(yīng)當(dāng)依據(jù)國家聲環(huán)境質(zhì)量標(biāo)準(zhǔn)和民用建筑隔聲設(shè)計規(guī)范，合理劃定建筑物與交通干線的防噪聲距離，并提出相應(yīng)的規(guī)劃設(shè)計要求。
Article 12 When determining the layout of buildings, urban planning
departments shall, in accordance with the national standards for acoustic
environmental quality and the sound insulation design standards for civil
architecture, decide on the rational distance between the structures and the
traffic trunk lines in order to keep the structures away form noise as well as
the requirements on planning and design accordingly.
第十三條 新建、改建、擴(kuò)建的建設(shè)項目，必須遵守國家有關(guān)建設(shè)項目環(huán)境保護(hù)管理的規(guī)定。
Article 13 Every project under construction, renovation or expansion must
conform to the regulations of the State governing environmental protection.
建設(shè)項目可能產(chǎn)生環(huán)境噪聲污染的，建設(shè)單位必須提出環(huán)境影響報告書，規(guī)定環(huán)境噪聲污染的防治措施，并按照國家規(guī)定的程序報環(huán)境保護(hù)行政主管部門批準(zhǔn)。
Where a construction project might cause environmental noise pollution, the
unit undertaking the project must prepare an environmental impact statement
which includes the measures it takes to prevent and control such pollution, and
submit it, following the procedures prescribed by the State, to the competent
administrative department for environmental protection for approval.
環(huán)境影響報告書中，應(yīng)當(dāng)有該建設(shè)項目所在地單位和居民的意見。
The environmental impact statement shall include the comments and suggestions
of the units and residents in the place where the construction project is
located.
第十四條 建設(shè)項目的環(huán)境噪聲污染防治設(shè)施必須與主體工程同時設(shè)計、同時施工、同時投產(chǎn)使用。
Article 14 Facilities for prevention and control of environmental noise
pollution must be designed, built and put into use simultaneously with the main
part of a construction project.
建設(shè)項目在投入生產(chǎn)或者使用之前，其環(huán)境噪聲污染防治設(shè)施必須經(jīng)原審批環(huán)境影響報告書的環(huán)境保護(hù)行政主管部門驗收；達(dá)不到國家規(guī)定要求的，該建設(shè)項目不得投入生產(chǎn)或者使用。
Before a construction project is put into production or use, its facilities
for prevention and control of environmental noise pollution must be inspected by
the competent administrative department for environmental protection that
originally approved the environmental impact statement; if such facilities fail
to meet the requirements of the State, the construction project may not be put
into production or use.
第十五條 產(chǎn)生環(huán)境噪聲污染的企業(yè)事業(yè)單位，必須保持防治環(huán)境噪聲污染的設(shè)施的正常使用；
Article 15 Enterprises and institutions that produce environmental noise
pollution must maintain normal operation of the facilities for prevention and
control of such pollution;
拆除或者閑置環(huán)境噪聲污染防治設(shè)施的，必須事先報經(jīng)所在地的縣級以上地方人民政府環(huán)境保護(hù)行政主管部門批準(zhǔn)。
whoever intends to dismantle or leave idle such facilities must report the
matter in advance to the competent administrative department for environmental
protection of the local people's government at or above the county level for
approval.
第十六條 產(chǎn)生環(huán)境噪聲污染的單位，應(yīng)當(dāng)采取措施進(jìn)行治理，并按照國家規(guī)定繳納超標(biāo)準(zhǔn)排污費。
Article 16 Units that produce environmental noise pollution shall take
measures to control it and pay fees for excessive emission of such pollution
according to the regulations of the State.
征收的超標(biāo)準(zhǔn)排污費必須用于污染的防治，不得挪作他用。
The fees collected from excessive emission of pollution must be used for
prevention and control of pollution and may not be appropriated for any other
use.
第十七條 對于在噪聲敏感建筑物集中區(qū)域內(nèi)造成嚴(yán)重環(huán)境噪聲污染的企業(yè)事業(yè)單位，限期治理。
Article 17 Any enterprise or institution that produces serious environmental
noise pollution in an area where noise-sensitive structures are concentrated
shall be ordered to control the pollution within a time limit.
被限期治理的單位必須按期完成治理任務(wù)。限期治理由縣級以上人民政府按照國務(wù)院規(guī)定的權(quán)限決定。
The unit that is ordered to control the pollution within a time limit must
accomplish the task on schedule. A decision on such control shall be made by the
people's government at or above the county level within the limits of its power
granted by the State Council.
對小型企業(yè)事業(yè)單位的限期治理，可以由縣級以上人民政府在國務(wù)院規(guī)定的權(quán)限內(nèi)授權(quán)其環(huán)境保護(hù)行政主管部門決定。
In the cases of a small enterprise or institution, the decision on controlling
pollution within a time limit may be made by the competent administrative
department for environmental protection that is authorized by a people's
government at or above the county level within the limits of its power granted
by the State Council.
第十八條 國家對環(huán)境噪聲污染嚴(yán)重的落后設(shè)備實行淘汰制度。
Article 18 The State applies an elimination system for out-dated equipment
that produces serious environmental noise pollution.
