Rules for the Implementation of Frontier Health and Quarantine Law of the
People's Republic of China

第一章 一般規(guī)定
Chapter I General Provisions
第一條 根據(jù)《中華人民共和國(guó)國(guó)境衛(wèi)生檢疫法》(以下稱《國(guó)境衛(wèi)生檢疫法》)的規(guī)定,制定本細(xì)則。
Article 1 These Implementation Rules are formulated in accordance with the
Frontier Health and Quarantine Law of the People's Republic of China
(hereinafter referred to as "the Frontier Health and Quarantine Law).
第二條 《國(guó)境衛(wèi)生檢疫法》和本細(xì)則所稱:
Article 2 For the purpose of the Frontier Health and Quarantine Law and these
Implementation Rules, the definitions of the following terms are:
“查驗(yàn)”指國(guó)境衛(wèi)生檢疫機(jī)關(guān)(以下稱衛(wèi)生檢疫機(jī)關(guān))實(shí)施的醫(yī)學(xué)檢查和衛(wèi)生檢查。
"Inspection" means that the Frontier Health and Quarantine Organ (hereinafter
referred to as the "Health and Quarantine Organ") carries out medical inspection
and sanitary inspection.
“染疫人”指正在患檢疫傳染病的人,或者經(jīng)衛(wèi)生檢疫機(jī)關(guān)初步診斷,認(rèn)為已經(jīng)感染檢疫傳染病或者已經(jīng)處于檢疫傳染病潛伏期的人。
"Quarantinable Epidemic Victim" means a person who suffers from quarantinable
infectious disease or a person who has been proved through primary diagnosis by
the Health and Quarantine organ to have caught the quarantinable infectious
disease or have become an incubation carrier.
“染疫嫌疑人”指接觸過(guò)檢疫傳染病的感染環(huán)境,并且可能傳播檢疫傳染病的人。
"Quarantinable Epidemic Suspect" means a person who has been exposed to the
quarantinable epidemic environment and may transmit quarantinable infectious
diseases.
“隔離”指將染疫人收留在指定的處所,限制其活動(dòng)并進(jìn)行治療,直到消除傳染病傳播的危險(xiǎn)。
"Isolation" means that a person affected by a quarantinable epidemic disease
is being detained in a designated place for medical treatment until there is no
longer any risk of spreading the disease.
“留驗(yàn)”指將染疫嫌疑人收留在指定的處所進(jìn)行診察和檢驗(yàn)。
"Check-up detention" means that a suspect carrier of a quarantinable epidemic
disease is being detained in a designated place for diagnosis and check-up.
“就地診驗(yàn)”指一個(gè)人在衛(wèi)生檢疫機(jī)關(guān)指定的期間,到就近的衛(wèi)生檢疫機(jī)關(guān)或者其他醫(yī)療衛(wèi)生單位去接受診察和檢驗(yàn);或者衛(wèi)生檢疫機(jī)關(guān)、其他醫(yī)療衛(wèi)生單位到該人員的居留地,對(duì)其進(jìn)行診察和檢驗(yàn)。
"On-site clinical check-up" means that a person is required to go to the
nearest health and quarantine organ or medical treatment unit for diagnosis and
check-up within a specific period of time set by the health and quarantine organ
or that the person is visited by people either from the health and quarantine
organ or from the medical treatment unit for diagnosis and check-up.
“運(yùn)輸設(shè)備”指貨物集裝箱。
"Transportation facility" means cargo containers.
“衛(wèi)生處理”指隔離、留驗(yàn)和就地診驗(yàn)等醫(yī)學(xué)措施,以及消毒、除鼠、除蟲等衛(wèi)生措施。
"Sanitization" means both medical measures, including isolation, check-up
detention and on-site clinical check-up; and "sanitary measures" including
disinfection, deratization, and deinsectization.
“傳染病監(jiān)測(cè)”指對(duì)特定環(huán)境、人群進(jìn)行流行病學(xué)、血清學(xué)、病原學(xué)、臨床癥狀以及其他有關(guān)影響因素的調(diào)查研究,預(yù)測(cè)有關(guān)傳染病的發(fā)生、發(fā)展和流行。
"To monitor epidemic diseases" means to carry out survey in a specific
environment and among specific groups of people on matters relating to
epidemiology, serology, etiology, and clinical symptoms; and to make
prognostication of the incidence, development and spread of an epidemic disease.
“衛(wèi)生監(jiān)督”指執(zhí)行衛(wèi)生法規(guī)和衛(wèi)生標(biāo)準(zhǔn)所進(jìn)行的衛(wèi)生檢查、衛(wèi)生鑒定、衛(wèi)生評(píng)價(jià)和采樣檢驗(yàn)。
"Health supervision" means the sanitary inspection, identification, evaluation
and sampling conducted in the implementation of the health law and hygienic
standard.
“交通工具”指船舶、航空器、列車和其他車輛。
"Conveyance" means vessels, aircraft, trains and other motor vehicles.
“國(guó)境口岸”指國(guó)際通航的港口、機(jī)場(chǎng)、車站、陸地邊境和國(guó)界江河的關(guān)口。
"Frontier ports" means international seaports, airports, railway or bus
terminals on the border, and ports of entry at land frontiers and boundary
rivers.
第三條
衛(wèi)生檢疫機(jī)關(guān)在國(guó)境口岸工作的范圍,是指為國(guó)境口岸服務(wù)的涉外賓館、飯店、俱樂(lè)部,為入境、出境交通工具提供飲食、服務(wù)的單位和對(duì)入境、出境人員、交通工具、集裝箱和貨物實(shí)施檢疫、監(jiān)測(cè)、衛(wèi)生監(jiān)督的場(chǎng)所。
Article 3 Duty range for health and quarantine organs on the frontier shall
cover those hotels, restaurants and clubs on the frontier and those units that
provide food or services for the incoming or outgoing conveyance and those
places where quarantine inspection, sanitary monitoring and health supervision
on the incoming or outgoing persons, conveyance, containers and goods are
carried out.
第四條
入境、出境的人員、交通工具和集裝箱,以及可能傳播檢疫傳染病的行李、貨物、郵包等,均應(yīng)當(dāng)按照本細(xì)則的規(guī)定接受檢疫,經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,方準(zhǔn)入境或者出境。
Article 4 All persons, conveyance and containers, as well as articles such as
baggage, goods, postal parcels that may transmit quarantinable diseases are
subject to quarantine inspection upon entering or exiting the country in
accordance with these Rules, and entry and exit shall be allowed to them only
after an approval is issued by the health and quarantine office.
第五條 衛(wèi)生檢疫機(jī)關(guān)發(fā)現(xiàn)染疫人時(shí),應(yīng)當(dāng)立即將其隔離,防止任何人遭受感染,并按照本細(xì)則第八章的規(guī)定處理。
Article 5 When a quarantinable epidemic victim is discovered by the health and
quarantine organ, measures must be taken promptly in accordance with the rules
stipulated in Chapter VIII of these Rules to place him in isolation and prevent
other persons from being infected.
衛(wèi)生檢疫機(jī)關(guān)發(fā)現(xiàn)染疫嫌疑人時(shí),應(yīng)當(dāng)按照本細(xì)則第八章的規(guī)定處理,
When a quarantinable epidemic suspect is found by the health and quarantine
organ, he shall be dealt with in accordance with the rules stipulated in Chapter
VIII.
但對(duì)第八章規(guī)定以外的其他病種染疫嫌疑人,可以從該人員離開感染環(huán)境的時(shí)候算起,實(shí)施不超過(guò)該傳染病最長(zhǎng)潛伏期的就地診驗(yàn)或者留驗(yàn)以及其他的衛(wèi)生處理。
As for those suspects suffering from contagious diseases other than plague,
cholera and yellow fever as defined in Chapter VIII of these Rules, they shall
be subject to on-site clinical check-up or check-up detention as well as other
measures of sanitization for a period of time not exceeding the longest
incubation period of that contagious counting from the day they left the
infected environment.
第六條
衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)阻止染疫人、染疫賺疑人出境,但是對(duì)來(lái)自國(guó)外并且在到達(dá)時(shí)接受就地診驗(yàn)的人,本人要求出境的,可以準(zhǔn)許出境;如果乘交通工具出境,檢疫醫(yī)師應(yīng)當(dāng)將這種情況在出境檢疫證上簽注,同時(shí)通知交通工具負(fù)責(zé)人采取必要的預(yù)防措施。
Article 6 Health and quarantine organs are required to bar any quarantinable
epidemic victims or suspects from exit, with the exception of those who come
from abroad and have undergone on-site clinical checked up on arrival. These
persons can leave the port if they wish to; if they leave in conveyance,
quarantine physicians are required to annotate and comment on their Exit
Quarantine Certificates and to inform the person in charge of the conveyance to
take the necessary precautionary measures.
第七條 在國(guó)境口岸以及停留在該場(chǎng)所的入境、出境交通工具上,所有非因意外傷害而死亡并死因不明的尸體,必須經(jīng)衛(wèi)生檢疫機(jī)關(guān)查驗(yàn),并簽發(fā)尸體移運(yùn)許可證后,方準(zhǔn)移運(yùn)。
Article 7 When a death due to an unidentified cause other than accidental harm
is discovered at a frontier port, the corpse shall be subject to quarantine
inspection and only after an entry or exit permit is granted can the corpse be
removed.
第八條
來(lái)自國(guó)內(nèi)疫區(qū)的交通工具,或者在國(guó)內(nèi)航行中發(fā)現(xiàn)檢疫傳染病,疑似檢疫傳染病,或者有人非因意外傷害而死亡并死因不明的,交通工具負(fù)責(zé)人應(yīng)當(dāng)向到達(dá)的國(guó)境口岸衛(wèi)生檢疫機(jī)關(guān)報(bào)告,接受臨時(shí)檢疫。
Article 8 When a quarantine infectious disease or a disease suspected to be
quarantinable or a death due to an unidentified cause other than accidental harm
is discovered on conveyance from a domestic pestilence area or in the course of
a domestic voyage, the persons in charge of the conveyance are required to make
a report to the health and quarantine organ on arrival at the frontier port and
undergo preliminary quarantine inspection.
第九條 在國(guó)內(nèi)或者國(guó)外檢疫傳染病大流行的時(shí)候,國(guó)務(wù)院衛(wèi)生行政部門應(yīng)當(dāng)立即報(bào)請(qǐng)國(guó)務(wù)院決定采取下列檢疫措施的一部或者全部:
Article 9 In times when quarantinable infectious diseases are prevailing at
home or abroad, the administrative department of health under the State Council
shall report the situation to the State Council for decisions on taking the
following precautionary measures, partially or totally, in quarantine
inspection:
(一)下令封鎖陸地邊境、國(guó)界江河的有關(guān)區(qū)域;
(1) giving orders to blockade relevant sections of the border and frontier
water course;
(二)指定某些物品必須經(jīng)過(guò)消毒、除蟲,方準(zhǔn)由國(guó)外運(yùn)進(jìn)或者由國(guó)內(nèi)運(yùn)出;
(2) giving orders that certain articles must be disinfected or treated with
insecticides before they are allowed in or out of the country;
(三)禁止某些物品由國(guó)外運(yùn)進(jìn)或者由國(guó)內(nèi)運(yùn)出;
(3) giving orders to prohibit shipment, in or out, of certain articles;
(四)指定第一入境港口、降落機(jī)場(chǎng)。對(duì)來(lái)自國(guó)外疫區(qū)的船舶、航空器,除因遇險(xiǎn)或者其他特殊原因外,沒(méi)有經(jīng)第一入境港口、機(jī)場(chǎng)檢疫的,不準(zhǔn)進(jìn)入其他港口和機(jī)場(chǎng)。
(4) giving orders to designate the primary sea-ports and airports. Those
vessels or aircraft from foreign pestilence areas, without going through
quarantine inspection at the primary sea-port or airport, shall not be permitted
to get into any other sea-port or airport, with the exception of cases of
accidents or other special reasons.
第十條 入境、出境的集裝箱,貨物,廢舊物等物品在到達(dá)口岸的時(shí)候,承運(yùn)人、代理人或者貨主,必須向衛(wèi)生檢疫機(jī)關(guān)申報(bào)并接受衛(wèi)生檢疫;
Article 10 Upon the arrival of containers, goods, or discarded used materials
at the port ready for shipping in or out, the shipper, the carrier's agent or
the consignor is required to report to the health and quarantine organ for
inspection.
對(duì)來(lái)自疫區(qū)的、被傳染病污染的以及可能傳播檢疫傳染病或者發(fā)現(xiàn)與人類健康有關(guān)的嚙齒動(dòng)物和病媒昆蟲的集裝箱、貨物、廢舊物等物品,應(yīng)當(dāng)實(shí)施消毒,除鼠、除蟲或者其他必要的衛(wèi)生處理。
Containers, goods, or used materials that come from pestilence area or have
been contaminated by an epidemic disease or are likely to spread quarantinable
epidemic diseases or are found to have carried rodents which affect human health
and vectors are required to undergo disinfection, deratization, deinsectization
and other necessary sanitization process.
集裝箱、貨物、廢舊物等物品的貨主要求在其他地方實(shí)施衛(wèi)生檢疫、衛(wèi)生處理的,衛(wèi)生檢疫機(jī)關(guān)可以給予方便,并按規(guī)定辦理。
If the owner of the containers, goods or discarded used materials asks to go
through quarantine inspection or sanitization in other places, the health and
quarantine organ shall provide convenience and carry out the task in accordance
with regulations.
海關(guān)憑衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的衛(wèi)生處理證明放行。
The Customs office shall let them pass after checking the sanitization
certificate issued by the health and quarantine organ.
第十一條
入境、出境的微生物、人體組織、生物制品、血液及其制品等特殊物品的攜帶人、托運(yùn)人或者郵遞人,必須向衛(wèi)生檢疫機(jī)關(guān)申報(bào)并接受衛(wèi)生檢疫,未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,不準(zhǔn)入境、出境。
Article 11 Special articles which enter or leave the country such as
microzoaria, human tissue, biological, blood and hemoproducts shall be subject
to health and quarantine inspection. The carrier, the shipper or the parcel
sender of the above mentioned articles is required to declare at the health and
quarantine organ for inspection. Without permission by the health and quarantine
organ, there shall be no entry or exit of such articles.
