第一章 總 則
Chapter I. Comprehensive Regulations
第一條
為了加強(qiáng)對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的安全保護(hù)，維護(hù)公共秩序和社會(huì)穩(wěn)定，根據(jù)《中華人民共和國(guó)計(jì)算機(jī)信息系統(tǒng)安全保護(hù)條例》、《中華人民共和國(guó)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)管理暫行規(guī)定》和其他法律、行政法規(guī)的規(guī)定，制定本辦法。
Article 1.In order to strengthen the security and the protection of computer
information networks and of the Internet, and to preserve the social order and
social stability, these regulations have been established on the basis of the
"PRC Computer Information Network Protection Regulations", the "PRC Temporary
Regulations on Computer Information Networks and the Internet" and other laws
and administrative regulations.
第二條 中華人民共和國(guó)境內(nèi)的計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)安全保護(hù)管理，適用本辦法。
Article 2.The security, protection and management of all computer information
networks within the borders of the PRC fall under these regulations.
第三條 公安部計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)負(fù)責(zé)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的安全保護(hù)管理工作。
Article 3.The computer management and supervision organization of the Ministry
of Public Security is responsible for the security, protection and management of
computer information networks and the Internet.
公安機(jī)關(guān)計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)保護(hù)計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的公共安全，維護(hù)從事國(guó)際聯(lián)網(wǎng)業(yè)務(wù)的單位和個(gè)人的合法權(quán)益和公眾利益。
The Computer Management and Supervision organization of the Ministry of Public
Security should protect the public security of computer information networks and
the Internet as well as protect the legal rights of Internet service providing
units and individuals as well as the public interest.
第四條 任何單位和個(gè)人不得利用國(guó)際聯(lián)網(wǎng)危害國(guó)家安全、泄露國(guó)家秘密，不得侵犯國(guó)家的、社會(huì)的、集體的利益和公民的合法權(quán)益，不得從事違法犯罪活動(dòng)。
Article 4.No unit or individual may use the Internet to harm national
security, disclose state secrets, harm the interests of the State, of society or
of a group, the legal rights of citizens, or to take part in criminal
activities.
第五條 任何單位和個(gè)人不得利用國(guó)際聯(lián)網(wǎng)制作、復(fù)制、查閱和傳播下列信息：
Article 5.No unit or individual may use the Internet to create, replicate,
retrieve, or transmit the following kinds of information:
(一) 煽動(dòng)抗拒、破壞憲法和法律、行政法規(guī)實(shí)施的；
(1) Inciting to resist or breaking the Constitution or laws or the
implementation of administrative regulations;
(二) 煽動(dòng)顛覆國(guó)家政權(quán)，推翻社會(huì)主義制度的；
(2) Inciting to overthrow the government or the socialist system;
(三) 煽動(dòng)分裂國(guó)家、破壞國(guó)家統(tǒng)一的；
(3) Inciting division of the country, harming national unification;
(四) 煽動(dòng)民族仇恨、民族歧視，破壞民族團(tuán)結(jié)的；
(4) Inciting hatred or discrimination among nationalities or harming the unity
of the nationalities;
(五) 捏造或者歪曲事實(shí)，散布謠言，擾亂社會(huì)秩序的；
(5) Making falsehoods or distorting the truth, spreading rumors, destroying
the order of society;
(六) 宣揚(yáng)封建迷信、淫穢、色情、賭博、暴力、兇殺、 恐怖，教唆犯罪的；
(6) Promoting feudal superstitions, sexually suggestive material, gambling,
violence, murder;
(七) 公然侮辱他人或者捏造事實(shí)誹謗他人的；
(7) Terrorism or inciting others to criminal activity; openly insulting other
people or distorting the truth to slander people;
(八) 損害國(guó)家機(jī)關(guān)信譽(yù)的；
(8) Injuring the reputation of state organs;
(九) 其他違反憲法和法律、行政法規(guī)的。
(9) Other activities against the Constitution, laws or administrative
regulations.