國務(wù)院經(jīng)濟(jì)綜合主管部門應(yīng)當(dāng)會同國務(wù)院有關(guān)部門公布限期禁止生產(chǎn)、禁止銷售、禁止進(jìn)口的環(huán)境噪聲污染嚴(yán)重的設(shè)備名錄。
The competent department for comprehensive economic and trade affairs under
the State Council shall, together with relevant departments of the State
Council, publish catalogs of equipment that, because of the serious
environmental noise pollution it produces, is forbidden to be manufactured, sold
or imported within a time limit.
生產(chǎn)者、銷售者或者進(jìn)口者必須在國務(wù)院經(jīng)濟(jì)綜合主管部門會同國務(wù)院有關(guān)部門規(guī)定的期限內(nèi)分別停止生產(chǎn)、銷售或者進(jìn)口列入前款規(guī)定的名錄中的設(shè)備。
The manufacturers, sellers and importers must stop manufacturing, selling or
importing the equipment included in the catalogs mentioned in the preceding
paragraph, within the time limit set by the competent department for
comprehensive economic and trade affairs under the State Council together with
the relevant departments of the State Council.
第十九條 在城市范圍內(nèi)從事生產(chǎn)活動確需排放偶發(fā)性強(qiáng)烈噪聲的，必須事先向當(dāng)?shù)毓矙C(jī)關(guān)提出申請，經(jīng)批準(zhǔn)后方可進(jìn)行。當(dāng)?shù)毓矙C(jī)關(guān)應(yīng)當(dāng)向社會公告。
Article 19 In the case where sporadic strong noise is truly unavoidable in
production conducted within an urban area, the matter must first be applied to
the local public security organ for approval. Upon giving approval, the local
public security organ shall make it known to the public.
第二十條 國務(wù)院環(huán)境保護(hù)行政主管部門應(yīng)當(dāng)建立環(huán)境噪聲監(jiān)測制度，制定監(jiān)測規(guī)范，并會同有關(guān)部門組織監(jiān)測網(wǎng)絡(luò)。
Article 20 The competent administrative department for environmental
protection under the State Council shall establish a system for monitoring
environmental noise, establish monitoring standards, and set up a monitoring
network with the relevant departments.
環(huán)境噪聲監(jiān)測機(jī)構(gòu)應(yīng)當(dāng)按照國務(wù)院環(huán)境保護(hù)行政主管部門的規(guī)定報送環(huán)境噪聲監(jiān)測結(jié)果。
The environmental noise monitoring institutions shall, as required, submit
reports on the environmental noise monitoring results to the competent
administrative department for environmental protection under the State Council.
第二十一條
縣級以上人民政府環(huán)境保護(hù)行政主管部門和其他環(huán)境噪聲污染防治工作的監(jiān)督管理部門、機(jī)構(gòu)，有權(quán)依據(jù)各自的職責(zé)對管轄范圍內(nèi)排放環(huán)境噪聲的單位進(jìn)行現(xiàn)場檢查。
Article 21 The competent administrative departments for environmental
protection of the people's governments at or above the county level and other
departments or institutions in charge of supervision and administration of the
prevention and control of environmental noise pollution shall, within the limits
of their respective functions and duties, have the power to conduct on-the-spot
inspection of the units that emit environmental noise within the areas under
their jurisdiction.
被檢查的單位必須如實反映情況，并提供必要的資料。
The units under inspection must give a true account of the actual situation
and provide the necessary information.
檢查部門、機(jī)構(gòu)應(yīng)當(dāng)為被檢查的單位保守技術(shù)秘密和業(yè)務(wù)秘密。
The departments or institutions conducting such inspection shall keep
confidential the technological and business secrets of the inspected units.
檢查人員進(jìn)行現(xiàn)場檢查，應(yīng)當(dāng)出示證件。
The inspectors shall produce their credentials before conducting on-the- spot
inspection.
第三章 工業(yè)噪聲污染防治
CHAPTER III PREVENTION AND CONTROL OF INDUSTRIAL NOISE POLLUTION
第二十二條 本法所稱工業(yè)噪聲，是指在工業(yè)生產(chǎn)活動中使用固定的設(shè)備時產(chǎn)生的干擾周圍生活環(huán)境的聲音。
Article 22 For purposes of this Law, "industrial noise" means the sound that
is emitted by the permanent equipment used in the course of industrial
production and that impairs the living environment of the neighbourhood.
第二十三條 在城市范圍內(nèi)向周圍生活環(huán)境排放工業(yè)噪聲的，應(yīng)當(dāng)符合國家規(guī)定的工業(yè)企業(yè)廠界環(huán)境噪聲排放標(biāo)準(zhǔn)。
Article 23 The industrial noise emitted to the living environment of the
neighbourhood within an urban area shall be kept within the limits set by the
State on emission of environmental noise within the boundary of an industrial
enterprise.