海關(guān)憑衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的特殊物品審批單放行。
The Customs office shall let them pass after checking the Certificate of
Approval for Special Articles issued by the health and quarantine organ.
第十二條
入境、出境的旅客、員工個(gè)人攜帶或者托運(yùn)可能傳播傳染病的行李和物品,應(yīng)當(dāng)接受衛(wèi)生檢查。衛(wèi)生檢疫機(jī)關(guān)對(duì)來(lái)自疫區(qū)或者被傳染病污染的各種食品、飲料、水產(chǎn)品等應(yīng)當(dāng)實(shí)施衛(wèi)生處理或者銷毀,并簽發(fā)衛(wèi)生處理證明。
Article 12 Luggage and other articles carried along by incoming or outgoing
passengers or staff members or by means of registered shipment that may spread
quarantinable epidemic diseases, are required to undergo hygienic examination.
The health and quarantine organ shall exercise sanitization or destruction of
the foods, drinks and aquatic products that come from the pestilence area or
have been contaminated with epidemic diseases and issue a sanitization
certificate.
海關(guān)憑衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的衛(wèi)生處理證明放行。
The customs office shall let them pass after checking the sanitization
certificate issued by the health and quarantine organ.
第十三條 衛(wèi)生檢疫機(jī)關(guān)對(duì)應(yīng)當(dāng)實(shí)施衛(wèi)生檢疫的郵包進(jìn)行衛(wèi)生檢查和必要的衛(wèi)生處理時(shí),郵政部門應(yīng)予配合。未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,郵政部門不得運(yùn)遞。
Article 13 When the health and quarantine organ conducts health examination
and sanitization of the registered parcels, the postal unit is required to offer
cooperation. Without permission by the health and quarantine organ, the postal
unit may not ship the parcels.
第十四條 衛(wèi)生檢疫單、證的種類、式樣和簽發(fā)辦法,由國(guó)務(wù)院衛(wèi)生行政部門規(guī)定。
Article 14 The health administrative department under the State Council is the
organ of authority for making the various kinds of health and quarantine forms,
certificates as well as for their issuance.
第二章 疫情通報(bào)
Chapter II Report of Epidemic Situation
第十五條
在國(guó)境口岸以及停留在國(guó)境口岸的交通工具上,發(fā)現(xiàn)檢疫傳染病、疑似檢疫傳染病,或者有人非因意外傷害而死亡并死因不明時(shí),國(guó)境口岸有關(guān)單位以及交通工具的負(fù)責(zé)人,應(yīng)當(dāng)立即向衛(wèi)生檢疫機(jī)關(guān)報(bào)告。
Article 15 On discovering at, or on a conveyance at a frontier port a
quarantinable infectious disease, a disease suspected to be quarantinable or a
death due to an unidentified cause other than accidental harm, the relevant
departmentat the frontier port and the person in charge of the conveyance must
report immediately to the health and quarantine office.
第十六條
衛(wèi)生檢疫機(jī)關(guān)發(fā)現(xiàn)檢疫傳染病、監(jiān)測(cè)傳染病、疑似檢疫傳染病時(shí),應(yīng)當(dāng)向當(dāng)?shù)匦l(wèi)生行政部門和衛(wèi)生防疫機(jī)構(gòu)通報(bào);發(fā)現(xiàn)檢疫傳染病時(shí),還應(yīng)當(dāng)用最快的辦法向國(guó)務(wù)院衛(wèi)生行政部門報(bào)告。
Article 16 When the health and quarantine organ has discovered any
quarantinable epidemic cases or monitored epidemic diseases or any disease
suspected to be quarantinable, it must inform the local health administrative
unit and the epidemic prevention unit. When a quarantinable disease is
discovered, it must be promptly reported to the health administrative department
under the State Council.
當(dāng)?shù)匦l(wèi)生防疫機(jī)構(gòu)發(fā)現(xiàn)檢疫傳染病、監(jiān)測(cè)傳染病時(shí),應(yīng)當(dāng)向衛(wèi)生檢疫機(jī)關(guān)通報(bào)。
On the other hand, if the local epidemic prevention unit has discovered any
quarantinable epidemic cases or monitored epidemic diseases, it must keep the
health and quarantine organ informed about the matter.
第十七條 在國(guó)內(nèi)或者國(guó)外某一地區(qū)發(fā)生檢疫傳染病流行時(shí),國(guó)務(wù)院衛(wèi)生行政部門可以宣布該地區(qū)為疫區(qū)。
Article 17 At the time when any quarantinable epidemic disease is prevalent in
certain regions at home or abroad, the health administrative department under
the State Council may declare the regions as pestilence areas.
第三章 衛(wèi)生檢疫機(jī)關(guān)
Chapter III Health and Quarantine Organs
第十八條 衛(wèi)生檢疫機(jī)關(guān)根據(jù)工作需要,可以設(shè)立派出機(jī)構(gòu)。衛(wèi)生檢疫機(jī)關(guān)的設(shè)立、合并或者撤銷,由國(guó)務(wù)院衛(wèi)生行政部門決定。
Article 18 The health and quarantine organ may set up its agent organ if
necessary. The setting up, amalgamation or dissolution of any health and
quarantine organ shall be decided by the health administrative department under
the State Council.
第十九條 衛(wèi)生檢疫機(jī)關(guān)的職責(zé):
Article 19 The studies of the health and quarantine organ are as follows:
(一)執(zhí)行《國(guó)境衛(wèi)生檢疫法》及其實(shí)施細(xì)則和國(guó)家有關(guān)衛(wèi)生法規(guī);
(1) enforce "The Frontier Health and Quarantine Law" and the rules for
implementation of this law as well as other state regulations concerning public
health;
(二)收集、整理、報(bào)告國(guó)際和國(guó)境口岸傳染病的發(fā)生、流行和終息情況;
(2) collect, analyze information and report about the occurrence, prevalence
and the cessation of quarantinable epidemic diseases at the frontier port or
abroad;
(三)對(duì)國(guó)境口岸的衛(wèi)生狀況實(shí)施衛(wèi)生監(jiān)督,對(duì)入境、出境的交通工具、人員、集裝箱、尸體、骰骨以及可能傳播檢疫傳染病的行李、貨物、郵包等實(shí)施檢疫查驗(yàn)、傳染病監(jiān)測(cè)、衛(wèi)生監(jiān)督和衛(wèi)生處理;
(3) exercise sanitary supervision at the frontier port and conduct quarantine
inspection, epidemic disease monitoring, sanitary control and sanitization to
the conveyances, passengers, containers, corpses, human bones as well as
luggage, goods, postal parcels that may spread quarantinable epidemic diseases;
(四)對(duì)入境、出境的微生物、生物制品、人體組織、血液及其制品等特殊物品以及能傳播人類傳染病的動(dòng)物,實(shí)施衛(wèi)生檢疫;
(4) carry out health and quarantine inspection of any special articles such as
exported or imported microzoaria, biological, human tissue, blood and
hemoproducts as well as some animals that may spread human epidemic diseases;
(五)對(duì)入境、出境人員進(jìn)行預(yù)防接種、健康檢查、醫(yī)療服務(wù)、國(guó)際旅行健康咨詢和衛(wèi)生宣傳;
(5) offer services in preventive inoculation, physical check-up, medical
treatment, consultancy on hygiene and health for international travellers;
(六)簽發(fā)衛(wèi)生檢疫證件;
(6) issue health and quarantine certificates;
(七)進(jìn)行流行病學(xué)調(diào)查研究,開展科學(xué)實(shí)驗(yàn);
(7) make epidemiological survey and carry out scientific experiments;
(八)執(zhí)行國(guó)務(wù)院衛(wèi)生行政部門指定的其他工作。
(8) fulfil other tasks assigned to it by the health administrative department
under the State Council.
第二十條 國(guó)境口岸衛(wèi)生監(jiān)督員的職責(zé):
Article 20 Duties of the frontier health supervisor:
(一)對(duì)國(guó)境口岸和停留在國(guó)境口岸的入境、出境交通工具進(jìn)行衛(wèi)生監(jiān)督和衛(wèi)生宣傳;
(1) exercise sanitary control and carry out publicity on hygiene and health to
the conveyances at the frontier port or parked on the border waiting for exit or
entry;
(二)在消毒、除鼠、除蟲等衛(wèi)生處理方面進(jìn)行技術(shù)指導(dǎo);
(2) give technical guidance in sanitization, such as disinfection,
deratization and deinsectization;
(三)對(duì)造成傳染病傳播、嚙齒動(dòng)物和病媒昆蟲擴(kuò)散、食物中毒、食物污染等事故進(jìn)行調(diào)查,并提出控制措施。
(3) make investigation into the cases that has caused the spread of epidemic
diseases and the proliferation of rodent, vector insects, food-poisoning and
food-borne contamination, and suggest control measures.
第二十一條 衛(wèi)生檢疫機(jī)關(guān)工作人員、國(guó)境口岸衛(wèi)生監(jiān)督員在執(zhí)行任務(wù)時(shí),應(yīng)當(dāng)穿著檢疫制服,佩戴檢疫標(biāo)志;衛(wèi)生檢疫機(jī)關(guān)的交通工具在執(zhí)行任務(wù)期間,應(yīng)當(dāng)懸掛檢疫旗幟。
Article 21 When performing its duties, the health and quarantine inspector and
border health supervisor are required to wear their quarantine uniform and their
quarantine budges. Their conveyances at work are required to bear quarantine
flags.
檢疫制服、標(biāo)志、旗幟的式樣和使用辦法由國(guó)務(wù)院衛(wèi)生行政部門會(huì)同有關(guān)部門制定,報(bào)國(guó)務(wù)院審批。
The design of quarantine uniform, sign and flag and their uses shall be
determined jointly by the health administrative department under the State
Council and other departments concerned, subject to ratification by the State
Council.
第四章 海港檢疫
Chapter IV Seaport Quarantine
第二十二條 船舶的入境檢疫,必須在港口的檢疫錨地或者經(jīng)衛(wèi)生檢疫機(jī)關(guān)同意的指定地點(diǎn)實(shí)施。
Article 22 Quarantine inspection for incoming vessels must be carried out at
檢疫錨地由港務(wù)監(jiān)督機(jī)關(guān)和衛(wèi)生檢疫機(jī)關(guān)會(huì)商確定,報(bào)國(guó)分院交通和衛(wèi)生行政部門備案。
quarantine anchorage or at the designated place approved by the health and
quarantine organ. Quarantine anchorage shall be decided jointly by the harbour
superintendency administration and the health and quarantine organ. A report
about the decision shall be presented to the transportation department and the
health administration department under the State Council for the record.
第二十三條 船舶代理應(yīng)當(dāng)在受入境檢疫的船舶到達(dá)以前,盡早向衛(wèi)生檢疫機(jī)關(guān)通知下列事項(xiàng):
Article 23 Prior to the arrival of the vessel subject to entry quarantine
inspection, the shipping agent is required to inform the health and quarantine
organ at the earliest possible time of the following matters:
(一)船名、國(guó)籍、預(yù)定到達(dá)檢疫錨地的日期和時(shí)間;
(1) name and nationality of the vessel, scheduled date and time of arrival at
the quarantine anchorage;
(二)發(fā)航港、最后寄港;
(2) port of departure and port of last call;
(三)船員和旅客人數(shù);
(3) number of crew and passengers;
(四)貨物種類。
(4) type of cargo.
港務(wù)監(jiān)督機(jī)關(guān)應(yīng)當(dāng)將船舶確定到達(dá)檢疫錨地的日期和時(shí)間盡早通知衛(wèi)生檢疫機(jī)關(guān)。
The harbour superintendency administration must inform the health and
quarantine organ at the earliest possible time of the scheduled arrival date and
time of the vessel at the quarantine anchorage.
第二十四條
受入境檢疫的船舶,在航行中,發(fā)現(xiàn)檢疫傳染病、疑似檢疫傳染病,或者有人非因意外傷害而死亡并死因不明的,船長(zhǎng)必須立即向?qū)嵤z疫港口的衛(wèi)生檢疫機(jī)關(guān)報(bào)告下列事項(xiàng):
Article 24 In the course of navigation, if a quarantinable epidemic disease, a
disease suspected to be quarantinable, or a death due to an unidentified cause
other than accidental harm is discovered, the captain must make a prompt report
to the health and quarantine organ about the following matters:
(一)船名、國(guó)籍、預(yù)定到達(dá)檢疫錨地的日期和時(shí)間;
(1) name and nationality of the vessel, scheduled date and time of arrival at
the quarantine anchorage;
發(fā)航港、最后寄港;
(2) port of departure and port of final call;
(三)船員和旅客人數(shù);
(3) number of crew and passengers;
(四)貨物種類;
(4) type of cargo;
(五)病名或者主要癥狀、患病人數(shù)、死亡人數(shù);
(5) name of disease or principal symptoms, number of cases and deaths;
(六)船上有無(wú)船醫(yī)。
(6) whether there are any vessel doctors on board the vessel.
第二十五條 受入境檢疫的船舶,必須按照下列規(guī)定懸掛檢疫信號(hào)等候查驗(yàn),在衛(wèi)生檢疫機(jī)關(guān)發(fā)給入境檢疫證前,不得降下檢疫信號(hào)。
Article 25 All vessels subject to entry quarantine inspection are required to
hoist quarantine signals ready for inspection. Without getting an Entry
Quarantine Permit issued by the health and quarantine organ, the quarantine
signals shall not be lowered.
晝間在明顯處所懸掛國(guó)際通語(yǔ)信號(hào)旗:
In the day time, an international signal flag shall be put up at a conspicuous
place on the vessel:
(一)“Q’字旗表示:本船沒(méi)有染疫,請(qǐng)發(fā)給入境檢疫證;
(1) The "Q" sign flag means that the vessel is free from quarantinable
epidemic diseases, and is applying for an Entry Quarantine Permit;
(二)“QQ”字旗表示:本船有染疫或者染疫嫌疑,請(qǐng)即刻實(shí)施檢疫。
(2) The "QQ" sign flag means that the vessel has on board a quarantinable
epidemic disease or a disease suspected to be quarantinable and asks for instant
quarantine sanitization.
