中華人民共和國(guó)商標(biāo)法實(shí)施細(xì)則
Implementing Rules of the Trademark Law of the PRC
第一條根據(jù)《中華人民共和國(guó)商標(biāo)法》（以下簡(jiǎn)稱(chēng)《商標(biāo)法》）第四十二條規(guī)定，制定本實(shí)施細(xì)則。
Article 1 These Rules are formulated in accordance with the provisions of
Article 42 of the Trademark Law of the People's Republic of China （hereinafter
referred to as the “Trademark Law”）
第二條商標(biāo)注冊(cè)申請(qǐng)人，必須是依法成立的企業(yè)、事業(yè)單位、社會(huì)團(tuán)體、個(gè)體工商戶(hù)、個(gè)人合伙以及符合《商標(biāo)法》第九條規(guī)定的外國(guó)人或者外國(guó)企業(yè)。
Article 2 Applicants for trademark registration must be enterprises，
institutions， social organizations， individual industrialists or businessmen or
partnerships of individuals that are formed in accordance with the law， or
foreign nationals or foreign enterprises that conform to the provisions of
Article 9 of the Trademark Law.
本實(shí)施細(xì)則有關(guān)商品商標(biāo)的規(guī)定，適用于服務(wù)商標(biāo)。
The provisions of these Rules about trademarks of goods are applicable to
trademarks of services.
第三條申請(qǐng)商標(biāo)注冊(cè)、轉(zhuǎn)讓注冊(cè)、續(xù)展注冊(cè)、變更注冊(cè)人名義或者地址、補(bǔ)發(fā)《商標(biāo)注冊(cè)證》等有關(guān)事項(xiàng)，申請(qǐng)人可以委托國(guó)家工商行政管理局認(rèn)可的商標(biāo)代理組織代理，也可以直接辦理。
Article 3 In applying for trademark registration， registration of assignments，
registration of renewals， the change of name or address of a registrant， the
replacement of a Trademark Registration Certificate or other related matters，
the applicants may entrust a trademark agency authorized by the State
Administration for Industry and Commerce to represent them， and may also perform
the application formalities directly by themselves.
外國(guó)人或者外國(guó)企業(yè)在中國(guó)申請(qǐng)商標(biāo)注冊(cè)或者辦理其他商標(biāo)事宜，應(yīng)當(dāng)委托國(guó)家工商行政管理局指定的商標(biāo)代理組織代理。
When foreign nationals or foreign enterprises wish to apply in China for
trademark registration and the handling of other trademark matters， they shall
entrust a trademark agency appointed by the State Administration for Industry
and Commerce to represent them.
商標(biāo)國(guó)際注冊(cè)，依照《商標(biāo)國(guó)際注冊(cè)馬德里協(xié)定》辦理。
The international registration of trademarks shall be done in accordance with
the Madrid Agreement for International Registration of Trademarks.
第四條申請(qǐng)商標(biāo)注冊(cè)、轉(zhuǎn)讓注冊(cè)、續(xù)展注冊(cè)、變更、補(bǔ)證、評(píng)審及其他有關(guān)事項(xiàng)，必須按照規(guī)定繳納費(fèi)用。
Article 4 Applicants for trademark registration， registration of assignments，
registration of renewals， the change of name or address of a registrant， the
replacement of a certificate， trademark review and adjudication or other related
matters must pay the prescribed fees in accordance with relevant provisions.
第五條國(guó)家工商行政管理局商標(biāo)局（以下簡(jiǎn)稱(chēng)商標(biāo)局）設(shè)置《商標(biāo)注冊(cè)薄》，記載注冊(cè)商標(biāo)及有關(guān)注冊(cè)事項(xiàng)。
Article 5 The Trademark Office of the State Administration for Industry and
Commerce （hereafter referred to as the “Trademark Office”） shall establish and
maintain a Trademark Register in which shall be entered registered trademarks
and relevant registration matters.