第二十四條
在工業(yè)生產(chǎn)中因使用固定的設(shè)備造成環(huán)境噪聲污染的工業(yè)企業(yè)，必須按照國務(wù)院環(huán)境保護(hù)行政主管部門的規(guī)定，向所在地的縣級以上地方人民政府環(huán)境保護(hù)行政主管部門申報擁有的造成環(huán)境噪聲污染的設(shè)備的種類、數(shù)量以及在正常作業(yè)條件下所發(fā)出的噪聲值和防治環(huán)境噪聲污染的設(shè)施情況，并提供防治噪聲污染的技術(shù)資料。
Article 24 Any industrial enterprise that produces environmental noise
pollution due to the use of permanent equipment in the course of industrial
production must, in accordance with the regulations of the competent
administrative department for environmental protection under the State Council,
report to the competent administrative department for environmental protection
of the local people's government at or above the county level the types and
quantity of its equipment that produces environmental noise pollution, the noise
level produced under normal operation and the facilities installed for
prevention and control of such pollution, and provide technical information
relating to the prevention and control of noise pollution.
造成環(huán)境噪聲污染的設(shè)備的種類、數(shù)量、噪聲值和防治設(shè)施有重大改變的，必須及時申報，并采取應(yīng)有的防治措施。
Any industrial enterprise that intends to make a substantial change in the
types or quantity of the equipment that produces environmental noise pollution,
in the noise level or facilities for prevention and control of such pollution
must submit a report without delay and take prevention and control measures as
it should.
第二十五條 產(chǎn)生環(huán)境噪聲污染的工業(yè)企業(yè)，應(yīng)當(dāng)采取有效措施，減輕噪聲對周圍生活環(huán)境的影響。
Article 25 Industrial enterprises that produce environmental noise pollution
shall take effective measures to minimize the impact of noise on the living
environment of the neighbourhood.
第二十六條
國務(wù)院有關(guān)主管部門對可能產(chǎn)生環(huán)境噪聲污染的工業(yè)設(shè)備，應(yīng)當(dāng)根據(jù)聲環(huán)境保護(hù)的要求和國家的經(jīng)濟(jì)、技術(shù)條件，逐步在依法制定的產(chǎn)品的國家標(biāo)準(zhǔn)、行業(yè)標(biāo)準(zhǔn)中規(guī)定噪聲限值。
Article 26 With regard to industrial equipment that might produce
environmental noise pollution, the relevant competent departments under the
State Council shall, in accordance with the requirements for protection of the
acoustic environment and the State's economic and technological conditions,
gradually include the noise level limits in the national standards and trade
standards for products established according to law.
前款規(guī)定的工業(yè)設(shè)備運行時發(fā)出的噪聲值，應(yīng)當(dāng)在有關(guān)技術(shù)文件中予以注明。
The level of noise emitted by the industrial equipment in operation mentioned
in the preceding paragraph shall be specified in relevant technical documents.
第四章 建筑施工噪聲污染防治
CHAPTER IV PREVENTION AND CONTROL OF CONSTRUCTION NOISE POLLUTION
第二十七條 本法所稱建筑施工噪聲，是指在建筑施工過程中產(chǎn)生的干擾周圍生活環(huán)境的聲音。
Article 27 "Construction noise", as used in this Law, means the sound that is
emitted in the course of construction and that impairs the living environment of
the neighbourhood.
第二十八條 在城市市區(qū)范圍內(nèi)向周圍生活環(huán)境排放建筑施工噪聲的，應(yīng)當(dāng)符合國家規(guī)定的建筑施工場界環(huán)境噪聲排放標(biāo)準(zhǔn)。
Article 28 The construction noise emitted to the living environment of the
neighbourhood within an urban area shall be kept within the limits set by the
State on the emission of environmental noise within the boundary of a
construction site.
第二十九條
在城市市區(qū)范圍內(nèi)，建筑施工過程中使用機(jī)械設(shè)備，可能產(chǎn)生環(huán)境噪聲污染的，施工單位必須在工程開工十五日以前向工程所在地縣級以上地方人民政府環(huán)境保護(hù)行政主管部門申報該工程的項目名稱、施工場所和期限、可能產(chǎn)生的環(huán)境噪聲值以及所采取的環(huán)境噪聲污染防治措施的情況。
Article 29 The unit in charge of a construction project which may produce
environmental noise pollution due to the use of machines and other equipment,
must report, 15 days before commencement of construction, to the competent
administrative department for environmental protection of the local people's
government at or above the county level the name of the project, the
construction site, the length of time needed for completion of the project, the
possible level of environmental noise and the measures taken for prevention and
control of such pollution.
第三十條 在城市市區(qū)噪聲敏感建筑物集中區(qū)域內(nèi)，禁止夜間進(jìn)行產(chǎn)生環(huán)境噪聲污染的建筑施工作業(yè)，但搶修、搶險作業(yè)和因生產(chǎn)工藝上要求或者特殊需要必須連續(xù)作業(yè)的除外。
Article 30 In an urban area where noise-sensitive structures are concentrated,
construction operation that produces environmental noise pollution is forbidden
at night, with the exception of rush repairs, rescue operations or continued
operations required by production techniques or by special needs.
因特殊需要必須連續(xù)作業(yè)的，必須有縣級以上人民政府或者其有關(guān)主管部門的證明。
For continued operation due to special needs, there must be a permit issued by
the people's government at or above the county level or by the relevant
competent department under it.
前款規(guī)定的夜間作業(yè)，必須公告附近居民。
Night operation mentioned in the preceding paragraph must be made known to the
residents in the neighbourhood.