夜間在明顯處所垂直懸掛燈號(hào):
During the night, a light-signal shall be put up vertically at a conspicuous
place on the vessel:
(一)紅燈3盞表示:本船沒(méi)有染疫,請(qǐng)發(fā)給入境檢疫證;
(1) Three red lights indicate that the vessel is free from quarantinable
epidemic disease and is applying for an Entry Quarantine Permit;
(二)紅、紅、白、紅燈4盞表示:本船有染疫或者染疫嫌疑,請(qǐng)即刻實(shí)施檢疫。
(2) Four lights in the order of Red-Red-White-Red indicate that the vessel has
been contaminated by a quarantinable epidemic disease or a disease suspected to
be quarantinable and asks for instant quarantine sanitization.
第二十六條
懸掛檢疫信號(hào)的船舶,除引航員和經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可的人員外,其他人員不準(zhǔn)上船,不準(zhǔn)裝卸行李、貨物、郵包等物品,其他船舶不準(zhǔn)靠近;船上的人員,除因船舶遇險(xiǎn)外,未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,不準(zhǔn)離船;引航員不得將船引離檢疫錨地。
Article 26 No persons other than navigation pilot and those approved by the
health and quarantine organ shall be allowed to get on board the vessel(s) with
quarantine flag or light signal(s); no unloading of luggage, cargo, postal
parcels shall be allowed; no other vessel shall be allowed to get close; no crew
member shall be allowed to leave the vessel without the approval by the health
and quarantine organ, unless the vessel is in distress. The navigation pilot
shall not guide the vessel(s) away from the quarantine anchorage.
第二十七條 申請(qǐng)電訊檢疫的船舶,首先向衛(wèi)生檢疫機(jī)關(guān)申請(qǐng)衛(wèi)生檢查,合格者發(fā)給衛(wèi)生證書,該證書自簽發(fā)之日起12個(gè)月內(nèi)可以申請(qǐng)電訊檢疫。
Article 27 Vessel(s) applying for quarantine inspection by telecommunication
must first submit an application to the health and quarantine organ. A sanitary
certificate shall be issued to the qualified vessel(s) which may apply for
telecommunicated quarantine inspection within 12 months as of the issuance of
the certificate.
第二十八條 持有效衛(wèi)生證書的船舶在入境前24小時(shí),應(yīng)當(dāng)向衛(wèi)生檢疫機(jī)關(guān)報(bào)告下列事項(xiàng):
Article 28 The vessel with valid sanitary certificate must make a report,
twenty-four hours prior to its arrival, to the health and quarantine organ about
the following matters:
(一)船名、國(guó)籍、預(yù)定到達(dá)檢疫錨地的日期和時(shí)間;
(1) name and nationality of the vessel, scheduled date and time of arrival at
the quarantine anchorage;
(二)發(fā)航港、最后寄港;
(2) port of departure and port of last call;
(三)船員和旅客人數(shù)及健康狀況;
(3) number of crew and passengers and their state of health;
(四)貨物種類;
(4) type of cargo;
(五)船舶衛(wèi)生證書的簽發(fā)日期和編號(hào)、除鼠證書或者免予除鼠證書的簽發(fā)日期和簽發(fā)港,以及其他衛(wèi)生證件。
(5) date of issuance and number of the vessel's sanitary certificate; date and
port of issuance of the deratization certificate or a deratization
laissez-passer, as well as other sanitary documents.
經(jīng)衛(wèi)生檢疫機(jī)關(guān)對(duì)上述報(bào)告答復(fù)同意后,即可進(jìn)港。
Upon approval of the above report, the vessel(s) may enter the port.
第二十九條 對(duì)船舶的入境檢疫,在日出后到日落前的時(shí)間內(nèi)實(shí)施;凡具備船舶夜航條件,夜間可靠離碼頭和裝卸作業(yè)的港口口岸,應(yīng)實(shí)行24
小時(shí)檢疫。對(duì)來(lái)自疫區(qū)的船舶,不實(shí)行夜間檢疫。
Article 29 Entry quarantine inspection of vessel(s) shall be conducted between
sunrise and sunset. Round-the-clock quarantine inspection shall be conducted on
vessel(s) at the port which have night navigation conditions for docking and
unloading of cargo. No night-time quarantine inspection shall be conducted on
vessel(s) from pestilence areas.
第三十條
受入境檢疫船舶的船長(zhǎng),在檢疫醫(yī)師到達(dá)船上時(shí),必須提交由船長(zhǎng)簽字或者有船醫(yī)附簽的航海健康申報(bào)書、船員名單、旅客名單、載貨申報(bào)單,并出示除鼠證書或者免予除鼠證書。
Article 30 The captain of the entry vessel is required to show the quarantine
physician on board the vessel health declaration, crew member list, passenger
manifest and cargo declaration, signed by the captain or the vessel physician,
and a deratization certificate or a deratization laissez-passer.
在查驗(yàn)中,檢疫醫(yī)師有權(quán)查閱航海日志和其他有關(guān)證件;需要進(jìn)一步了解船舶航行中衛(wèi)生情況時(shí),檢疫醫(yī)師可以向船長(zhǎng)、船醫(yī)提出詢問(wèn),船長(zhǎng)、船醫(yī)必須如實(shí)回答。用書面回答時(shí),須經(jīng)船長(zhǎng)簽字和船醫(yī)附簽。
During the inspection, the quarantine physician has the right to read the deck
logbook and other related documents; he may ask for detailed information about
the sanitary situation of the vessel during its navigation course, if he
considers it necessary and the captain or the vessel physician must give the
true facts. The answers in written form must bear the signature of the captain
and that of the vessel physician.
第三十一條
船舶實(shí)施入境查驗(yàn)完畢以后,對(duì)沒(méi)有染疫的船舶,檢疫醫(yī)師應(yīng)當(dāng)立即簽發(fā)入境檢疫證:如果該船有受衛(wèi)生處理或者限制的事項(xiàng),應(yīng)當(dāng)在入境檢疫證上簽注,并按照簽注事項(xiàng)辦理。對(duì)染疫船舶、染疫嫌疑船舶,除通知港務(wù)監(jiān)督機(jī)關(guān)外,對(duì)該船舶還應(yīng)當(dāng)發(fā)給衛(wèi)生處理通知書,該船舶上的引航員和經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可上船的人員,應(yīng)當(dāng)視同員工接受有關(guān)衛(wèi)生處理,在衛(wèi)生處理完畢以后,再發(fā)給入境檢疫證。
Article 31 After completion of entry quarantine inspection of the vessel, the
quarantine physician is required to sign and issue an Entry Quarantine Permit
without delay; if the vessel needs to go through sanitization or is subject to
certain restrictions, a footnote and signature must be made on
船舶領(lǐng)到衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的入境檢疫證后,可以降下檢疫信號(hào)。
the Permit and measures shall be taken accordingly; if the vessel is
contaminated or is suspected to be contaminated with a quarantine disease, the
harbour superintendency administration shall be informed and a sanitization
notice shall be given to the vessel. The navigation pilot and those persons
approved by the health and quarantine organ are required to undergo sanitization
together with crew members and passengers. The Entry Quarantine Permit shall be
issued to the vessel only after the necessary sanitization is completed. Having
received the Entry Quarantine Permit issued by the health and quarantine organ,
the quarantine flag and light signal(s) may be lowered.
第三十二條 船舶代理應(yīng)當(dāng)在受出境檢疫的船舶啟航以前,盡早向衛(wèi)生檢疫機(jī)關(guān)通知下列事項(xiàng):
Article 32 Before departure of an exit vessel, the shipping agent is required
to inform the health and quarantine organ at the earliest possible time of the
following matters:
(一)船名、國(guó)籍、預(yù)定開航的日期和時(shí)間;
(1) name and nationality of vessel and scheduled date and time of departure;
(二)目的港、最初寄港;
(2) destination port and primary departure port;
(三)船員名單和旅客名單;
(3) crew member list and passenger manifest;
(四)貨物種類。
(4) type of cargo.
港務(wù)監(jiān)督機(jī)關(guān)應(yīng)當(dāng)將船舶確定開航的日期和時(shí)間盡早通知衛(wèi)生檢疫機(jī)關(guān)。
The harbour superintendency administration is required to notify the health
and quarantine organ at the earliest possible time of the fixed date and time of
departure of the exit vessel(s).
船舶的入境、出境檢疫在同一港口實(shí)施時(shí),如果船員、旅客沒(méi)有變動(dòng),可以免報(bào)船員名單和旅客名單;有變動(dòng)的,報(bào)變動(dòng)船員、旅客名單。
If there is no change in crew members and passengers, the vessel receiving
entry and exit quarantine inspections at the same port may get a P.W.E. If there
is a change in crew members or passengers, revised manifest shall be required.
第三十三條
受出境檢疫的船舶,船長(zhǎng)應(yīng)當(dāng)向衛(wèi)生檢疫機(jī)關(guān)出示除鼠證書或者免于除鼠證書和其他有關(guān)檢疫證件,檢疫醫(yī)師可以向船長(zhǎng)、船醫(yī)提出有關(guān)船員、旅客健康情況和船上衛(wèi)生情況的詢問(wèn),船長(zhǎng)、船醫(yī)對(duì)上述詢問(wèn)應(yīng)當(dāng)如實(shí)回答。
Article 33 The captain of the vessel receiving exit quarantine inspection is
required to show the deratization certificate or the deratization laissez-passer
and other related quarantine documents to the health and quarantine organ. The
quarantine physician may ask the captain or the vessel physician for further
details about the state of health of the crew members and the passengers as well
as the sanitary situation on the vessel; the captain and the vessel physician
are required to give true-to-fact answers.
第三十四條 對(duì)船舶實(shí)施出境檢疫完畢以后,檢疫醫(yī)師應(yīng)當(dāng)按照檢疫結(jié)果立即簽發(fā)出境檢疫證,如果因衛(wèi)生處理不能按原定時(shí)間啟航,應(yīng)當(dāng)及時(shí)通知港務(wù)監(jiān)督機(jī)關(guān)。
Article 34 Upon completion of quarantine inspection on an exit vessel, the
quarantine physician must sign and issue an Exit Quarantine Permit without
delay. If the vessel cannot yet sail at the scheduled time due to sanitization,
the health and quarantine organ is required to notify the harbour
superintendency administration immediately.
第三十五條
對(duì)船舶實(shí)施出境檢疫完畢以后,除引航員和經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可的人員外,其他人員不準(zhǔn)上船,不準(zhǔn)裝卸行李、貨物、郵包等物品。如果違反上述規(guī)定,該船舶必須重新實(shí)施出境檢疫。
Article 35 After quarantine inspection on an exit vessel is completed, no
persons other than the navigation pilot and those approved by the health and
quarantine organ shall be allowed to go on board the vessel, no loading and
unloading of luggage, cargo or postal parcels shall be allowed. Any violation of
the rules may cause the vessel to undergo quarantine reinspection.
第五章 航空檢疫
Chapter V Airport Quarantine
第三十六條 航空器在飛行中,不得向下投擲或者任其墜下能傳播傳染病的任何物品。
Article 36 Aircraft shall be prohibited from dumping or be allowed to drop any
articles that may spread epidemic diseases while flying.
第三十七條 實(shí)施衛(wèi)生檢疫機(jī)場(chǎng)的航空站,應(yīng)當(dāng)在受入境檢疫的航空器到達(dá)以前,盡早向衛(wèi)生檢疫機(jī)關(guān)通知下列事項(xiàng):
Article 37 The aviation station that conducts health and quarantine inspection
is required to inform the health and quarantine organ at the earliest possible
time of the following matters:
(一)航空器的國(guó)籍、機(jī)型、號(hào)碼、識(shí)別標(biāo)志、預(yù)定到達(dá)時(shí)間;
(1) nationality, make, number and markings of the aircraft and its scheduled
arrival time;
(二)出發(fā)站、經(jīng)停站;
(2) departure airport, stop-over airport and destination airport;
(三)機(jī)組和旅客人數(shù);
(3) number of crew members and passengers.
第三十八條
受入境檢疫的航空器,如果在飛行中發(fā)現(xiàn)檢疫傳染病、疑似檢疫傳染病,或者有人非因意外傷害而死亡并死因不明時(shí),機(jī)長(zhǎng)應(yīng)當(dāng)立即通知到達(dá)機(jī)場(chǎng)的航空站,向衛(wèi)生檢疫機(jī)關(guān)報(bào)告下列事項(xiàng):
Article 38 In the course of flight, if any quarantinable epidemic disease, a
disease suspected to be quarantinable, or a death due to an unidentified cause
other than accidental harm is discovered, the captain of the aircraft subject to
entry quarantine inspection is required to inform the airport of the matter and
report to the health and quarantine organ about the following matters:
(一)航空器的國(guó)籍、機(jī)型、號(hào)碼、識(shí)別標(biāo)志、預(yù)定到達(dá)時(shí)間;
(1) nationality, make, number and markings of the aircraft and its scheduled
arrival time;
(二)出發(fā)站、經(jīng)停站;
(2) departure airport, stop-over airport and destination airport;
(三)機(jī)組和旅客人數(shù)。
(3) number of crew members and passengers;
(三)病名或者主要癥狀、患病人數(shù)、死亡人數(shù)。
(4) name of disease or principal symptoms, number of cases and deaths.