第六條 任何單位和個(gè)人不得從事下列危害計(jì)算機(jī)信息網(wǎng)絡(luò)安全的活動(dòng)：
Article 6.No unit or individual may engage in the following activities which
harm the security of computer information networks:
(一) 未經(jīng)允許，進(jìn)入計(jì)算機(jī)信息網(wǎng)絡(luò)或者使用計(jì)算機(jī)信息網(wǎng)絡(luò)資源的；
(1) No-one may use computer networks or network resources without getting
proper prior approval
(二) 未經(jīng)允許，對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)功能進(jìn)行刪除、修改或者增加的；
(2) No-one may without prior permission may change network functions or to add
or delete information
(三) 未經(jīng)允許，對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)中存儲(chǔ)、處理或者傳輸?shù)臄?shù)據(jù)和應(yīng)用程序進(jìn)行刪除、修改或者增加的；
(3) No-one may without prior permission add to, delete, or alter materials
stored, processed or being transmitted through the network.
(四) 故意制作、傳播計(jì)算機(jī)病毒等破壞性程序的；
(4) No-one may deliberately create or transmit viruses.
(五) 其他危害計(jì)算機(jī)信息網(wǎng)絡(luò)安全的。
(5) Other activities which harm the network are also prohibited.
第七條 用戶(hù)的通信自由和通信秘密受法律保護(hù)。任何單位和個(gè)人不得違反法律規(guī)定，利用國(guó)際聯(lián)網(wǎng)侵犯用戶(hù)的通信自由和通信秘密。
Article 7.The freedom and privacy of network users is protected by law. No
unit or individual may, in violation of these regulations, use the Internet to
violate the freedom and privacy of network users.
第二章 安全保護(hù)責(zé)任
Chapter II. Responsibility for Security and Protection
第八條
從事國(guó)際聯(lián)網(wǎng)業(yè)務(wù)的單位和個(gè)人應(yīng)當(dāng)接受公安機(jī)關(guān)的安全監(jiān)督、檢查和指導(dǎo)，如實(shí)向公安機(jī)關(guān)提供有關(guān)安全保護(hù)的信息、資料及數(shù)據(jù)文件，協(xié)助公安機(jī)關(guān)查處通過(guò)國(guó)際聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)的違法犯罪行為。
Article 8.Units and individuals engaged in Internet business must accept the
security supervision, inspection, and guidance of the Public Security
organization. This includes providing to the Public Security organization
information, materials and digital document, and assisting the Public Security
organization to discover and properly handle incidents involving law violations
and criminal activities involving computer information networks.
第九條 國(guó)際出入口信道提供單位、互聯(lián)單位的主管部門(mén)或者主管單位，應(yīng)當(dāng)依照法律和國(guó)家有關(guān)規(guī)定負(fù)責(zé)國(guó)際出入口信道、所屬互聯(lián)網(wǎng)絡(luò)的安全保護(hù)管理工作。
Article 9.The supervisory section or supervisory units of units which provide
service through information network gateways through which information is
imported and exported and connecting network units should, according to the law
and relevant state regulations assume responsibility for the Internet network
gateways as well as the security, protection, and management of the subordinate
networks.
第十條 互聯(lián)單位、接入單位及使用計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的法人和其他組織應(yīng)當(dāng)履行下列安全保護(hù)職責(zé)：
Article 10.Connecting network units, entry point units and corporations that
use computer information networks and the Internet and other organizations must
assume the following responsibilities for network security and protection:
(一) 負(fù)責(zé)本網(wǎng)絡(luò)的安全保護(hù)管理工作，建立健全安全保護(hù)管理制度；
(1) Assume responsibility for network security, protection and management and
establish a thoroughly secure, protected and well managed network;
(二) 落實(shí)安全保護(hù)技術(shù)措施，保障本網(wǎng)絡(luò)的運(yùn)行安全和信息安全；
(2) Carry out technical measures for network security and protection. Ensure
network operational security and information security;
(三) 負(fù)責(zé)對(duì)本網(wǎng)絡(luò)用戶(hù)的安全教育和培訓(xùn)；
(3) Assume responsibility for the security education and training of network
users;
(四) 對(duì)委托發(fā)布信息的單位和個(gè)人進(jìn)行登記，并對(duì)所提供的信息內(nèi)容按照本辦法第五條進(jìn)行審核；
(4) Register units and individuals to whom information is provided. Provide
information according to the stipulations of article five;
(五) 建立計(jì)算機(jī)信息網(wǎng)絡(luò)電子公告系統(tǒng)的用戶(hù)登記和信息管理制度；
(5) Establish a system for registering the users of electronic bulletin board
systems on the computer information network as well as a system for managing
bulletin board information;
(六) 發(fā)現(xiàn)有本辦法第四條、第五條、第六條、第七條所列情形之一的，應(yīng)當(dāng)保留有關(guān)原始記錄，并 在二十四小時(shí)內(nèi)向當(dāng)?shù)毓矙C(jī)關(guān)報(bào)告 ；
(6) If a violation of articles four, five, six or seven is discovered than an
unaltered record of the violation should be kept and reported to the local
Public Security organization;
(七) 按照國(guó)家有關(guān)規(guī)定，刪除本網(wǎng)絡(luò)中含有本辦法第五條內(nèi)容的地址、目錄或者關(guān)閉服務(wù)器。
(7) According to the relevant State regulations, remove from the network and
address, directory or server which has content in violation of article five.