第五章 交通運輸噪聲污染防治
CHAPTER V PREVENTION AND CONTROL OF TRAFFIC NOISE POLLUTION
第三十一條 本法所稱交通運輸噪聲，是指機(jī)動車輛、鐵路機(jī)車、機(jī)動船舶、航空器等交通運輸工具在運行時所產(chǎn)生的干擾周圍生活環(huán)境的聲音。
Article 31 "Traffic noise", as used in this Law means the sound that is
emitted by such means of transport as motor vehicles, locomotives, motor vessels
and aircraft in motion and that impairs the living environment of the
neighbourhood.
第三十二條 禁止制造、銷售或者進(jìn)口超過規(guī)定的噪聲限值的汽車。
Article 32 It is forbidden to manufacture, sell or import automobiles that
emit noise beyond the limits set on noise level.
第三十三條 在城市市區(qū)范圍內(nèi)行使的機(jī)動車輛的消聲器和喇叭必須符合國家規(guī)定的要求。機(jī)動車輛必須加強(qiáng)維修和保養(yǎng)，保持技術(shù)性能良好，防治環(huán)境噪聲污染。
Article 33 Mufflers and horns of motor vehicles driven within urban areas must
meet the requirements of the State. Motor vehicles must be regularly serviced
and kept in good repair in order to maintain excellent technical performance and
help prevent and control environmental noise pollution.
第三十四條 機(jī)動車輛在城市市區(qū)范圍內(nèi)行駛，機(jī)動船舶在城市市區(qū)的內(nèi)河航道航行，鐵路機(jī)車駛經(jīng)或者進(jìn)入城市市區(qū)、療養(yǎng)區(qū)時，必須按照規(guī)定使用聲響裝置。
Article 34 When motor vehicles are driven in urban areas, motor vessels are
navigated along inland rivers in urban areas, and locomotives are running
through or entering urban areas or sanatorium areas, their sound-making
apparatus must be used in compliance with regulations.
警車、消防車、工程搶險車、救護(hù)車等機(jī)動車輛安裝、使用警報器，必須符合國務(wù)院公安部門的規(guī)定；在執(zhí)行非緊急任務(wù)時，禁止使用警報器。
Alarming sirens must be installed on such motor vehicles as police cars, fire
engines, engineering rescue vehicles and ambulances and used in compliance with
the regulations of the public security department under the State Council. It is
forbidden to use the alarming sirens unless when urgent tasks are performed.
第三十五條 城市人民政府公安機(jī)關(guān)可以根據(jù)本地城市市區(qū)區(qū)域聲環(huán)境保護(hù)的需要，劃定禁止機(jī)動車輛行駛和禁止其使用聲響裝置的路段和時間，并向社會公告。
Article 35 The public security organs of municipal people's governments may,
in line with the need to protect the local acoustic environment of the urban
areas, demarcate no-motor-vehicle or no-horn road sections and hours, and make
them known to the public.
第三十六條
建設(shè)經(jīng)過已有的噪聲敏感建筑物集中區(qū)域的高速公路和城市高架、輕軌道路，有可能造成環(huán)境噪聲污染的，應(yīng)當(dāng)設(shè)置聲屏障或者采取其他有效的控制環(huán)境噪聲污染的措施。
Article 36 To build expressways, urban overhead road and light-tract lines
that traverse areas where there are concentrated noise-sensitive structures and
that might produce environmental noise pollution, sound barriers shall be
erected or other effective measures shall be taken to control environmental
noise pollution.
第三十七條 在已有的城市交通干線的兩側(cè)建設(shè)噪聲敏感建筑物的，建設(shè)單位應(yīng)當(dāng)按照國家規(guī)定間隔一定距離，并采取減輕、避免交通噪聲影響的措施。
Article 37 To build noise-sensitive structures on both sides of existing urban
traffic trunk lines, the construction unit shall, in accordance with the
regulations of the State, keep such structures a certain distance away from the
lines and take measures to mitigate or avoid the impact of traffic noise.
第三十八條 在車站、鐵路編組站、港口、碼頭、航空港等地指揮作業(yè)時使用廣播喇叭的，應(yīng)當(dāng)控制音量，減輕噪聲對周圍生活環(huán)境的影響。
Article 38 Where loudspeakers are used to direct operations at transport
terminals, railway marshal yards, ports, docks and airports, the sound volume
shall be controlled so as to minimize the noise impact on the living environment
of the neighbourhood.
第三十九條
穿越城市居民區(qū)、文教區(qū)的鐵路，因鐵路機(jī)車運行造成環(huán)境噪聲污染的，當(dāng)?shù)爻鞘腥嗣裾畱?yīng)當(dāng)組織鐵路部門和其他有關(guān)部門，制定減輕環(huán)境噪聲污染的規(guī)劃。鐵路部門和其他有關(guān)部門應(yīng)當(dāng)按照規(guī)劃的要求，采取有效措施，減輕環(huán)境噪聲污染。
Article 39 Where locomotives when traversing urban residential, cultural and
education districts produce environmental noise pollution, the local municipal
people's governments shall get the railway departments and other relevant
departments together to work out plans for mitigating such pollution. The
railway departments and other relevant departments shall act in accordance with
such plans and take effective measures to mitigate environmental noise
pollution.
第四十條 除起飛、降落或者依法規(guī)定的情形以外，民用航空器不得飛越城市市區(qū)上空。
Article 40 With the exception of take-off, landing or other situations as
provided for by law, no civil aircraft may fly over the urban areas of cities.