第三十九條
受入境檢疫的航空器到達(dá)機(jī)場(chǎng)以后,檢疫醫(yī)師首先登機(jī)。機(jī)長(zhǎng)或者其授權(quán)的代理人,必須向衛(wèi)生檢疫機(jī)關(guān)提交總申報(bào)單、旅客名單,貨物倉(cāng)單和有效的滅蚊證書,以及其他有關(guān)檢疫證件;對(duì)檢疫醫(yī)師提出的有關(guān)航空器上衛(wèi)生狀況的詢問(wèn),機(jī)長(zhǎng)或者其授權(quán)的代理人應(yīng)當(dāng)如實(shí)回答。在檢疫沒(méi)有結(jié)束之前,除經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可外,任何人不得上下航空器,不準(zhǔn)裝卸行李、貨物、郵包等物品。
Article 39 After an aircraft subject to entry quarantine inspection lands at
the airport, the quarantine physician shall get on board first. The aircraft
captain or his authorized agent is required to submit to the health and
quarantine organ the general declaration, passenger manifest, deck cargo
declaration and the valid deinsectization certificate and other related
quarantine documents; the aircraft captain or his authorized agent is required
to give true-to-fact answers to the inquiries from the quarantine physician
about the sanitary situation on the aircraft. Before completion of quarantine
inspection, no persons other than those approved by the health and quarantine
organ are allowed to get on or off the aircraft; no loading and unloading of
luggage, cargo and postal parcels shall be permitted.
第四十條 入境旅客必須在指定的地點(diǎn)接受入境查驗(yàn),同時(shí)用書面或者口頭回答檢疫醫(yī)師提出的有關(guān)詢問(wèn)。在此期間,入境旅客不得離開查驗(yàn)場(chǎng)所。
Article 40 Entry passengers are required to undergo entry quarantine
inspection at the appointed place and answer the quarantine physician's
inquiries orally or in written form. During the inspection time entry passengers
shall not be allowed to leave the inspection place.
第四十一條
對(duì)入境航空器查驗(yàn)完畢以后,根據(jù)查驗(yàn)結(jié)果,對(duì)沒(méi)有染疫的航空器,檢疫醫(yī)師應(yīng)當(dāng)簽發(fā)入境檢疫證;如果該航空器有受衛(wèi)生處理或者限制的事項(xiàng),應(yīng)當(dāng)在入境檢疫證上簽注,由機(jī)長(zhǎng)或者其授權(quán)的代理人負(fù)責(zé)執(zhí)行;對(duì)染疫或者有染疫嫌疑的航空器,除通知航空站外,對(duì)該航空器應(yīng)當(dāng)發(fā)給衛(wèi)生處理通知單,在規(guī)定的衛(wèi)生處理完畢以后,再發(fā)給入境檢疫證。
Article 41 Upon completion of entry quarantine inspection of the aircraft, the
quarantine physician must sign and issue an Entry Quarantine Permit to the
aircraft which is free from contamination. If the aircraft needs to undergo
sanitization or is subject to certain restrictions, a footnote and signature
must be made on the Permit and the aircraft captain or his authorized agent
shall be responsible for taking necessary measures accordingly; if the aircraft
is proved to be contaminated, a sanitization notice shall be given to the
aircraft and the aircraft shall be notified. After the required sanitization is
done, an Entry Quarantine Permit shall be issued to the aircraft.
第四十二條 實(shí)施衛(wèi)生檢疫機(jī)場(chǎng)的航空站,應(yīng)當(dāng)在受出境檢疫的航空器起飛以前,盡早向衛(wèi)生檢疫機(jī)關(guān)提交總申報(bào)單、貨物倉(cāng)單和其他有關(guān)檢疫證件,并通知下列事項(xiàng):
Article 42 Prior to the departure of the aircraft subject to exit quarantine
inspection, the airport is required to submit to the health and quarantine organ
the general declaration, deck cargo declaration and other documents related to
quarantine and to inform it of the following matters:
(一)航空器的國(guó)籍、機(jī)型、號(hào)碼、識(shí)別標(biāo)志、預(yù)定起飛時(shí)間;
(1) nationality, make, number and markings of the aircraft and its scheduled
time of departure;
(二)經(jīng)停站、目的站;
(2) stop-over airport(s) and destination airport;
(三)機(jī)組和旅客人數(shù)。
(3) number of crew members and passengers.
第四十三條
對(duì)出境航空器查驗(yàn)完畢以后,如果沒(méi)有染疫,檢疫醫(yī)師應(yīng)當(dāng)簽發(fā)出境檢疫證或者在必要的衛(wèi)生處理完畢以后,再發(fā)給出境檢疫證;如果該航空器因衛(wèi)生處理不能按原定時(shí)間起飛,應(yīng)當(dāng)及時(shí)通知航空站。
Article 43 Upon completion of exit quarantine inspection of the aircraft, the
quarantine physician must sign and issue an Exit Quarantine Permit to the
aircraft which is free from contamination, or, such Permit shall be issued upon
completion of the necessary sanitization; if the aircraft cannot take off at the
scheduled time due to sanitization; the health and quarantine organ must notify
the airport without delay.
第六章 陸地邊境檢疫
Chapter VI Border Quarantine
第四十四條 實(shí)施衛(wèi)生檢疫的車站,應(yīng)當(dāng)在受入境檢疫的列車到達(dá)之前,盡早向衛(wèi)生檢疫機(jī)關(guān)通知下列事項(xiàng):
Article 44 Prior to the arrival of the trains subject to entry quarantine
inspection, the railway station is required to inform the health and quarantine
organ of the following matters:
(一)列車的車次,預(yù)定到達(dá)的時(shí)間;
(1) train number and scheduled arrival time;
(二)始發(fā)站;
(2) primary departure station;
(三)列車編組情況。
(3) train marshalling.
第四十五條
受入境檢疫的列車和其他車輛到達(dá)車站、關(guān)口后,檢疫醫(yī)師首先登車,列車長(zhǎng)或者其他車輛負(fù)責(zé)人,應(yīng)當(dāng)口頭或者書面向衛(wèi)生檢疫機(jī)關(guān)申報(bào)該列車或者其他車輛上人員的健康情況,對(duì)檢疫醫(yī)師提出有關(guān)衛(wèi)生狀況和人員健康的詢問(wèn),應(yīng)當(dāng)如實(shí)回答。
Article 45 After the train or other motor vehicle subject to entry quarantine
inspection arrives at the railway station on the border, the quarantine
physician shall get on board the train first. The head of train crew or the
person in charge of the vehicle is required to submit a report either orally or
in written form to the health and quarantine organ on the state of health of the
persons on board and to give true-to-fact answers to the inquiries by the
quarantine physician concerning sanitary and health conditions on board.

受入境檢疫的列車和其他車輛到達(dá)車站、關(guān)口,在實(shí)施入境檢疫而未取得入境檢疫證以前,未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,任何人不準(zhǔn)上下列車或者其他車輛,不準(zhǔn)裝卸行李、貨物、郵包等物品。
Article 46 During quarantine inspection, without permission by the health and
quarantine organ, no persons shall be allowed to get on or off the train to
other vehicle which is subjected to entry quarantine inspection; no loading or
unloading of luggage, cargo or postal parcels shall be permitted.
第四十七條 實(shí)施衛(wèi)生檢疫的車站,應(yīng)當(dāng)在受出境檢疫列車發(fā)車以前,盡早向衛(wèi)生檢疫機(jī)關(guān)通知下列事項(xiàng):
Article 47 Prior to the departure of the train subject to exit quarantine
inspection, the railway station is required to inform the health and quarantine
organ at the earliest possible time of the following matters:
(一)列車的車次,預(yù)定發(fā)車的時(shí)間;
(1) train number and scheduled departure time;
(二)終到站;
(2) destination station;
(三)列車編組情況。
(3) train marshalling.
第四十八條
應(yīng)當(dāng)受入境、出境檢疫的列車和其他車輛,如果在行程中發(fā)現(xiàn)檢疫傳染病、疑似檢疫傳染病,或者有人非因意外傷害而死亡并死因不明的,列車或者其他車輛到達(dá)車站、關(guān)口時(shí),列車長(zhǎng)或者其他車輛負(fù)責(zé)人應(yīng)當(dāng)向衛(wèi)生檢疫機(jī)關(guān)報(bào)告。
Article 48 During its course of transportation, if a quarantinable infectious
disease, a disease suspected to be quarantinable, or death due to an
unidentified cause other than accidental harm is discovered on the train or
other vehicle subject to entry or exit quarantine inspection, the head of the
train crew or the person in charge of the vehicle is required to report to the
health and quarantine organ about the matter upon arrival at the border station.
第四十九條
受入境、出境檢疫的列車,在查驗(yàn)中發(fā)現(xiàn)檢疫傳染病或者疑似檢疫傳染病,或者因受衛(wèi)生處理不能按原定時(shí)間發(fā)車,衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)及時(shí)通知車站的站長(zhǎng);如果列車在原停車地點(diǎn)不宜實(shí)施衛(wèi)生處理,站長(zhǎng)可以選擇站內(nèi)其他地點(diǎn)實(shí)施衛(wèi)生處理。在處理完畢之前,未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,任何人不準(zhǔn)上下列車,不準(zhǔn)裝卸行李、貨物、郵包等物品。
Article 49 In cases that a quarantine infectious disease or a disease
suspected to be quarantinable is discovered on the train subject to entry or
exit quarantine inspection, or in case that the train is unable to leave at
scheduled time due to sanitization, the health and quarantine organ is required
to inform the station master of the case without delay. If the parking place is
not suitable for sanitization, the station master can decide on another place
within the station for sanitization. Before completion of sanitization, without
permission by the health and quarantine organ, no person shall be allowed to get
off or on the train, no loading or unloading of luggage, goods or postal parcels
shall be permitted.
為了保證入境直通列車的正常運(yùn)輸,衛(wèi)生檢疫機(jī)關(guān)可以派員隨車實(shí)施檢疫,列車長(zhǎng)應(yīng)當(dāng)提供方便。
In order that the entry through train can run normally, the health and
quarantine organ may have its personnel exercise quarantine inspection on board
the train in operation. The head of the train crew shall provide conveniences.
第五十條
對(duì)列車或者其他車輛實(shí)施入境、出境檢疫完畢后,檢疫醫(yī)師應(yīng)當(dāng)根據(jù)檢疫結(jié)果分別簽發(fā)入境、出境檢疫證,或者在必要的衛(wèi)生處理完畢后,再分別簽發(fā)入境、出境檢疫證。
Article 50 After completion of entry or exit quarantine inspection or
necessary sanitization to the train or other vehicle, the quarantine physician
is required to sign and issue an exit and entry quarantine certificate according
to quarantine inspection results.
第五十一條 徒步入境、出境的人員,必須首先在指定的場(chǎng)所接受入境、出境查驗(yàn),未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,不準(zhǔn)離開指定的場(chǎng)所。
Article 51 Those who enter or leave the country at the border on foot are
required to undergo entry or exit quarantine inspection at a designated place.
Without permission by the health and quarantine organ, no one may leave the
designated place.
第五十二條
受入境、出境檢疫的列車以及其他車輛,載有來(lái)自疫區(qū)、有染疫或者染疫嫌疑或者夾帶能傳播傳染病的病媒昆蟲和嚙齒動(dòng)物的貨物,應(yīng)當(dāng)接受衛(wèi)生檢查和必要的衛(wèi)生處理。
Article 52 Any train or vehicle, coming from pestilence area, or having been
contaminated or being suspected to have been contaminated with an epidemic
disease or being found to have carried goods with rodent or pests that may
spread an epidemic disease, shall be required to undergo health inspection and
necessary sanitization.
第七章 衛(wèi)生處理
Chapter VII Sanitization
第五十三條 衛(wèi)生檢疫機(jī)關(guān)的工作人員在實(shí)施衛(wèi)生處理時(shí),必須注意下列事項(xiàng):
Article 53 While performing sanitization,the health and quarantine officers
are required to see to it that:
(一)防止對(duì)任何人的健康造成危害;
(1) no one's health is endangered;
(二)防止對(duì)交通工具的結(jié)構(gòu)和設(shè)備造成損害;
(2) no damage is done to the structure of and the equipment on the vehicle;
(三)防止發(fā)生火災(zāi);
(3) no fire is caused;
(四)防止對(duì)行李、貨物造成損害。
(4) no damage is done to the luggage or goods.
第五十四條 入境、出境的集裝箱、行李、貨物、郵包等物品需要衛(wèi)生處理的,由衛(wèi)生檢疫機(jī)關(guān)實(shí)施。
Article 54 The sanitization that exit or entry containers, luggage, goods or
postal parcels are required to undergo shall be conducted by the health and
quarantine organ.
入境、出境的交通工具有下列情形之一的,應(yīng)當(dāng)由衛(wèi)生檢疫機(jī)關(guān)實(shí)施消毒、除鼠、除蟲或者其他衛(wèi)生處理。
Any conveyance waiting for entry or exit is subject to disinfectization,
deratization, deinsectization and other necessary sanitization when found to be
in any one of the following conditions:
(一)來(lái)自檢疫傳染病疫區(qū)的;
(1) having come from a pestilence area;
(二)被檢疫傳染病污染的;
(2) being contaminated by a quarantinable epidemic disease;
(三)發(fā)現(xiàn)有與人類健康有關(guān)的嚙齒動(dòng)物或者病媒昆蟲,超過(guò)國(guó)家衛(wèi)生標(biāo)準(zhǔn)的。
(3) revealing the presence of rodents which affect human health or insects
which are carriers of disease and their number exceeds the state standard.
第五十五條 由國(guó)外起運(yùn)經(jīng)中華人民共和國(guó)境內(nèi)的貨物,如果不在境內(nèi)換裝,除發(fā)生在流行病學(xué)上有重要意義的事件,需要實(shí)施衛(wèi)生處理外,在一般情況下不實(shí)施衛(wèi)生處理。
Article 55 Goods that are shipped from abroad and are only passing through the
People's Republic of China, shall, if there is no transshipment, be exempted
from sanitization except in cases where events of epidemiological significance
have taken place.
第五十六條 衛(wèi)生檢疫機(jī)關(guān)對(duì)入境、出境的廢舊物品和曾行駛于境外港口的廢舊交通工具,根據(jù)污染程度,分別實(shí)施消毒、除鼠、除蟲,對(duì)污染嚴(yán)重的實(shí)施銷毀。
Article 56 According to the extent of contamination, the health and quarantine
organ shall exercise disinfectization, deratization or insectization
respectively to the used materials waiting for entry or exit and to the used
transportation vehicles that were in operation at foreign ports. In case of
serious contamination, the used materials or vehicles shall be destroyed.