第十一條 用戶(hù)在接入單位辦理入網(wǎng)手續(xù)時(shí)， 應(yīng)當(dāng)填寫(xiě)用戶(hù)備案表。備案表由公安部監(jiān)制。
Article 11.The network user should fill out a user application form when
applying for network services. The format of this application form is determined
by Public Security.
第十二條 互聯(lián)單位、接入單位、使用計(jì)算機(jī)信息網(wǎng)絡(luò)國(guó)際聯(lián)網(wǎng)的法人和其他組織
(包括跨省、自治區(qū)、直轄市聯(lián)網(wǎng)的單位和所屬的分支機(jī)構(gòu)），應(yīng)當(dāng)自網(wǎng)絡(luò)正式聯(lián)通之日起三十日內(nèi)，到所在地的省、自治區(qū)、直轄市人民政府公安機(jī)關(guān)指定的受理機(jī)關(guān)辦理備案手續(xù)。
Article 12.Connecting network units, entry point units, and corporations that
use computer information networks and the Internet and other organizations
(including connecting network units that are inter-provincial, autonomous
region, municipalities directly under the Central Government or the branch
organization of these units) should, within 30 days of the opening of network
connection, carry out the proper registration procedures with a unit designated
by the Public Security organization of the provincial, autonomous region, or
municipality directly under the Central Government peoples' government.
前款所列單位應(yīng)當(dāng)負(fù)責(zé)將接入本網(wǎng)絡(luò)的接入單位和用戶(hù)情況報(bào)當(dāng)?shù)毓矙C(jī)關(guān)備案，并及時(shí)報(bào)告本網(wǎng)絡(luò)中接入單位和用戶(hù)的變更情況。
The units mentioned above have the responsibility to report for the record to
the local public security organization information on the units and individuals
which have connections to the network. The units must also report in a timely
manner to Public Security organization any changes in the information about
units or individuals using the network.
第十三條 使用公用帳號(hào)的注冊(cè)者應(yīng)當(dāng)加強(qiáng)對(duì)公用帳號(hào)的管理，建立帳號(hào)使用登記制度。用戶(hù)帳號(hào)不得轉(zhuǎn)借、轉(zhuǎn)讓。
Article 13.People who register public accounts should strengthen their
management of the account and establish an account registration system. Accounts
may not be lent or transferred.
第十四條 涉及國(guó)家事務(wù)、經(jīng)濟(jì)建設(shè)、國(guó)防建設(shè)、尖端科學(xué)技術(shù)等重要領(lǐng)域的單位辦理備案手續(xù)時(shí)，應(yīng)當(dāng)出具其行政主管部門(mén)的審批證明。
Article 14.Whenever units involved in matters such as national affairs,
economic construction, building the national defense, and advanced science and
technology are registered, evidence of the approval of the chief administrative
section should be shown.
前款所列單位的計(jì)算機(jī)信息網(wǎng)絡(luò)與國(guó)際聯(lián)網(wǎng)，應(yīng)當(dāng)采取相應(yīng)的安全保護(hù)措施。
Appropriate measures should be taken to ensure the security and protection of
the computer information network and Internet network links of the units
mentioned above.