城市人民政府應(yīng)當(dāng)在航空器起飛、降落的凈空周圍劃定限制建設(shè)噪聲敏感建筑物的區(qū)域；
The municipal people's governments shall demarcate areas in the vicinity of
obstacle clearance zones for the take-off and landing of aircraft where
construction of noise-sensitive structures is restricted.
在該區(qū)域內(nèi)建設(shè)噪聲敏感建筑物的，建設(shè)單位應(yīng)當(dāng)采取減輕、避免航空器運行時產(chǎn)生的噪聲影響的措施。
To build noise-sensitive structures within such areas, the construction units
shall take measure to mitigate or avoid the impact of the noise emitted by
aircraft in motion.
民航部門應(yīng)當(dāng)采取有效措施，減輕環(huán)境噪聲污染。
The civil aviation department shall take effective measures to mitigate
environmental noise pollution.
第六章 社會生活噪聲污染防治
CHAPTER VI PREVENTION AND CONTROL OF POLLUTION BY NOISE OF SOCIAL ACTIVITIES
第四十一條 本法所稱社會生活噪聲，是指人為活動所產(chǎn)生的除工業(yè)噪聲、建筑施工噪聲和交通運輸噪聲之外的干擾周圍生活環(huán)境的聲音。
Article 41 "Noise of social activities", as used in this Law, means the sound
that is emitted by man-conducted activities and that impairs the living
environment of the neighbourhood, other than industrial, construction and
traffic noise.
第四十二條
在城市市區(qū)噪聲敏感建筑物集中區(qū)域內(nèi)，因商業(yè)經(jīng)營活動中使用固定設(shè)備造成環(huán)境噪聲污染的商業(yè)企業(yè)，必須按照國務(wù)院環(huán)境保護(hù)行政主管部門的規(guī)定，向所在地的縣級以上地方人民政府環(huán)境保護(hù)行政主管部門申報擁有的造成環(huán)境噪聲污染的設(shè)備的狀況和防治環(huán)境噪聲污染的設(shè)施的情況。
Article 42 A commercial enterprise that, in an urban area where
noise-sensitive structures are concentrated, produce environmental noise
pollution as the result of its use of permanent equipment in the course of
commercial activities must, in accordance with the regulations of the competent
administrative department for environmental protection under the State Council,
report to the competent administrative department for environmental protection
of the local people's government at or above the county level the condition of
the equipment that produces environmental noise pollution and provide
information about the facilities for prevention and control of such pollution.
第四十三條 新建營業(yè)性文化娛樂場所的邊界噪聲必須符合國家規(guī)定的環(huán)境噪聲排放標(biāo)準(zhǔn)；
Article 43 Noise level at the boundary of newly-constructed profit- making
cultural and entertainment centers must be kept within the limits of
environmental noise emission set by the State.
不符合國家規(guī)定的環(huán)境噪聲排放標(biāo)準(zhǔn)的，文化行政主管部門不得核發(fā)文化經(jīng)營許可證，工商行政管理部門不得核發(fā)營業(yè)執(zhí)照。
No competent administrative department for culture may issue cultural
operation licence and no administrative department for industry and commerce may
issue business licence to the centers that fail to keep such emission within the
limits.
經(jīng)營中的文化娛樂場所，其經(jīng)營管理者必須采取有效措施，使其邊界噪聲不超過國家規(guī)定的環(huán)境噪聲排放標(biāo)準(zhǔn)。
Operators and managers of cultural and entertainment centers must take
effective measures to keep noise at the boundary from exceeding the limits set
by the State on emission of environmental noise.
第四十四條 禁止在商業(yè)經(jīng)營活動中使用高音廣播喇叭或者采用其他發(fā)出高噪聲的方法招攬顧客。
Article 44 In commercial activities high-pitch loudspeakers and other
loud-noise instruments are forbidden to be used for attracting customers.
在商業(yè)經(jīng)營活動中使用空調(diào)器、冷卻塔等可能產(chǎn)生環(huán)境噪聲污染的設(shè)備、設(shè)施的，其經(jīng)營管理者應(yīng)當(dāng)采取措施，使其邊界噪聲不超過國家規(guī)定的環(huán)境噪聲排放標(biāo)準(zhǔn)。
When using such equipment and facilities as air-conditioners and cooling
towers in commercial activities which might produce environmental noise
pollution, the operators and managers shall take measures to keep the noise at
the boundary from exceeding the limits set by the State on emission of
environmental noise.
第四十五條 禁止任何單位、個人在城市市區(qū)噪聲敏感建設(shè)物集中區(qū)域內(nèi)使用高音廣播喇叭。
Article 45 All units and individuals are forbidden to use high-pitch
loudspeakers in urban areas where noise-sensitive structures are concentrated.
在城市市區(qū)街道、廣場、公園等公共場所組織娛樂、集會等活動，使用音響器材可能產(chǎn)生干擾周圍生活環(huán)境的過大音量的，必須遵守當(dāng)?shù)毓矙C(jī)關(guān)的規(guī)定。
Where audio apparatus that might produce such excessive sound volume as to
impair the living environment of the neighbourhood are used for entertainments
arranged or gatherings held at such public places as streets, squares or parks
in urban areas, the regulations of the local public security organ must be
observed.