第五十七條 入境、出境的尸體,骸骨托運(yùn)人或者代理人應(yīng)當(dāng)申請(qǐng)衛(wèi)生檢疫,并出示死亡證明或者其他有關(guān)證件,對(duì)不符合衛(wèi)生要求的,必須接受衛(wèi)生檢疫機(jī)關(guān)實(shí)施的衛(wèi)生處理。
Article 57 Prior to the entry or exit of human remains or ashes, the shipper
or the agent is required to apply for health and quarantine inspection and to
present a certificate of cause of death or other related documents. If it fails
to meet the hygiene requirements, it is required to undergo sanitization by the
health and quarantine organ.
經(jīng)衛(wèi)生檢疫機(jī)關(guān)簽發(fā)尸體、骸骨入境、出境許可證后,方準(zhǔn)運(yùn)進(jìn)或者運(yùn)出。
Only with an entry or exit license issued by the health and quarantine organ
can the remains or ashes be shipped in or out.
對(duì)因患檢疫傳染病而死亡的病人尸體,必須就近火化,不準(zhǔn)移運(yùn)。
The corpse of anyone who died from a quarantinable epidemic disease must be
cremated at a nearby place.
第五十八條 衛(wèi)生檢疫機(jī)關(guān)對(duì)已在到達(dá)本口岸前的其他口岸實(shí)施衛(wèi)生處理的交通工具不再重復(fù)實(shí)施衛(wèi)生處理。但有下列情形之一的,仍需實(shí)施衛(wèi)生處理。
Article 58 In the case that a conveyance has previously undergone sanitization
at another port, it is not necessary to conduct sanitization again upon its
arrival unless any one of the following circumstances applies:
(一)在原實(shí)施衛(wèi)生處理的口岸或者該交通工具上,發(fā)生流行病學(xué)上有重要意義的事件,需要進(jìn)一步實(shí)施衛(wèi)生處理的;
(1) when events of epidemiological significance have taken place either at the
port where the conveyance underwent sanitization or on board that conveyance;
(二)在到達(dá)本口岸前的其他口岸實(shí)施的衛(wèi)生處理沒(méi)有實(shí)際效果的。
(2) when sanitization undertaken at other port proved to be practically
ineffective.
第五十九條
在國(guó)境口岸或者交通工具上發(fā)現(xiàn)嚙齒動(dòng)物有反常死亡或者死因不明的,國(guó)境口岸有關(guān)單位或者交通工具的負(fù)責(zé)人,必須立即向衛(wèi)生檢疫機(jī)關(guān)報(bào)告,迅速查明原因,實(shí)施衛(wèi)生處理。
Article 59 In the case when any rodent is found to have died of unusual or
unknown cause either at the border port or on the conveyance, the border port
authorities or the captain of the conveyance is required to the health and
quarantine organ about the case without delay so that prompt examination and
sanitization can be carried out.
第六十條
國(guó)際航行船舶的船長(zhǎng),必須每隔6個(gè)月向衛(wèi)生檢疫機(jī)關(guān)申請(qǐng)一次鼠患檢查,衛(wèi)生檢疫機(jī)關(guān)根據(jù)檢查結(jié)果實(shí)施除鼠或者免予除鼠,并且分別發(fā)給除鼠證書或者免予除鼠證書。該證書自簽發(fā)之日起6個(gè)月內(nèi)有效。
Article 60 The captain of a ship of international voyage is required to apply
to the health and quarantine organ for inspection of rat damage every 6 months.
The health and quarantine organ shall exercise deratization or dispense with
deratization according to the result of the inspection and issue a certificate
of deratization or a deratization laissez-passer which shall be valid for 6
months from the day it is issued.
第六十一條 衛(wèi)生檢疫機(jī)關(guān)只有在下列之一情況下,經(jīng)檢查確認(rèn)船舶無(wú)鼠害的,方可簽發(fā)免于除鼠證書:
Article 61 Only under any one of the following circumstances shall the health
and quarantine organ issue a certificate of exemption of deratization after
making sure that the vessel is free of rodents:
(一)空艙;
(1) when the hold is bare;
(二)艙內(nèi)雖然裝有壓艙物品或者其他物品,但是這些物品不引誘鼠類,放置情況又不妨礙實(shí)施鼠患檢查。
(2) when there is ballast or other goods in the hold, but these goods do not
lure the mice and the layout of the goods does not hinder the inspection.
對(duì)油輪在實(shí)艙時(shí)進(jìn)行檢查,可以簽發(fā)免予除鼠證書。
When an oil tanker is in full load, a certificate of exemption of deratization
may be issued.
第六十二條
對(duì)船舶的鼠患檢查或者除鼠,應(yīng)當(dāng)盡量在船舶空艙的時(shí)候進(jìn)行。如果船舶因故不宜按期進(jìn)行鼠患檢查或者蒸熏除鼠,并且該船又開往便于實(shí)施鼠患檢查或者蒸熏除鼠的港口,可以準(zhǔn)許該船原有的除鼠證書或者免予除鼠證書的有效期延長(zhǎng)1個(gè)月,并簽發(fā)延長(zhǎng)證明。
Article 62 Normally the inspection of rat-damage or deratization shall be
carried out while the hold is bare. If the vessel can not undergo rat-damage
inspection or deratization by means of steam sterilization in due time owing to
some reason or other, and it is sailing towards a port convenient for inspection
or deratization, he term of validity of deratization certificate or the
deratization laissez-passers the vessel is holding may be extended for one
month, and the extended certificate may be issued.
第六十三條
對(duì)國(guó)際航行的船舶,按照國(guó)家規(guī)定的標(biāo)準(zhǔn),應(yīng)當(dāng)用蒸熏的方法除鼠時(shí),如果該船的除鼠證書或者免予除鼠證書尚未失效,除該船染有鼠疫或者鼠疫嫌疑外,衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)將除鼠理由通知船長(zhǎng)。船長(zhǎng)應(yīng)當(dāng)按照要求執(zhí)行。
Article 63 In the situation when the deratization certificate or the
deratization laissez-passer of a vessel is still valid, but the vessel is found
to have caught the plague or is suspected to have caught the plague, the health
and quarantine organ must inform the captain that his vessel is required to
undergo deratization by means of steam sterilization in accordance with the
standard set by the state, and the captain must act as required.
第六十四條 船舶在港口??科陂g,船長(zhǎng)應(yīng)當(dāng)負(fù)責(zé)采取下列的措施:
Article 64 While anchoring at the port, the captain is required to take
effective measures as follows:
(一)纜繩上必須使用有效的防鼠板,或者其他防鼠裝置;
(1) the mooring rope must have effective rat guard or the like;
(二)夜間放置扶梯、橋板時(shí),應(yīng)當(dāng)用強(qiáng)光照射;
(2) at night the accommodation ladder and the gang board must be illuminated
by strong searchlight;
(三)在船上發(fā)現(xiàn)死鼠或者捕獲到鼠類時(shí),應(yīng)當(dāng)向衛(wèi)生檢疫機(jī)關(guān)報(bào)告。
(3) when any dead rat is found or any rat is trapped, it is required to report
to the health and quarantine organ.
第六十五條 在國(guó)境口岸停留的國(guó)內(nèi)航行的船舶如果存在鼠患,船方應(yīng)當(dāng)進(jìn)行除鼠。根據(jù)船方申請(qǐng),也可由衛(wèi)生檢疫機(jī)關(guān)實(shí)施除鼠。
Article 65 At the border port, if rodents are found on any home vessel of
domestic voyage, the vessel must undertake deratization by itself. Upon
application, the health quarantine organ may exercise deratization.
第六十六條 國(guó)務(wù)院衛(wèi)生行政部門認(rèn)為必要時(shí),可以要求來(lái)自國(guó)外或者國(guó)外某些地區(qū)的人員負(fù)在入境時(shí),向衛(wèi)生檢疫機(jī)關(guān)出示有效的某種預(yù)防接種證書或者健康證明。
Article 66 When necessary, the health administrative department under the
State Council shall order the health and quarantine organs to check the valid
certificate of certain preventive inoculation or health certificate of the
persons upon their arrival at the entry port from abroad or from certain
regions.
第六十七條 預(yù)防接種的有效期如下:
Article 67 Term of validity of preventive inoculation are as follows:
(一)黃熱病疫苗自接種后第10日起,10年內(nèi)有效。如果前次接種不滿 10年又經(jīng)復(fù)種,自受種的七日起,10年內(nèi)有效;
(1) For yellow fever vaccine, it is valid for10 years from the day of
inoculation. If the second inoculation follows the previous one is less than 10
years, it is valid for 10 years from the day of reinoculation.
(二)其他預(yù)防接種的有效期,按照有關(guān)規(guī)定執(zhí)行。
(2) As for other kinds of inoculation, their term of validity shall be stated
in related regulations.
第八章 檢疫傳染病管理
Chapter VIII Control of Quarantinable Epidemic Disease
第一節(jié) 鼠 疫
Section I The Plague
第六十八條 鼠疫的潛伏期為6日。
Article 68 Incubation period of the plague is 6 days.
第六十九條 船舶、航空器在到達(dá)時(shí),有下列情形之一的,為染有鼠疫:
Article 69 Under any one of the following circumstances, a vessel or an
aircraft, upon its arrival, shall be considered as having been contaminated with
the plague:
(一)船舶、航空器上有鼠疫病例的;
(1) any plague case is found on the vessel or aircraft;
(二)船舶、航空器上發(fā)現(xiàn)有感染鼠疫的嚙齒動(dòng)物的;
(2) any rodent is found to have caught the plague on the vessel or aircraft;
(三)船舶上曾經(jīng)有人在上船6日以后患鼠疫的。
(3) any person is found to have caught the plague 6 days after he/she boarded
the vessel.
第七十條 船舶在到達(dá)時(shí),有下列情形之一的,為染有鼠疫嫌疑:
Article 70 Under any one of the following circumstances, the vessel shall e
considered as being suspected to have caught the plague:
(一)航舶上沒(méi)有鼠疫病例,但曾經(jīng)有人在上船后6日以內(nèi)患鼠疫的;
(1) there is no plague case but there were persons who caught the plague 6
days after they had boarded the vessel;
(二)船上嚙齒動(dòng)物有反常死亡,并且死因不明的。
(2) unusual death of rodent is found on the vessel and its cause of death is
unknown.
第七十一條 對(duì)染有鼠疫的船舶、航空器應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理:
Article 71 A vessel or an aircraft contaminated with the plague shall undergo
sanitization as follows:
(一)對(duì)染疫人實(shí)施隔離;
(1) the person(s) who has contracted the plague shall be placed in isolation;
(二)對(duì)染疫嫌疑人實(shí)施除蟲,并且從到達(dá)時(shí)算起,實(shí)施不超過(guò)6日的就地診驗(yàn)或者留驗(yàn)。在此期問(wèn),船上的船員除因工作需要并且經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可外,不準(zhǔn)上岸;
(2) the plague suspect(s) shall undergo deinsectization and shall have on site
clinical check-up or check-up detention for less than 6 days. During this
period, no crew member shall be allowed to go on shore except those whose work
requires them to do so and who are permitted by the health and quarantine organ;
(三)對(duì)染疫人、染疫嫌疑人的行李、使用過(guò)的其他物品和衛(wèi)生檢疫機(jī)關(guān)認(rèn)為有污染嫌疑的物品,實(shí)施除蟲,必要時(shí)實(shí)施消毒;
(3) the luggage and belongings of a plague victim or plague suspect and other
Articles that the health and quarantine organ considers as having been
contaminated shall undergo deinsectization or disinfection if necessary;
(四)對(duì)染疫人占用過(guò)的部位和衛(wèi)生檢疫機(jī)關(guān)認(rèn)為有污染嫌疑的部位,實(shí)施除蟲,必要時(shí)實(shí)施消毒;
(4) the places that have been occupied by the plague victim, or that are
suspected of having been contaminated with the plague, shall undergo
deinsectization or disinfection if necessary;
(五)船舶、航空器上有感染鼠疫的嚙齒動(dòng)物,衛(wèi)生檢疫機(jī)關(guān)必須實(shí)施除鼠。如果船舶上發(fā)現(xiàn)只有未感染鼠疫的嚙齒動(dòng)物,衛(wèi)生檢疫機(jī)關(guān)也可以實(shí)施除鼠。實(shí)施除鼠可以在隔離的情況下進(jìn)行。對(duì)船舶的除鼠應(yīng)當(dāng)在卸貨以前進(jìn)行;
(5) if any rodent on a vessel or on an aircraft is found to have caught the
plague, the health and quarantine organ shall exercise deratization. If rodent
is found to have not been contaminated with the plague, the health and
quarantine organ may also exercise deratization. Deratization shall be conducted
when the vessel is isolated and before unloading of cargo;
(六)卸貨應(yīng)當(dāng)在衛(wèi)生檢疫機(jī)關(guān)的監(jiān)督下進(jìn)行,并且防止卸貨的工作人員遭受感染。必要時(shí),對(duì)卸貨的工作人員從卸貨完畢時(shí)算起,實(shí)施不超過(guò) 6日的就地診驗(yàn)或者留驗(yàn)。
(6) the health and quarantine organ shall supervise the unloading of cargo and
see to it that the workers shall not be contaminated. If necessary, these
workers shall have on-site clinical check-up or check-up detention for less than
6 days after completion of the unloading.
第七十二條 對(duì)染有鼠疫嫌疑的船帕,應(yīng)當(dāng)實(shí)施本細(xì)則第七十一條第 (二)至第(六)項(xiàng)規(guī)定的衛(wèi)生處理。
Article 72 The vessel that is suspected of having caught the plague shall
undergo sanitization as stipulated in Items 2 to 6 of Article 71 of these
Implementation Rules.