第三章 安全監(jiān)督
Chapter III. Security and Supervision
第十五條 省、自治區(qū)、直轄市公安廳（局），地（市）、縣（市）公安局，應(yīng)當(dāng)有相應(yīng)機(jī)構(gòu)負(fù)責(zé)國(guó)際聯(lián)網(wǎng)的安全保護(hù)管理工作。
Article 15.The provincial, autonomous region or municipal Public Security
agency or bureau, as well as city and county Public Security organizations
should have appropriate organizations to ensure the security, protection and
management of the Internet.
第十六條 公安機(jī)關(guān)計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)掌握互聯(lián)單位、接入單位和用戶(hù)的備案情況，建立備案檔案，進(jìn)行備案統(tǒng)計(jì)，并按照國(guó)家有關(guān)規(guī)定逐級(jí)上報(bào)。
Article 16.The Public Security organization computer management and
supervision organization should have information on the connecting network
units, entry point unit, and users, establish a filing system for this
information, maintain statistical information on these files and report to
higher level units as appropriate.
第十七條 公安機(jī)關(guān)計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)督促互聯(lián)單位、接入單位及有關(guān)用戶(hù)建立健全安全保護(hù)管理制度。
Article 17.The Public Security computer management and supervision
organization should have establish a system for ensuring the security,
protection and good management of the connecting network units, entry point
unit, and users.
監(jiān)督、檢查網(wǎng)絡(luò)安全保護(hù)管理以及技術(shù)措施的落實(shí)情況。
The Public Security organization should supervise and inspect network
security, protection and management and the implementation of security measures.
第十八條 公安機(jī)關(guān)計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)發(fā)現(xiàn)含有本辦法第五條所列內(nèi)容的地址、目錄或者服務(wù)器時(shí)，應(yīng)當(dāng)通知有關(guān)單位關(guān)閉 或者刪除。
Article 18.If the Public Security computer management and supervision
organization discovers an address, directory or server with content in violation
of Article 5, then the appropriate units should be notified to close or delete
it.
第十九條
公安機(jī)關(guān)計(jì)算機(jī)管理監(jiān)察機(jī)構(gòu)應(yīng)當(dāng)負(fù)責(zé)追蹤和查處通過(guò)計(jì)算機(jī)信息網(wǎng)絡(luò)的違法行為和針對(duì)計(jì)算機(jī)信息網(wǎng)絡(luò)的犯罪案件，對(duì)違反本辦法第四條、第七條規(guī)定的違法犯罪行為，應(yīng)當(dāng)按照國(guó)家有關(guān)規(guī)定移送有關(guān)部門(mén)或者司法機(jī)關(guān)處理。
Article 19.The Public Security computer management and supervision
organization is responsible for pursuing and dealing with illegal computer
information network activities and criminal cases involving computer information
networks. Criminal activities in violation of Article 4 or Article 7 should
according to the relevant State regulations, be handed over to the relevant
department or to the legal system for appropriate disposition.
第四章 法律責(zé)任
Chapter IV. Legal Responsibility
第二十條
違反法律、行政法規(guī)，有本辦法第五條、第六條所列行為之一的，由公安機(jī)關(guān)給予警告，有違法所得的，沒(méi)收違法所得，對(duì)個(gè)人可以并處五千元以下的罰款，對(duì)單位可以并處一萬(wàn)五千元以下的罰款；
Article 20.For violations of law, administrative regulations or of Article 5
or Article 6 of these regulations, the Public Security organization gives a
warning and if there income from illegal activities, confiscates the illegal
earnings. A fine not to exceed 5000 RMB to individuals and 15,000 RMB to work
units may be assessed.
情節(jié)嚴(yán)重的，并可以給予六個(gè)月以?xún)?nèi)停止聯(lián)網(wǎng)、停機(jī)整頓的處罰，必要時(shí)可以建議原發(fā)證、審批機(jī)構(gòu)吊銷(xiāo)經(jīng)營(yíng)許可證或者取消聯(lián)網(wǎng)資格；
For serious offenses computer and network access can be closed down for up to
six months, and if necessary Public Security can suggest that the business
operating license of the concerned unit or the cancellation of its network
registration.
構(gòu)成違反治安管理行為的，依照治安管理處罰條例的規(guī)定處罰；構(gòu)成犯罪的，依法追究刑事責(zé)任。
Activities contravening public security management regulations are punishable
in accordance with provisions of the public security management penalties
articles. Where crimes have occurred, prosecutions for criminal responsibility
should be made.