第四十六條 使用家用電器、樂器或者進(jìn)行其他家庭室內(nèi)娛樂活動時，應(yīng)當(dāng)控制音量或者采取其他有效措施，避免對周圍居民造成環(huán)境噪聲污染。
Article 46 Whoever uses household appliances or musical instruments or holds
other indoor entertainment activities shall keep the sound volume under control
or take other effective measures to avoid producing environmental noise
pollution to the neighbours.
第四十七條 在已竣工交付使用的住宅樓進(jìn)行室內(nèi)裝修活動，應(yīng)當(dāng)限制作業(yè)時間，并采取其他有效措施，以減輕、避免對周圍居民造成環(huán)境噪聲污染。
Article 47 Whoever makes indoor decoration and refitting in a residential
building that is already completed and delivered for use shall do so in
restricted hours and take other effective measures to mitigate or avoid
producing environmental noise pollution to the neighbours.
第七章 法律責(zé)任
CHAPTER VII LEGAL LIABILITY
第四十八條
違反本法第十四條的規(guī)定，建設(shè)項目中需要配套建設(shè)的環(huán)境噪聲污染防治設(shè)施沒有建成或者沒有達(dá)到國家規(guī)定的要求，擅自投入生產(chǎn)或者使用的，由批準(zhǔn)該建設(shè)項目的環(huán)境影響報告書的環(huán)境保護(hù)行政主管部門責(zé)令停止生產(chǎn)或者使用，可以并處罰款。
Article 48 Anyone who, in violation of the provisions of Article 14 of this
Law, puts into production or use a construction project before the necessary
facilities for prevention and control of environmental noise pollution have been
completed or meet the requirements laid down by the State, shall be ordered to
stop production or use and may also be fined by the competent administrative
department for environmental protection that originally approved the
environmental impact statement regarding this construction project.
第四十九條 違反本法規(guī)定，拒報或者謊報規(guī)定的環(huán)境噪聲排放申報事項的，縣級以上地方人民政府環(huán)境保護(hù)行政主管部門可以根據(jù)不同情節(jié)，給予警告或者處以罰款。
Article 49 Anyone who, in violation of the provisions of this Law, refuses to
report or makes a false report on the particulars subject to report regarding
the environmental noise emission, may be given a disciplinary warning or fined
in light of the seriousness of the violation by the competent administrative
department for environmental protection of the local people's government at or
above the county level.
第五十條
違反本法第十五條的規(guī)定，未經(jīng)環(huán)境保護(hù)行政主管部門批準(zhǔn)，擅自拆除或者閑置環(huán)境噪聲污染防治設(shè)施，致使環(huán)境噪聲排放超過規(guī)定標(biāo)準(zhǔn)的，由縣級以上地方人民政府環(huán)境保護(hù)行政主管部門責(zé)令改正，并處罰款。
Article 50 Any enterprise or institution that, in violation of the provisions
of Article 15 of this Law, dismantles or leaves idle the facilities for
prevention and control of environmental noise pollution without approval of the
competent administrative department for environmental protection, thereby
emitting environmental noise in excess of the limits prescribed, shall be
ordered to set it right and also be fined by the competent administrative
department for environmental protection of the local people's government at or
above the county level.
第五十一條 違反本法第十六條的規(guī)定，不按照國家規(guī)定繳納超標(biāo)準(zhǔn)排污費的，縣級以上地方人民政府環(huán)境保護(hù)行政主管部門可以根據(jù)不同情節(jié)，給予警告或者處以罰款。
Article 51 Any unit that, in violation of the provisions of Article 16 of this
Law, fails to pay, as required by the State, fees for excessive emission of
noise, may be given a disciplinary warning or fined, in light of the seriousness
of the violation, by the competent administrative department for environmental
protection of the local people's government at or above the county level.
第五十二條
違反本法第十七條的規(guī)定，對經(jīng)限期治理逾期未完成治理任務(wù)的企業(yè)事業(yè)單位，除依照國家規(guī)定加收超標(biāo)準(zhǔn)排污費外，可以根據(jù)所造成的危害后果處以罰款，或者責(zé)令停業(yè)、搬遷、關(guān)閉。
Article 52 Any enterprise or institution that, in violation of the provisions
of Article 17 of this Law, fails to put the pollution under control at the
expiration of the time limit, may be fined or ordered to suspend production or
to relocate or close down in light of the hazards so caused, in addition to
paying fees for excessive emission of noise as required by the State.
前款規(guī)定的罰款由環(huán)境保護(hù)行政主管部門決定。責(zé)令停業(yè)、搬遷、關(guān)閉由縣級以上人民政府按照國務(wù)院規(guī)定的權(quán)限決定。
The decision on a fine mentioned in the preceding paragraph shall be made by
the competent administrative department for environmental protection. The order
for suspension of production, relocation or closedown shall be issued by the
people's government at or above the county level within the limits of its power
granted by the State Council.