第七十三條 對(duì)沒(méi)有染疫的船舶、航空器,如果來(lái)自鼠疫疫區(qū),衛(wèi)生檢疫機(jī)關(guān)認(rèn)為必要時(shí),可以實(shí)施下列衛(wèi)生處理:
Article 73 The health and quarantine organ may, when it deems necessary, take
the following sanitization measures to the vessel or aircraft coming from the
plague prevalent area but free from contamination:
(一)對(duì)離船、離航空器的染疫嫌疑人,從船舶、航空器離開疫區(qū)的時(shí)候算起,實(shí)施不超過(guò)6日的就地診驗(yàn)或者留驗(yàn);
(1) the plague suspect(s) shall be required to have on-site clinical check-up
or check-up detention for a period of less than 6 days from the day the vessel
or aircraft left the pestilence area;
(二)在特殊情況下,對(duì)船舶、航空器實(shí)施除鼠。
(2) under special circumstances, the vessel or aircraft must undergo
deratization.
第七十四條 對(duì)到達(dá)的時(shí)候載有鼠疫病例的列車和其他車輛,應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理:
Article 74 Upon arrival, a train or other motor vehicle on which any plague
case is found shall undergo sanitization as follows:
(一)本細(xì)則第六十一條第(一)、第(三)、第(四)、第(六)項(xiàng)規(guī)定的衛(wèi)生處理;
(1) to undergo sanitization as stipulated in Items 1, 3, 4 and 6 of Article 71
of these Implementation Rules;
(二)對(duì)染疫嫌疑人實(shí)施除蟲,并且從到達(dá)時(shí)算起,實(shí)施不超過(guò)6日的就地診驗(yàn)或者留驗(yàn);
(2) plague suspect(s) shall undergo disinsectization and have on-site clinical
check-up or check-up detention for a period of less than 6 days from the date of
arrival;
(三)必要時(shí),對(duì)列車和其他車輛實(shí)施除鼠。
(3) when necessary, the train or other motor vehicle shall undergo
deratization.
第二節(jié) 霍 亂
Section II Cholera
第七十五條 霍亂潛伏期為5日。
Article 75 Incubation period of cholera is 5 days.
第七十六條
船舶在到達(dá)的時(shí)候載有霍亂病例,或者在到達(dá)前5日以內(nèi),船上曾經(jīng)有霍亂病例發(fā)生,為染有霍亂。船舶在航行中曾經(jīng)有霍亂病例發(fā)生,但是在到達(dá)前5日以內(nèi),沒(méi)有發(fā)生新病例,為染有霍亂嫌疑。
Article 76 A vessel shall be considered as having been contaminated with
cholera when any cholera case is found on board upon its arrival or there were
cholera cases on board within 5 days before its arrival. The vessel shall be
suspected of having been contaminated with cholera if there were cholera
第七十七條 航空器在到達(dá)的時(shí)候載有霍亂病例,為染有霍亂。
cases during its voyage but there have been no additional cases within 5 days
before its arrival.
航空器在航行中曾經(jīng)有霍亂病例發(fā)生,但在到達(dá)以前該病員已經(jīng)離去,為染有霍亂嫌疑。
Article 77 The aircraft shall be considered as having been contaminated with
cholera if there is any cholera case on board. The aircraft shall be suspected
of having been contaminated with cholera if there were cholera cases on board
during the flight but the cases have left the aircraft before arrival.
第七十八條 對(duì)染有霍亂的船舶、航空器,應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理:
Article 78 The vessel or aircraft contaminated with cholera is required to
undergo sanitization as follows:
(一)對(duì)染疫人實(shí)施隔離;
(1) the person(s) contaminated with cholera shall be placed in isolation;
(二)對(duì)離船、離航空器的員工、旅客,從衛(wèi)生處理完畢時(shí)算起,實(shí)施不超過(guò)5日的就地診驗(yàn)或者留驗(yàn);從船舶到達(dá)時(shí)算起5日內(nèi),船上的船員除因工作需要,并且經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可外,不準(zhǔn)上岸;
(2) crew members and passengers leaving the vessel or aircraft are required to
have on-site clinical check-up or check-up detention for a period of less than 5
days counting from the day the vessel or aircraft underwent sanitization. No
crew member is allowed to go on shore within 5 days after its arrival with the
exception of those whose work requires them to do so and who are permitted by
the health quarantine organ;
(三)對(duì)染疫人、染疫嫌疑人的行李,使用過(guò)的其他物品和有污染嫌疑的物品、食品實(shí)施消毒;
(3) the luggage and belongings of the cholera cases or of the suspects and
other articles or food that are suspected of having been contaminated shall be
disinfected;
(四)對(duì)染疫人占用的部位、污染嫌疑部位,實(shí)施消毒;
(4) the places that have been occupied by the cholera cases and the places
that are suspected of having been contaminated with cholera shall undergo
disinfections;
(五)對(duì)污染或者有污染嫌疑的飲用水,應(yīng)當(dāng)實(shí)施消毒后排放,并在儲(chǔ)水容器消毒后再換清潔飲用水;
(5) the drinking water that has been contaminated or is suspected of having
been contaminated with cholera shall be disinfected before being drained off and
the fresh water tank shall be disinfected before being refilled with clean
water;
(六)人的排泄物、垃圾、廢水、廢物和裝自霍亂疫區(qū)的壓艙水,未經(jīng)消毒,不準(zhǔn)排放和移下;
(6) human discharges, rubbish, used water, spent material, and the ballast
water filled in the cholera prevalent area are not allowed to be discharged or
unloaded without disinfections;
(七)卸貨必須在衛(wèi)生檢疫機(jī)關(guān)監(jiān)督下進(jìn)行,并且防止工作人員遭受感染,必要時(shí),對(duì)卸貨工作人員從卸貨完畢時(shí)算起,實(shí)施不超過(guò)5日的就地診驗(yàn)或者留驗(yàn)。
(7) the health and quarantine organ shall supervise the unloading of goods and
see to it that the workers shall not be contaminated. When necessary, these
workers shall have on-site clinical check-up or check-up detention for a period
of less than 5 days after completion of the unloading.
第七十九條 對(duì)染有霍亂嫌疑的船舶、航空器應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理。
Article 79 The vessel or aircraft that is suspected of having been
contaminated with cholera is required to undergo sanitization as follows:
(一)本細(xì)則第七十八條第(二)至第(七)項(xiàng)規(guī)定的衛(wèi)生處理;
(1) it is required to undergo sanitization as stipulated in Items 2 to 7 of
Article 78 of these Implementation Rules;
(二)對(duì)離船、離航空器的員工、旅客從到達(dá)時(shí)算起,實(shí)施不超過(guò)5日的就地診驗(yàn)或者留驗(yàn)。在此期間,船上的船員除因工作需要,并經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可外,不準(zhǔn)離開口岸區(qū)域;或者對(duì)離船、離航空器的員工、旅客,從離開疫區(qū)時(shí)算起,實(shí)施不超過(guò)5月的就地鱗驗(yàn)或者留驗(yàn)。
(2) crew members and passengers leaving the vessel or aircraft shall either
have on-site clinical check-up or check-up detention for a period of less than 5
days counting from the day of its arrival, or they may have on-site clinical
check-up or check-up detention for a period of less than 5 days counting from
the day they left the cholera prevalent area. During this period, no crew member
is allowed to leave the port zone with the exception of those whose work
requires them to do so and who are permitted by the health and quarantine organ.
第八十條 對(duì)沒(méi)有染疫的船舶、航空器,如果來(lái)自霍亂疫區(qū),衛(wèi)生檢疫機(jī)關(guān)認(rèn)為必要時(shí),可以實(shí)施下列衛(wèi)生處理:
Article 80 The vessel or aircraft coming from a cholera prevalent but free
from contamination may undergo sanitization as follows if the health and
quarantine organ thinks it necessary:
(一)本細(xì)則第七十八條第(五),第(六)項(xiàng)規(guī)定的衛(wèi)生處理;
(1) to undergo sanitization as stipulated in Items 5 and 6 of Article 78 of
these Implementation Rules;
(二)對(duì)離船、離航空器的員工、旅客,從離開疫區(qū)時(shí)算起,實(shí)施不超過(guò)5日的就地診驗(yàn)或者留驗(yàn)。
(2) the crew members and passengers leaving the vessel or aircraft are
required to have on-site clinical check-up or check-up detention for a period of
less than 5 days beginning from the day they left the cholera prevalent area.
第八十一條 對(duì)到達(dá)時(shí)載有霍亂病例的列車和其他車輛應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理:
Article 81 Upon arrival, the train or other vehicle on which any cholera case
is found is required to undergo sanitization as follows:
(一)按本細(xì)則第七十八條第(一)、第(二)、第(四)、第(五)、第(七) 項(xiàng)規(guī)定的衛(wèi)生處理;
(1) to undergo sanitization as stipulated in Items 1, 3, 4, 5, 7 of Article 78
of these Implementation Rules;
(二)對(duì)染疫嫌疑人從到達(dá)時(shí)算起,實(shí)施不超過(guò)3日的就地診驗(yàn)或者留驗(yàn)。
(2) the cholera suspect(s) shall undergo on-site clinical check-up or check-up
detention for a period of less than 5 days starting from the day of arrival.
第八十二條
對(duì)來(lái)自霍亂疫區(qū)的或者染有霍亂嫌疑的交通工具,衛(wèi)生檢疫機(jī)關(guān)認(rèn)為必要時(shí),可以實(shí)施除蟲、消毒;如果交通工具載有水產(chǎn)品、水果、蔬菜、飲料及其他食品,除裝在密封容器內(nèi)沒(méi)有被污染外,未經(jīng)衛(wèi)生檢疫機(jī)關(guān)許可,不準(zhǔn)卸下,必要時(shí)可以實(shí)施衛(wèi)生處理。
Article 82 The conveyance coming from a cholera prevalent area or suspected of
having been contaminated with cholera shall undergo disinsectization and
disinfection if the health and quarantine organ thinks it necessary. If the
conveyance carries aquatic products, fruit, vegetables, drinks or other food, no
unloading shall be allowed without the permission by the health and quarantine
organ. When necessary, they have to undergo sanitization, with the exception of
those food canned in air-tight containers and free from contamination.
第八十三條 對(duì)來(lái)自霍亂疫區(qū)的水產(chǎn)品、水果、蔬菜、飲料以及裝有這些制品的郵包,衛(wèi)生檢疫機(jī)關(guān)在查驗(yàn)時(shí),為了判明是否被污染,可以抽樣檢驗(yàn),必要時(shí)可以實(shí)施衛(wèi)生處理。
Article 83 During inspection on the aquatic products, fruit, vegetable, drinks
or postal parcels containing such food shipped from a cholera prevalent area,
the health and quarantine organ shall exercise sample examination in order to
determine whether the food has been contaminated, when necessary, sanitization
of the food shall be conducted.
第三節(jié) 黃 熱 病
Section III Yellow Fever
第八十四條 黃熱病的潛伏期為6日。
Article 84 Incubation period of yellow fever is 6 days.
第八十五條 來(lái)自黃熱病疫區(qū)的人員,在入境時(shí),必須向衛(wèi)生檢疫機(jī)關(guān)出示有效的黃熱病預(yù)防接種證書。
Article 85 People coming from a yellow fever prevalent area are required to
present valid certificate of inoculation against yellow fever to the health and
quarantine organ upon entry.
對(duì)無(wú)有效的黃熱病預(yù)防接種證書的人員,衛(wèi)生檢疫機(jī)關(guān)可以從該人員離開感染環(huán)境的時(shí)候算起,實(shí)施6日的留驗(yàn),或者實(shí)施預(yù)防接種并留驗(yàn)到黃熱病預(yù)防接種證書生效時(shí)為止。
For those without valid certificate of inoculation, the health and quarantine
organ may exercise check-up detention for a period of 6 days counting from the
day they left the contaminated place or they may have on-site inoculation
against yellow fever and stay until the certificate comes into effect.
第八十六條 航空器到達(dá)時(shí)載有黃熱病病例,為染有黃熱病。
Article 86 An aircraft shall be considered as having been contaminated with
yellow fever when yellow fever cases are found on board upon its arrival.
第八十七條
來(lái)自黃熱病疫區(qū)的航空器,應(yīng)當(dāng)出示在疫區(qū)起飛前的滅蚊證書;如果在到達(dá)時(shí)不出示滅蚊證書,或者衛(wèi)生檢疫機(jī)關(guān)認(rèn)為出示的滅蚊證書不符合要求,并且在航空器上發(fā)現(xiàn)活蚊,為染有黃熱病嫌疑。
Article 87 An aircraft coming from a yellow fever prevalent area is required
to present disinsectization certificate issued before the flight. If it fails to
present the disinfectization certificate, or the health and quarantine organ
considers that the certificate is not up to the requirements and live mosquitoes
are found inside the aircraft, then the aircraft shall be suspected of having
been contaminated with yellow fever.
第八十八條 船舶在到達(dá)時(shí)載有黃熱病病例,或者在航行中曾經(jīng)有黃熱病病例發(fā)生,為染有黃熱病。
Article 88 A vessel shall be considered as having been contaminated with
yellow fever when yellow fever cases are found on board upon arrival or there
were yellow fever cases on board during the voyage.
船舶在到達(dá)時(shí),如果離開黃熱病疫區(qū)沒(méi)有滿6日,或者沒(méi)有滿30日并且在船上發(fā)現(xiàn)埃及伊蚊或者其他黃熱病媒介,為染有黃熱病嫌疑。
The vessel shall be suspected of having been contaminated with yellow fever if
it left the yellow fever prevalent area less than 6 days ago, or less than 30
days whole aedes aegypti or other causitive mosquitoes are found on board.