第二十一條 有下列行為之一的，由公安機(jī)關(guān)責(zé)令限期改正，給予警告，有違法所得的，沒(méi)收違法所得；
Article 21.Where one of the activities listed below has occurred, the Public
Security organization should order that remedial action should be taken with a
specific period and give a warning; if there has been illegal income, the income
should be confiscated;
在規(guī)定的限期內(nèi)未改正的，對(duì)單位的主管負(fù)責(zé)人員和其他直接責(zé)任人員可以并處五千元以下的罰款，對(duì)單位可以并處一萬(wàn)五千元以下的罰款；
if remedial action is not taken within the specified period, then a fine of
not more than 5000 RMB may be assessed against the top management personnel in
charge of the area and other persons directly responsible [for the violation]
and a fine of not more than 15,000 RMB against the unit;
情節(jié)嚴(yán)重的，并可以給予六個(gè)月以?xún)?nèi)的停止聯(lián)網(wǎng)、停機(jī)整頓的處罰，必要時(shí)可以建議原發(fā)證、審批機(jī)構(gòu)吊銷(xiāo)經(jīng)營(yíng)許可證或 者取消聯(lián)網(wǎng)資格。
in the case of serious offenses, the network and equipment can be closed for
up to six months. If necessary Public Security may suggest that the business
license of the organization be canceled and its network registration canceled.
(一) 未建立安全保護(hù)管理制度的；
(1) Not establishing a management system for network security and protection;
(二) 未采取安全技術(shù)保護(hù)措施的；
(2) Not implementing security techniques and protection measures;
(三) 未對(duì)網(wǎng)絡(luò)用戶(hù)進(jìn)行安全教育和培訓(xùn)的；
(3) Not providing security education and training for network users;
(四) 未提供安全保護(hù)管理所需信息、資料及數(shù)據(jù)文件， 或者所提供內(nèi)容不真實(shí)的；
(4) Not providing information, materials or electronic documentation needed
for security, protection and management or providing false information;
(五) 對(duì)委托其發(fā)布的信息內(nèi)容未進(jìn)行審核或者對(duì)委托單 位和個(gè)人未進(jìn)行登記的；
(5) Not inspecting the content of information released on behalf of someone
else or not registering the unit or individual on whose behalf the information
was released;
(六) 未建立電子公告系統(tǒng)的用戶(hù)登記和信息管理制度的 ；
(6) Not establishing a system for registering users and managing the
information of electronic bulletin boards;
(七) 未按照國(guó)家有關(guān)規(guī)定，刪除網(wǎng)絡(luò)地址、目錄或者關(guān)閉服務(wù)器的；
(7) Not removing web addresses and directories or not closing servers
according to the relevant state regulations;
(八) 未建立公用帳號(hào)使用登記制度的；
(8) Not establishing a system for registering users of public accounts;
(九) 轉(zhuǎn)借、轉(zhuǎn)讓用戶(hù)帳號(hào)的。
(9) Lending or transferring accounts.
第二十二條 違反本辦法第四條、第七條規(guī)定 的，依照有關(guān)法律、法規(guī)予以處罰。
Article 22.Violation of Article 4 or Article 7 of these regulations shall be
punished according to the relevant laws and regulations.
第二十三條 違反本辦法第十一條、第十二條規(guī)定，不履行備案職責(zé)的，由公安機(jī)關(guān)給予警告或者停機(jī)整頓不超過(guò)六個(gè)月的處罰。
Article 23.Violations of Article 11 or Article 12 of these regulations or not
fulfilling the responsibility or registering users shall be punished by a
warning from Public Security or suspending network operations for six months.
第五章 附 則
Chapter V. Additional Regulations
第二十四條 與香港特別行政區(qū)和臺(tái)灣、澳門(mén)地區(qū)聯(lián)網(wǎng)的計(jì)算機(jī)信息網(wǎng)絡(luò)的安全保護(hù)管理，參照本辦法執(zhí)行。
Article 24.These regulations should be consulted with regards to the
implementation of the security, protection and management of computer
information networks connecting to networks in the Hong Kong Special
Administrative Region as well as with networks in the Taiwan and Macao
districts.
第二十五條 本辦法自發(fā)布之日起施行。
Article 25.These regulations go into effect on the day of promulgation.