第五十三條 違反本法第十八條的規(guī)定，生產(chǎn)、銷售、進(jìn)口禁止生產(chǎn)、銷售、進(jìn)口的設(shè)備的，由縣級以上人民政府經(jīng)濟(jì)綜合主管部門責(zé)令改正；
Article 53 Anyone who, in violation of the provisions of Article 18 of this
Law, manufactures, sells or imports equipment prohibited to be manufactured,
sold or imported, shall be ordered by the competent department for comprehensive
economic and trade affairs of the people's government at or above the county
level to set it right;
情節(jié)嚴(yán)重的，由縣級以上人民政府經(jīng)濟(jì)綜合主管部門提出意見，報請同級人民政府按照國務(wù)院規(guī)定的權(quán)限責(zé)令停業(yè)、關(guān)閉。
if the violation is serious, the said department shall submit a proposal to
the people's government at the corresponding level for ordering, within the
limits of its power granted by the State Council, the violator to suspend
operation or close down.
第五十四條 違反本法第十九條的規(guī)定，未經(jīng)當(dāng)?shù)毓矙C(jī)關(guān)批準(zhǔn)，進(jìn)行產(chǎn)生偶發(fā)性強(qiáng)烈噪聲活動的，由公安機(jī)關(guān)根據(jù)不同情節(jié)給予警告或者處以罰款。
Article 54 Anyone who, in violation of the provisions of Article 19 of this
Law and without approval of the local public security organ, conducts activities
that emit sporadic strong noise shall be given a disciplinary warning or fined
by the said organ in light of the seriousness of the violation.
第五十五條
排放環(huán)境噪聲的單位違反本法第二十一條的規(guī)定，拒絕環(huán)境保護(hù)行政主管部門或者其他依照本法規(guī)定行使環(huán)境噪聲監(jiān)督管理權(quán)的部門、機(jī)構(gòu)現(xiàn)場檢查或者在被檢查時弄虛作假的，環(huán)境保護(hù)行政主管部門或者其他依照本法規(guī)定行使環(huán)境噪聲監(jiān)督管理權(quán)的監(jiān)督管理部門、機(jī)構(gòu)可以根據(jù)不同情節(jié)，給予警告或者處以罰款。
Article 55 Any unit emitting environmental noise that, in violation of the
provisions of Article 21 of this Law, refuses to undergo on-the-spot inspection
by the competent administrative department for environmental protection or by
any other department or institution that exercises its power of supervision and
control of environmental noise in accordance with the provisions of this Law, or
resorts to fraud when being inspected, may be given a disciplinary warning or be
fined in light of the seriousness of the violation by the said competent
administrative department or the said department or institution.
第五十六條
建筑施工單位違反本法第三十條第一款的規(guī)定，在城市市區(qū)噪聲敏感建筑的集中區(qū)域內(nèi)，夜間進(jìn)行禁止進(jìn)行的產(chǎn)生環(huán)境噪聲污染的建筑施工作業(yè)的，由工程所在地縣級以上地方人民政府環(huán)境保護(hù)行政主管部門責(zé)令改正，可以并處罰款。
Article 56 Any construction unit that, in violation of the provisions of
Paragraph 1 of Article 30 of this Law, conducts at night, in an urban area where
noise-sensitive structures are concentrated, construction operation that
produces environmental noise pollution and that is therefore prohibited, shall
be ordered to set it right and may also be fined by the competent administrative
department for environmental protection of the people's government at or above
the county level in the place where the construction project is located.
第五十七條 違反本法第三十四條的規(guī)定，機(jī)動車輛不按照規(guī)定使用聲響裝置的，由當(dāng)?shù)毓矙C(jī)關(guān)根據(jù)不同情節(jié)給予警告或者處以罰款。
Article 57 Anyone who uses the sound apparatus on the motor vehicle in
violation of the provisions of Article 34 of this Law shall be given a
disciplinary warning or be fined by the local public security organ in light of
the seriousness of the violation.
機(jī)動船舶有前款違法行為的，由港務(wù)監(jiān)督機(jī)構(gòu)根據(jù)不同情節(jié)給予警告或者處以罰款。
If a motor vessel is involved in the commission of the unlawful act mentioned
in the preceding paragraph, a disciplinary warning or fine shall be imposed by
the harbour superintendency administration in light of the seriousness of the
act.
鐵路機(jī)車有第一款違法行為的，由鐵路主管部門對有關(guān)責(zé)任人員給予行政處分。
If a railway locomotive is involved in the commission of the unlawful act
mentioned in the first paragraph, the competent railway department shall impose
administrative penalty on the person who is responsible for the act.
第五十八條 違反本法規(guī)定，有下列行為之一的，由公安機(jī)關(guān)給予警告，可以并處罰款：
Article 58 Anyone who, in violation of the provisions of this Law, commits any
of the following acts, shall be given a disciplinary warning and may also be
fined by the public security organ:
?。ㄒ唬┰诔鞘惺袇^(qū)噪聲敏感建筑物集中區(qū)域內(nèi)使用高音廣播喇叭；
(1) Using a high-pitch loudspeaker in an urban area where noise- sensitive
structures are concentrated;
（二）違反當(dāng)?shù)毓矙C(jī)關(guān)的規(guī)定，在城市市區(qū)街道、廣場、公園等公共場所組織娛樂、集會等活動，使用音響器材，產(chǎn)生干擾周圍生活環(huán)境的過大音量的；
(2) Using, in violation of the regulations of the local public security organ,
audio apparatus which produce such excessive sound volume as to impair the
living environment of the neighbourhood when offering entertainment or holding
gatherings in such public places as streets, squares or parks in urban areas; or
（三）未按本法第四十六條和第四十七條規(guī)定采取措施，從家庭室內(nèi)發(fā)出嚴(yán)重干擾周圍居民生活的環(huán)境噪聲的。
(3) Emitting from indoors environmental noise that seriously impairs life of
the neighbours, without taking measures in accordance with the provisions of
Article 46 or Article 47 of this Law.