第八十九條 對(duì)染有黃熱病的船舶、航空器,應(yīng)當(dāng)實(shí)施下列衛(wèi)生處理:
Article 89 A vessel or an aircraft contaminated with yellow fever is required
to undergo sanitization as follows:
(一)對(duì)染疫人實(shí)施隔離;
(1) the person(s) contaminated with yellow fever shall be placed in isolation;
(二)對(duì)離船、離航空器又無(wú)有效的黃熱病預(yù)防接種證書的員工、旅客,實(shí)施本細(xì)則第八十五條規(guī)定的衛(wèi)生處理;
(2) crew members and passengers leaving the vessel or the aircraft without a
valid certificate of inoculation against yellow fever are required to undergo
sanitization as stipulated in Article 85 of these Implementation Rules;
(三)徹底殺滅船舶、航空器上的埃及伊蚊及其蟲卵、幼蟲和其他黃熱病媒介,并且在沒(méi)有完成滅蚊以前限制該船與陸地和其他船舶的距離不少于400米;
(3) aedes aegypti, its eggs and larvae as well as other causitive mosquitoes
must be eliminated completely and, before completion of disinsectization, the
vessel is required to keep away from the shore or other vessels at a distance of
at least 400 meters;
(四)卸貨應(yīng)當(dāng)在滅蚊以后進(jìn)行,如果在滅蚊以前卸貨,應(yīng)當(dāng)在衛(wèi)生檢疫機(jī)關(guān)監(jiān)督下進(jìn)行,并已采取預(yù)防措施,使卸貨的工作人員免受感染。必要時(shí),對(duì)卸貨的工作人員,從卸貨完畢時(shí)算起,實(shí)施6日的就地診驗(yàn)或者留驗(yàn)。
(4) unloading work must be carried out after disinsectization. If it must be
done before disinsectization, the health and quarantine organ is required to
supervise the work and see to it that no worker shall be contaminated. If
necessary, the workers shall have on-site clinical check-up or check-up
detention for a period of 6 days counting from the day the unloading work is
finished
第九十條 對(duì)染有黃熱病嫌疑的船舶、航空器,應(yīng)當(dāng)實(shí)施本細(xì)則第八十九條第(二)至第(四)項(xiàng)規(guī)定的衛(wèi)生處理。
Article 90 The vessels or aircraft suspected of having been contaminated with
yellow fever are required to undergo sanitization as stipulated in Items 2, 3
and 4 of Article 89 of these Implementation Rules.
第九十一條 對(duì)沒(méi)有染疫的船舶、航空器,如果來(lái)自黃熱病疫區(qū),衛(wèi)生檢疫機(jī)關(guān)認(rèn)為必要時(shí),可以實(shí)施本細(xì)則第八十九條第(三)項(xiàng)規(guī)定的衛(wèi)生處理。
Article 91 The vessel or aircraft coming from a yellow fever prevalent area
but free from contamination may undergo sanitization as stipulated in Item 3 of
Article 89 of these Implementation Rules if the health and quarantine organ
considers it necessary.
第九十二條
對(duì)到達(dá)的時(shí)候載有黃熱病病例的列車和其他車輛,或者來(lái)自黃熱病疫區(qū)的列車和其他車輛,應(yīng)當(dāng)實(shí)施本細(xì)則第八十九條第(一)、第(四)項(xiàng)規(guī)定的衛(wèi)生處理;對(duì)列車、車輛徹底殺滅成蚊及其蟲卵、幼蟲;對(duì)無(wú)有效黃熱病預(yù)防接種證書的員工、旅客,應(yīng)當(dāng)實(shí)施本細(xì)則第八十五條規(guī)定的衛(wèi)生處理。
Article 92 A train or other vehicle on which yellow fever cases are found on
board upon arrival, or a train or other vehicle coming from the yellow fever
prevalent area must undergo sanitization as stipulated in Items 1 and 4 of
Article 89 of these Implementation Rules; adult mosquitoes, their eggs and
larvae on board must be annihilated; the crew members and passengers without
valid certificate of inoculation against yellow fever are required to undergo
sanitization as stipulated in Article 85 of these Implementation Rules.
第四節(jié) 就地診驗(yàn)、留驗(yàn)和隔離
Section IV On-Site Clinical Check-up, Check-Up Detention and Isolation
第九十三條 衛(wèi)生檢疫機(jī)關(guān)對(duì)受就地診驗(yàn)的人員,應(yīng)當(dāng)發(fā)給就地診驗(yàn)記錄簿,必要的時(shí)候,可以在該人員出具履行就地診驗(yàn)的保證書以后,再發(fā)給其就地診驗(yàn)記錄簿。
Article 93 The health and quarantine organ is required to issue a casebook to
the person taking on-site clinical check-up. If necessary, the casebook shall be
issued to the person after he/she has presented a guarantee for such check-up.
受就地診驗(yàn)的人員應(yīng)當(dāng)攜帶就地診驗(yàn)記錄簿,按照衛(wèi)生檢疫機(jī)關(guān)指定的期間、地點(diǎn),接受醫(yī)學(xué)檢查:如果就地診驗(yàn)的結(jié)果沒(méi)有染疫,就地診驗(yàn)期滿的時(shí)候,受就地診驗(yàn)的人員應(yīng)當(dāng)將就地診驗(yàn)記錄簿退還衛(wèi)生檢疫機(jī)關(guān)。
The person subject to on-site clinical check-up must take the casebook along
to have his medical examination at the designated place and during a specific
period of time. If the check-up proved that he is free from contamination, he
can return the casebook to the health and quarantine organ when the detention
period for clinical check-up is over.
第九十四條 衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)將受就地診驗(yàn)人員的情況,用最快的方法通知受就地診驗(yàn)人員的旅行停留地的衛(wèi)生檢疫機(jī)關(guān)或者其他醫(yī)療衛(wèi)生單位。
Article 94 The health and quarantine organ must inform by the quickest means
the health and quarantine organ or the medical and health unit in places where
the person subject to on-site clinical check-up will stop over on his journey of
his condition.
衛(wèi)生檢疫機(jī)關(guān),醫(yī)療衛(wèi)生單位遇有受就地診驗(yàn)的人員請(qǐng)求醫(yī)學(xué)檢查時(shí),應(yīng)當(dāng)視同急診給予醫(yī)學(xué)檢查,并將檢查結(jié)果在就地診驗(yàn)記錄簿上簽注;
If the person subject to on-site clinical check-up asks for medical
examination, the health and quarantine organ and the medical and health unit
must take him as an emergency case and give him a medical examination.The result
of which shall be recorded in his casebook.
如果發(fā)現(xiàn)其患檢疫傳染病或者監(jiān)測(cè)傳染病、疑似檢疫傳染病或者疑似監(jiān)測(cè)傳染病時(shí),應(yīng)當(dāng)立即采取必要的衛(wèi)生措施,將其就地診驗(yàn)記錄簿收回存查,并且報(bào)告當(dāng)?shù)匦l(wèi)生防疫機(jī)構(gòu)和簽發(fā)就地診驗(yàn)記錄簿的衛(wèi)生檢疫機(jī)關(guān)。
If he is found to have been contaminated with a quarantinable epidemic
disease, or a monitored infectious disease, or if he is suspected of having been
contaminated with a quarantinable epidemic disease or a monitored infectious
disease, he is then required to undergo necessary sanitization and his casebook
shall be taken back to keep on file for reference. At the same time his case
shall be reported to the local health and disease prevention organ as well as
the health and quarantine organ that has issued the casebook of on-site clinical
check-up.
第九十五條 受留驗(yàn)的人員必須在衛(wèi)生檢疫機(jī)關(guān)指定的場(chǎng)所接受留驗(yàn);但是有下列情形之一的,經(jīng)衛(wèi)生檢疫機(jī)關(guān)同意,可以在船上留驗(yàn)。
Article 95 The person subject to on-site clinical check-up detention is
required to have medical examination at the designated place. In any on of the
following circumstances, the detention for medical check-up may be carried out
on the vessel, with permission by the health and quarantine organ:
(一)船長(zhǎng)請(qǐng)求船員在船上留驗(yàn)的;
(1) at the request of the captain, the crew members may have the detention
check-up on the vessel;
(二)旅客請(qǐng)求在船上留驗(yàn),經(jīng)船長(zhǎng)同意,并且船上有船醫(yī)和醫(yī)療、消毒設(shè)備的。
(2) the passengers ask to have their detention check-up carried out on the
vessel, with approval by the captain, and have available on board vessel
physicians as well as facilities for medical treatment and disinfection.
第九十六條
受留驗(yàn)的人員在留驗(yàn)期間如果出現(xiàn)檢疫傳染病的癥狀,衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)立即對(duì)該人員實(shí)施隔離。對(duì)與其接觸的其他受留驗(yàn)的人員,應(yīng)當(dāng)實(shí)施必要的衛(wèi)生處理,并且從衛(wèi)生處理完畢時(shí)算起,重新計(jì)算留驗(yàn)時(shí)間。
Article 96 During his period of detention check-up,if the person has shown
symptoms of a quarantinable epidemic disease, he must be isolated by the health
and quarantine organ without delay.The other people subject to check-up
detention with him are required to undergo necessary sanitization and the term
of detention shall be counted from the time the sanitization is carried out.
第九章 傳染病監(jiān)測(cè)
Chapter IX Monitoring of Epidemic Disease
第九十七條 入境、出境的交通工具、人員、食品、飲用水和其他物品以及病媒昆蟲、動(dòng)物,均為傳染病監(jiān)測(cè)的對(duì)象。
Article 97 Entry or exit conveyances, people, food, drinking water and other
articles as well as causitive pests, animals are all subject to epidemic
disease(s)monitoring.
第九十八條 傳染病監(jiān)測(cè)內(nèi)容是:
Article 98 Epidemic disease monitoring shall cover:
(一)首發(fā)病例的個(gè)案調(diào)查;
(1) investigation on first individual cases;
(二)暴發(fā)流行的流行病學(xué)調(diào)查;
(2) epidemiological investigation of the occurrence and prevalence of an
epidemic disease;
(三)傳染源調(diào)查;
(3) investigation of the infectious agent;
(四)國(guó)境口岸內(nèi)監(jiān)測(cè)傳染病的回顧性調(diào)查;
(4) retrospective investigation of epidemic disease monitoring on the border
ports;
(五)病原體的分離、鑒定,人群、有關(guān)動(dòng)物血清學(xué)調(diào)查以及流行病學(xué)調(diào)查;
(5) investigation into the separation and identification of the causitive
agent, serological investigation in people and animals involved and
epidemiological investigation;
(六)有關(guān)動(dòng)物、病媒昆蟲、食品、飲用水和環(huán)境因素的調(diào)查;
(6) investigation into the animal involved, causitive pests, food, drinking
water and environmental factors;
(七)消毒、除鼠、除蟲的效果觀察與評(píng)價(jià);
(7) observation and assessment of the result in disinfection, deratization and
disinsectization;
(八)國(guó)境口岸以及國(guó)內(nèi)外監(jiān)測(cè)傳染病疫情的收集、整理、分析和傳遞;
(8) collecting, processing, analyzing and disseminating information about
epidemic disease monitoring at the border port, at home and abroad;
(九)對(duì)監(jiān)測(cè)對(duì)象開展健康檢查和對(duì)監(jiān)測(cè)傳染病病人、疑似病人、密切接觸人員的管理。
(9) undertaking physical check-up on persons subject to epidemic disease
monitoring and exercising administration over victims of epidemic diseases under
monitoring, suspects of such diseases, and people who have close contact with
the victims.
第九十九條 衛(wèi)生檢疫機(jī)關(guān)應(yīng)當(dāng)阻止所發(fā)現(xiàn)的患有艾滋病、性病、麻風(fēng)病、精神病、開放性肺結(jié)核的外國(guó)人入境。
Article 99 The health and quarantine organ should bar foreigners who are
victims of AIDS, venereal disease, leprosy, psychosis, open tuberculosis from
entry.
第一百條 受入境、出境檢疫的人員,必須根據(jù)檢疫醫(yī)師的要求,如實(shí)填報(bào)健康申明卡,出示某種有效的傳染病預(yù)防接種證書、健康證明或者其他有關(guān)證件。
Article 100 The people subject to entry or exit quarantine inspection are
required to fill out health card as required by the quarantine physician, to
present a valid certificate of inoculation against epidemic diseases, bill of
health or other related certificate.
第一百零一條 衛(wèi)生檢疫機(jī)關(guān)對(duì)國(guó)境口岸的涉外賓館、飯店內(nèi)居住的入境、出境人員及工作人員實(shí)施傳染病監(jiān)測(cè),并區(qū)別情況采取必要的預(yù)防,控制措施。
Article 101 The health and quarantine organ shall exercise quarantine
monitoring among the incoming or outcoming passengers staying at the hotels at
the frontier port as well as the hotel workers and will either take
precautionary measures or control measures according to circumstances.
對(duì)來(lái)自檢疫傳染病和監(jiān)測(cè)傳染病疫區(qū)的人員,檢疫醫(yī)師可以根據(jù)流行病學(xué)和醫(yī)學(xué)檢查結(jié)果,發(fā)給就診方便卡。
The health and quarantine physician may give an instant clinic card to every
person coming from the pestilence area of the monitoring epidemic area according
to the epidemiological and medical examination results.
衛(wèi)生檢疫機(jī)關(guān)、醫(yī)療衛(wèi)生單位遇到持有就診方便卡的人員請(qǐng)求醫(yī)學(xué)檢查時(shí),應(yīng)當(dāng)視同急診給予醫(yī)學(xué)檢查;如果發(fā)現(xiàn)其患檢疫傳染病或者監(jiān)測(cè)傳染病,疑似檢疫傳染病或者疑似監(jiān)測(cè)傳染病,應(yīng)當(dāng)立即實(shí)施必要的衛(wèi)生措施,并且將情況報(bào)告當(dāng)?shù)匦l(wèi)生防疫機(jī)構(gòu)和簽發(fā)就診方便卡的衛(wèi)生檢疫機(jī)關(guān)。
When a person comes for a medical examination with an instant clinic card, the
health quarantine organ and the medical and health unit are required to give him
an emergency medical examination. If he is found to be a victim of a
quarantinable infectious disease or to have been contaminated with a monitoring
epidemic disease or he is suspected of being a quarantinable disease victim or
of having caught the monitored epidemic disease, he is required to go through
necessary sanitization. Meanwhile, the case shall be reported to the local
health and epidemic prevention station and the health and quarantine organ that
issued him the instant clinic card.
第一百零二條 凡申請(qǐng)出境居住1年以上的中國(guó)籍人員,必須持有衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的健康證明。中國(guó)公民出境、入境管理機(jī)關(guān)憑衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的健康證明辦理出境手續(xù)。
Article 102 Chinese citizens who apply to stay abroad for over one year are
required to carry health certificates issued by the health and quarantine organ.
The exit and entry organ for Chinese citizens shall process such an application
only if it includes a health certificate issued by the health and quarantine
organ.
凡在境外居住1年以上的中國(guó)籍人員,入境時(shí)必須向衛(wèi)生檢疫機(jī)關(guān)申報(bào)健康情況,并在入境后1個(gè)月內(nèi)到就近的衛(wèi)生檢疫機(jī)關(guān)或者縣級(jí)以上的醫(yī)院進(jìn)行健康檢查。公安機(jī)關(guān)憑健康證明辦理有關(guān)手續(xù),健康證明的副本應(yīng)當(dāng)寄送到原入境口岸的衛(wèi)生檢疫機(jī)關(guān)備案。
A Chinese citizen who has stayed abroad for over one year is, upon reentry,
required to fill out health declaration form required by the health and
quarantine organ and go to the local health and quarantine organ or to the
hospital at or above the county level for physical check-up within one month.
The public security organ shall allow him to go through related procedures on
the strength of the health certificate. A copy of his health certificate must be
sent to the port health and quarantine organ for the record.
國(guó)際通行交通工具上的中國(guó)籍員工,應(yīng)當(dāng)持有衛(wèi)生檢疫機(jī)關(guān)或者縣級(jí)以上醫(yī)院出具的健康證明。健康證明的項(xiàng)目、格式由國(guó)務(wù)院衛(wèi)生行政部門統(tǒng)一規(guī)定,有效期為12個(gè)月。
Chinese crew members working on the means of international transport must
carry their health certificates issued by the health and quarantine organ or the
hospital at or above the county level. The health administrative department
under the State Council of the People's Republic of China shall unify the items
and form of health certificate. The term of validity is 12 months.
第一百零三條 衛(wèi)生檢疫機(jī)關(guān)在國(guó)境口岸內(nèi)設(shè)立傳染病監(jiān)測(cè)點(diǎn)時(shí),有關(guān)單位應(yīng)當(dāng)給予協(xié)助并提供方便。
Article 103 When the health and quarantine organ sets up a monitoring post for
epidemic diseases at the border port, the units concerned are required to offer
conveniences.
第十章 衛(wèi)生監(jiān)督
Chapter X Health Supervision
第一百零四條 衛(wèi)生檢疫機(jī)關(guān)依照《國(guó)境衛(wèi)生檢疫法》第十八條、第十九條規(guī)定的內(nèi)容,對(duì)國(guó)境口岸和交通工具實(shí)施衛(wèi)生監(jiān)督。
Article 104 The health and quarantine organ shall exercise health supervision
over the sanitary conditions at frontier ports and the sanitary conditions of
conveyances according to the requirements stipulated in Articles 18 and 19 of
the Frontier Health and Quarantine Law.
第一百零五條 對(duì)國(guó)境口岸的衛(wèi)生要求是:
Article 105 The sanitary requirements for a border port are as follows:
(一)國(guó)境口岸和國(guó)境口岸內(nèi)涉外的賓館、生活服務(wù)單位以及候船、候車、候機(jī)廳(室)應(yīng)當(dāng)有健全的衛(wèi)生制度和必要的衛(wèi)生設(shè)施,并保持室內(nèi)外環(huán)境整潔、通風(fēng)良好;
(1) the border port, the port hotels accommodating inward or outward
passengers, and ship, bus and airport terminals, are required to have an
effective hygiene system and necessary hygienic facilities and to maintain clean
and tidy and well ventilated;
(二)國(guó)境口岸有關(guān)部門應(yīng)當(dāng)采取切實(shí)可行的措施,控制嚙齒動(dòng)物、病媒昆蟲,使其數(shù)量降低到不足為害的程度,倉(cāng)庫(kù)、貨場(chǎng)必須具有防鼠設(shè)施;
(2) the units concerned at the border port are required to take effective
measures to minimize the number of rodents or vector pests so it may not cause
any harm. Warehouses and storage ground are required to be equipped with
anti-rat devices;
(三)國(guó)境口岸的垃圾、廢物、污水、糞便必須進(jìn)行無(wú)害化處理,保持國(guó)境口岸環(huán)境整潔衛(wèi)生。
(3) garbage, waste water, sewage, and excrement must be disposed after
innocuous treatment in order to keep the environment at the border port clean
and tidy.
第一百零六條 對(duì)交通工具的衛(wèi)生要求是:
Article 106 The sanitary requirements for the conveyance are as follows:
(一)交通工具上的宿艙、車廂必須保持清潔衛(wèi)生,通風(fēng)良好;
(1) the berths and carriages must be kept clean and tidy and well ventilated;
(二)交通工具上必須備有足夠的消毒、除鼠、除蟲藥物及器械,并備有防鼠裝置;
(2) there must be on board the conveyance adequate disinfectant and equipment,
rat-killer and insecticides;
(三)交通工具上的貨艙、行李艙、貨車車廂在裝貨前或者卸貨后應(yīng)當(dāng)進(jìn)行徹底清掃,有毒物品和食品不得混裝,防止污染;
(3) cargo holds, luggage compartments and freight cars must be thoroughly
cleaned before loading and after unloading. Mixloading of toxic articles and
foods is strictly forbidden so as to prevent contamination;
(四)對(duì)不符合衛(wèi)生要求的入境、出境交通工具,必須接受衛(wèi)生檢疫機(jī)關(guān)的督導(dǎo)立即進(jìn)行改進(jìn)。
(4) entry and exit conveyances that have not meet the sanitary requirements,
are required to make improvement without delay under the supervision of the
health and quarantine organ.
第一百零七條 對(duì)飲用水、食品及從業(yè)人員的衛(wèi)生要求是:
Article 107 The sanitary requirements for drinking water, food and the
relevant working staff:
(一)國(guó)境口岸和交通工具上的食品、飲用水必須符合有關(guān)的衛(wèi)生標(biāo)準(zhǔn);
(1) drinking water and food provided at the border port or on the conveyance
must be up to the relevant hygienic standards;
(二)國(guó)境口岸內(nèi)的涉外賓館,以及向入境、出境的交通工具提供飲食服務(wù)的部門,營(yíng)業(yè)前必須向衛(wèi)生檢疫機(jī)關(guān)申請(qǐng)衛(wèi)生許可證;
(2) prior to their operation, the port hotels accommodating inward or outward
passengers and the restaurants providing service to the inward or outward
conveyances are required to apply to the health and quarantine organ for a
hygiene license;
(三)國(guó)境口岸內(nèi)涉外的賓館和入境、出境交通工具上的食品、飲用水從業(yè)人員應(yīng)當(dāng)持有衛(wèi)生檢疫機(jī)關(guān)簽發(fā)的健康證書,該證書自簽發(fā)之日起12 個(gè)月內(nèi)有效。
(3) members of the staff involved in providing drinking water and food to the
border port hotels accommodating inward or outward passengers and to the entry
or exit conveyances must hold health certificates issued by the health and
quarantine organ. The certificate will be valid for 12 months of the date of
issuance.
第一百零八條 國(guó)境口岸有關(guān)單位和交通工具負(fù)責(zé)應(yīng)當(dāng)遵守下列事項(xiàng):
Article 108 The persons in charge of the relevant units at the border port or
of conveyances are required to observe the following requirements:
(一)遵守《國(guó)境衛(wèi)生檢疫法》和本細(xì)則及有關(guān)衛(wèi)生法規(guī)的規(guī)定:
(1) abide by the "Frontier Health and Quarantine Law" and the related health
regulations stipulated in these Implementation Rules;
(二) 接受衛(wèi)生監(jiān)督員的監(jiān)督和檢查,并為其工作提供方便;
(2) accept the inspection and checking by the sanitation supervisors and
provide convenience for their work;
(三)按照衛(wèi)生監(jiān)督員的建議,對(duì)國(guó)境口岸和交通工具的衛(wèi)生狀況及時(shí)采取改進(jìn)措施。
(3) take prompt measures to improve sanitary conditions at the border port or
on the conveyance as suggested by the sanitary supervisors.
第十一章 罰 則
Chapter XI Penalty Provisions
第一百零九條 《國(guó)境衛(wèi)生檢疫法》和本細(xì)則所規(guī)定的應(yīng)當(dāng)受行政處罰的行為是指:
Article 109 Acts that are subject to administrative sanction as defined in the
"Frontier Health and Quarantine Law" and these Implementation Rules refer to the
following:
(一)應(yīng)當(dāng)受入境檢疫的船舶,不懸掛檢疫信號(hào)的;
(1) vessels subject to entry quarantine fail to hoist quarantine signals;
(二)入境、出境的交通工具,在入境檢疫之前或者在出境檢疫之后,擅自上下人員,裝卸行李、貨物、郵包等物品的;
(2) embark on or disembark from conveyances, load or unload articles such as
luggage, goods or postal parcels from conveyances prior to entry quarantine and
after exit quarantine;
(三)拒絕接受檢疫或者抵制衛(wèi)生監(jiān)督,拒不接受衛(wèi)生處理的;
(3) refuse to undergo quarantine inspection or sanitary supervision, or refuse
to allow sanitation measures to be taken;
(四)偽造或者涂改檢疫單、證,不如實(shí)申報(bào)疫情的;
(4) forge or alter the quarantine permit or certificate or fail to declare
truthfully the quarantine situation on their vessel;
(五)瞞報(bào)攜帶禁止進(jìn)口的微生物、人體組織。生物制品、血液及其制品或者其他可能引起傳染病傳播的動(dòng)物和物品的;
(5) fail to declare to have carried in such forbidden articles as microzoaria,
human tissue, biologicals, blood and hemoproducts as well as other articles that
may cause the spread of epidemic diseases;
(六)未經(jīng)檢疫的入境、出境交通工具,擅自離開檢疫地點(diǎn),逃避查驗(yàn)的;
(6) entry and exit conveyances leave the quarantine inspection place without
permission for the purpose of evading quarantine inspection;
(七)隱瞞疫情或者偽造情節(jié)的;
(7) hide the truth of quarantine epidemic disease from the health and
quarantine organ or falsify the details of the situation;
(八)未經(jīng)衛(wèi)生檢疫機(jī)關(guān)實(shí)施衛(wèi)生處理,擅自排放壓艙水、移下垃圾、污物等控制的物品的。
(8) discharge ballast water or remove such controlled things as rubbish or
contaminated matter without prior sanitization by the health and quarantine
organ;
(九)未經(jīng)衛(wèi)生檢疫機(jī)關(guān)實(shí)施衛(wèi)生處理,擅自移運(yùn)尸體、骸骨的;
(9) transship human corpse or remains without prior sanitization conducted by
the health and quarantine organ;
(十)廢舊物品、廢舊交通工具,未向衛(wèi)生檢疫機(jī)關(guān)申報(bào),未經(jīng)衛(wèi)生檢疫機(jī)關(guān)實(shí)施衛(wèi)生處理和簽發(fā)衛(wèi)生檢疫證書而擅自入境、出境或者使用、拆卸的;
(10) ship in or out, use or dismantle used materials or used conveyance
without applying to the health and quarantine organ, or without a health and
quarantine inspection certificate after sanitization conducted by the health and
quarantine organ;
(十一)未經(jīng)衛(wèi)生檢檢機(jī)關(guān)檢查,從交通工具上移下傳染病病人造成傳染病傳播危險(xiǎn)的。
(11) let patients of epidemic cases off the conveyance before going through
the health and quarantine inspection and thus cause the spread of epidemic
diseases.
第一百一十條 具有本細(xì)則第一百零九條所列第(一)至第(五)項(xiàng)行為的,處以警告或者100元以上5000元以下的罰款;
Article 110 Those who violate any one of Items 1 to 5 listed in Article 109
shall get a warning or a fine ranging from RMB 100 yuan to RMB 5,000 yuan;
具有本細(xì)則第一百零九條所列第(六)至第(九)項(xiàng)行為的,處以l000元以上1萬(wàn)元以下的罰款;
those who violate any one of Items 6 to 9 listed in Article 109 shall get a
fine ranging from RMB 1,000 yuan to RMB 10,000 yuan;
具有本細(xì)則第一百零九條所列第(十)、第(十一)項(xiàng)行為的,處以5000 元以上3萬(wàn)元以下的罰款。
those who violate either Item 10 or 11 listed in Article 109 shall get a fine
ranging from RMB 5,000 yuan to RMB 30,000 yuan.
第一百一十一條 衛(wèi)生檢疫機(jī)關(guān)在收取罰款時(shí),應(yīng)當(dāng)出具正式的罰款收據(jù)。罰款全部上交國(guó)庫(kù)。
Article 111 When imposing penalties, the health and quarantine organ must
write out an official fine receipt. All fines thus collected shall be turned
over to the state treasure.
第十二章 附 則
Chapter XII Supplementary Provisions
第一百一十二條 國(guó)境衛(wèi)生檢疫機(jī)關(guān)實(shí)施衛(wèi)生檢疫的收費(fèi)標(biāo)準(zhǔn),由國(guó)務(wù)院衛(wèi)生行政部門會(huì)同國(guó)務(wù)院財(cái)政、物價(jià)部門共同制定。
Article 112 The standard fee for health and quarantine inspection charged by
the frontier health and quarantine organ shall be set jointly by the health
administrative department, the financial department and the administration for
commodity prices under the State Council of the People's Republic of China.
第一百一十三條 本細(xì)則由國(guó)務(wù)院衛(wèi)生行政部門負(fù)責(zé)解釋。
Article 113 The right to interpret these Implementation Rules resides in the
health administrative department under the State Council of the People's
Republic of China.
第一百一十四條 本細(xì)則自發(fā)布之日起施行。
Article 114 These Implementation Rules shall go into effect as of the date of
promulgation.