第五十九條 違反本法第四十三條第二款、第四十四條第二款的規(guī)定，造成環(huán)境噪聲污染的，由縣級以上地方人民政府環(huán)境保護(hù)行政主管部門責(zé)令改正，可以并處罰款。
Article 59 Any operators or managers who, in violation of the provisions of
Paragraph 2 of Article 43 or Paragraph 2 of Article 44 of this Law, cause
environmental noise pollution, shall be ordered to set it right and may also be
fined by the competent administrative department for environmental protection of
the local people's government at or above the county level.
第六十條 違反本法第四十四條第一款的規(guī)定，造成環(huán)境噪聲污染的，由公安機(jī)關(guān)責(zé)令改正，可以并處罰款。
Article 60 Any operators or managers who, in violation of the provisions of
Paragraph 1 of Article 44 of this Law, cause environmental noise pollution shall
be ordered to set it right and may also be fined by the public security organ.
省級以上人民政府依法決定由縣級以上地方人民政府環(huán)境保護(hù)行政主管部門行使前款規(guī)定的行政處罰權(quán)的，從其決定。
Where the people's governments at or above the provincial level have decided
according to law that the competent administrative departments for environmental
protection of the local people's governments at or above the county level
exercise the power of administrative penalty mentioned in the preceding
paragraph, such decision shall be abided by.
第六十一條 受到環(huán)境噪聲污染危害的單位和個人，有權(quán)要求加害人排除危害；造成損失的，依法賠償損失。
Article 61 Any unit or individual suffering from the hazards of environmental
noise pollution shall have the right to demand the polluter to eliminate the
hazards; if a loss has been caused, it shall be compensated according to law.
賠償責(zé)任和賠償金額的糾紛，可以根據(jù)當(dāng)事人的請求，由環(huán)境保護(hù)行政主管部門或者其他環(huán)境噪聲污染防治工作的監(jiān)督管理部門、機(jī)構(gòu)調(diào)解處理；
Any dispute over the liability for losses or over the amount of compensation
may, at the request of the parties concerned, be mediated by the competent
administrative department for environmental protection or any other supervisory
and administrative department or institution in charge of prevention and control
of environmental noise pollution;
調(diào)解不成的，當(dāng)事人可以向人民法院起訴。當(dāng)事人也可以直接向人民法院起訴。
if such mediation fails, the parties may bring a lawsuit in a People's Court.
They may also directly bring a lawsuit In a People's Court.
第六十二條 環(huán)境噪聲污染防治監(jiān)督管理人員濫用職權(quán)、玩忽職守、徇私舞弊的，由其所在單位或者上級主管機(jī)關(guān)給予行政處分；構(gòu)成犯罪的，依法追究刑事責(zé)任。
Article 62 If any person who is in charge of supervision or administration of
prevention and control of noise pollution abuses his power, neglects his duty or
conducts malpractice for personal gain, the unit to which he belongs or the
competent authority at the higher level shall give him administrative penalty.
If a crime is constituted, criminal liability shall be investigated according to
law.
第八章 附則
CHAPTER VIII SUPPLEMENTARY PROVISIONS
第六十三條 本法中下列用語的含義是：
Article 63 For purposes of this Law, the meanings of the following terms are:
?。ㄒ唬霸肼暸欧拧笔侵冈肼曉聪蛑車瞽h(huán)境輻射噪聲。
(1) "Noise emission" means emission of noise from the source to the living
environment of the neighbourhood.
?。ǘ霸肼暶舾薪ㄖ铩笔侵羔t(yī)院、學(xué)校、機(jī)關(guān)、科研單位、住宅等需要保持安靜的建筑物。
(2) "Noise-sensitive structures" mean structures that require a quiet
environment such as hospitals, schools, government offices, research
institutions and residential buildings.
?。ㄈ霸肼暶舾薪ㄖ锛袇^(qū)域”是指醫(yī)療區(qū)、文教科研區(qū)和以機(jī)關(guān)或者居民住宅為主的區(qū)域。
(3) "Areas where noise-sensitive structures are concentrated" mean such areas
as medical treatment areas, cultural, education and research districts and areas
where government offices or residential buildings constitute the main buildings.
（四）“夜間”是指晚二十二點至晨六點之間的期間。
(4) "At night" means the period from 10:00 p.m. to 6:00 a.m.
?。ㄎ澹皺C(jī)動車輛”是指汽車和摩托車。
(5) "Motor vehicles" mean automobiles and motorcycles.
第六十四條 本法自１９９７年３月１日起施行。１９８９年９月２６日國務(wù)院發(fā)布的《中華人民共和國環(huán)境噪聲污染防治條例》同時廢止。
Article 64 This Law shall enter into force as of March 1, 1997. The
Regulations of the People's Republic of China on Prevention and Control of
Environmental Noise" promulgated by the State Council on September 26, 1989
shall be repealed at the same time.
